Hi there. Have Halifax breached any formal terms or rules regarding the default process? They issued default notice on 13th feb 2009, says pay the charges of 450 pounds before 14th march 2009, stating, "If the action required by this notice is taken before the date shown no furrther enforcement action will be taken in respect of the breach. "If you do not take the action required by this notice before the date shown (underlined) then the further action set out below may be taken against you". Then I recieve a letter 21st feb 2009 saying that I have failed to repay the requested amount by the date shown in the notice, they terminated my credit agreement unlawfully? Now says that no further notices will be given etc. Do i have a case against them for this, have they breached any formalities? Thank you.

i want to focus my claim on halifax being unprofessional, not sticking to their letter of saying they would credit 140 pounds to my account, therefore keeping it in the unauthorised overdraft zone, while stringing me along until the charges went up to 500 pounds and then saying in a letter they're sorry but they want me to pay up. then issuing the start of a default notice. i want to get halifax to wipe this disputed amount and also now costs of 80 pounds and compensation for weeks of stress and inconvenience i have written my first letter and i can demonstrate that i have contacted the bank repeatedly to sort things out and got nowhere. docs are in the hands of the financial ombudsmen. how would i adust the letter before action and n1?

hi hugh. thanks for reading and replying. halifax took me 140 over the arranged overdraft with charges, it started with a bunch of charges, claimed hardship, they replied saying they would credit my account with 140 pounds and staff member said on phone that would go back in two three days and no further charges. i took that person on face value, just recently told sorry for any confusion, what was meant that 140 pounds would be waived of charges. sorry it's not the answer you were