  1. Oh yes I forgot to mention. In their second letter to me detailing the compensation amount etc, they enclosed a fresh Loan Agreement ( and Direct Debit mandate ) for me to sign which with the compensation deducted from my arrears, would have meant a marginally lower monthly repayment. When I spoke to them last Friday, I said " No way am I signing a new agreement with an amount you know I cannot afford as we already have an existing deal with me paying a far lower amount each month." Yesterday they accepted this and I am awaiting another letter confirming all this. WF have not really changed as they also enclosed another document titled " Customer Settlement Form " for me to sign agreeing their Compensation Offer. I am not signing anything at this stage until the FOS have seen all their letters and other docs that I am sending.
  2. Hi Steven, These are the SAR's that I am sending to Welcome. (1) Copies of the two Loan Agreements (2) Copy of the Underwriting Sheet relating to the 1st Loan Agreement (3) Copies of all Statements for both Loans Are there any other SAR's that I need to send as I want to get this right and provide the FOS with all the correct information so they can look into my case.   3. Hi again Steven, Right I am going to town now on this matter and SAR WF all the documents that I need. I will then write to the FOS and send them all that I have. My copies of the two loan documents are hardly legible so I will SAR them too. This will give me something to really get my teeth into. Thanks again Voda
  4. Hi Steven, I receive from WF a " Notice of Sums in Arrears " staement every 6 months as they are required to do so. It lists the balance outstanding to them, default sums & default sums interest and the arrears total. Then it lists the past 6 months transactions. It's a very basic statement.

The PPI that they are refunding was added to a loan in the Autumn of 2007 but was rewritten in the Spring of 2008 with no PPI on it although there is a percentage of the PPI in the rewrite amount. Does this potentially make the second loan void because if so, I do not owe them anything now. PPS. The bloke that I spoke to at WF today really does not have much of a clue as he is only trained to do so much and no more. This is obviously a potentially serious matter and needs to be submitted to the FOS and CAB as I said in my previous post tonight.
  7. Hi, My 310 posts are not relating to this matter. I first started talking about this matter on 11th June 2010, 20:28 #10262 However,I do appreciate what you have just said though. However I need to know whether WF are doing something legal or illegal relating to this matter so I will now leave the matter with professional advisers such as the Citizens Advice Bureau and FOS. I will send them all the letters that I have received from WF and they can take it from here. I will not continue to discuss this matter on here anymore. In the meantime I am looking into whether I should witheld paying them any more money. Take care Voda PS. The £100 Compensation is an award by WF for any distress and inconvenience as per their letter.
  8. Hi again, Just spoken to FOS and told them all about it. They said that I should write to them with all the details and then they would let me know what they think. They could not give any answer to an outcome whether good or bad !!! Also they don't have any such template letter. Looks like WF may well get away with it although I am still in the jock seat as it's an unsecured loan and I suppose that I could stop paying them the agreed monthly amount until I get my money back this way. I would rather not go down that route though. I simply want a cheque with the distress compensation of £100.00 plus 8% interest. Any thoughts guys? Voda

Morning, I called WF this morning and the department dealing with the PPI refunds say that they cannot refund the £100 Compensation Fee and 8% offered to me but only knock it off the account arrears alongside the PPI refund. They said that the PPI department set up to sort out the PPI mis-selling cannot deal with complaints such as mine but I would have to complain in writing to the general WF Customer Complaints Department in Nottingham. This I shall do. Is there a template letter I can send or should I contact the FOS and ask them what they think or should write? Thanks in advance. Received a letter from WF this morning and as I have an outstanding loan with them ( account as they call it ), which has an arrears on it, they are deducting the £400 plus compensation from these arrears although this PPI refund + 8% and £100 distress compensation relates to two other loans that were settled by this other latest loan that is in arrears and has an agreed with them all charges and interest frozen and an agreed reduced monthly repayment. Can they legally do this? I await with interest your replies. Voda PS. Over the last two week's I have received letters from Allied International Credit(UK)Ltd and Rockwell Debt Collection Agency relating to debts that are "Time Expired". Of course, I ignore them (and in the past they go away and give up ) but then I get a phone call from Rockwell and put the phone down once they told me who they were. I have now instructed my Phone Company to change my number. It's time that Government legislated against these parasitic companies from contacting people after the debt is no longer valid. The type of individuals who run and work for these firms should get proper jobs and not harrass individuals who have hit hard times. So Debt Collection Agencies are at the top of my list of most hated organisations and people. Have a great days folks and thank heavens for this forum .... Voda A debt would become expired after 6 years under the Limitation Act 1980. The Limitations Act 1980 outlines the time limit within which a creditor can chase a debtor for outstanding debts. The Limitations Act 1980 only applies when no contact has been made between the creditor and debtor within the given time limit and only applies to residents of England and Wales. Creditors are given a fixed period of time to chase their debtors, which is outlined in the Limitations Act 1980. The time scale mainly depends on the type of debt and can be extended at the courts discretion. The time limit begins when you last admitted owing the money or made a payment.   15. Probably not ..... The agreement copies that I have are very faint so if they don't send copies when they write to me, then I will need to do a Subject Access Request ....
  16. Hi Postie, How are you? The first loan with PPI was settled by my taking out a new higher loan with PPI. Then my financial problems began with this second loan and my local branch consolidated the debt to one of their 1% loans without PPI. This is the one that I am repaying still at a much reduced but agreed amount with them. All interest and other charges are frozen. So I presume that the two loans with PPI are, in fact, settled and that is why they have contacted me. I will keep you and others updated. Have a lovely weekend. Voda

  18. Hi everyone, I nearly fell off my perch this morning when I received this letter from Welcome's Customer Complaints Department in Ruddington, Nottingham... I have never contacted them about the matter mentioned below although I did have another complaint about the way that one of the employees at my local branch spoke to me, that was dealt by them very satisfactorily. Have they a conscience as far as I am concerned? It seems that the new management are Spring Cleaning !!! Dear xxxx As part of our quality control process, we regularly check that our customers are being fairly treated. As part of this process, I have reviewed your records and I cannot be satisfied that the Payment Protection Insurance (PPI) policy that you took out with your loan was suitable to you. I am concerned that you would not have been able to make an insurance claim against the PPI policy because of your age at the time the policy was sold. I would like to make you an offer to compensate you for this. if you would like me to do this, please confim that the contact details that I have for you are accurate. I look forward to hearing from you shortly, and if you have any questions please call me quoting our reference shown above. Yours sincerely xxxxx Complaints Department I called the person right away in Nottingham and they will be writing to me within 10 days giving me details of their compensation and apparently this compensation covers two loans that were repaid. WHAT DO YOU GUYS THINK ??? PS. I still have an oustanding loan without PPI with them, can they knock their compensation off the amount that I still owe them.

  20. Awesome news Andie. Well done honeybun. My complaint to Nottingham was replied to by letter the other day and I was pleasantly surprised. More details soon but suffice to say the woman at the Feltham Branch will not be harassing me again and my phone number has been removed from their records ( in writing too ).   21. Hiya, I have no trust whatsoever in the FOS. All these people are in it together. "Jobs for the Boys" as my late father used to say. In fact I have no trust in Banks, Politicians and many other organisations. I was telling a good friend of mine about the nasty & patronising $%£"* who called me from the branch and said that my agreed monthly payment was not enough. My friend said that I should have said " In that case return my Building Society Account cheque ".......... Next month I will deduct the £10.00 that they charged me for their pathetic letter when I send my payment. With the ever increasing cost of living, I will soon be sending them a revised Income & Expenditue statement and will offer them an even smaller amount each month. Time for a " Cuppa Tea " I feel.   22. Hi Andie, Good to hear from you.... I cannot believe this company..... They have to be the most amateurish and puerile organisation that I have ever come across. I have had responsible and mature response from all my other creditors and yet this bunch of losers seem to think that they are something special and can ignore all normal business procedures, etiquette and financial rules. Good words I feel and will go in my official complaint letter in response to the letter that I received from them after my phone call last week to Nottingham..... This letter was from their Customer Complaints Department saying that I will be contacted within the next few days by their Complaint Handling Team. And then today, I received a letter from the rude %^&*" of a woman that called me from Feltham last week stating: Further to my recent letter sent to you on 27/8/2009 regarding your overdue payment ( hang on - recent !!!!! ), I am disappointed to see that I have not received a reply. Please telephone me TODAY to discuss this matter further. Your account has been charged with the sum of £10.00 being the cost of sending this letter. Yours sincerely xxxxx xxxxxxxx Firstly, this creature has never been in touch with me by letter ( and I would like to bet that she did not even work for WF back then ) and since July 2009, all my dealings with WF have been by letter and the odd phone call with the LCU Branch Manager in Sutton, Surrey and my correspondence with them is always by Recorded Delivery. My dealings with Sutton were mostly satisfactory and more professional than my dealings have ever been with Feltham. I knew that once the LCU Branch was closed earlier this year that all the old branch harassment and phone calls would begin again simply because the staff they employ are low grade commission based sales staff who do not have a clue what is right or wrong. So nothing has changed with the Welscum people and never will, I'm afraid. Actually I find them quite laughable and pathetic. "Oh hang on, I must behave in a mature and responsible manner" .......:lol: I will be in touch on here as soon as I hear more. Take care and look forward to hear more about your continuing saga !!
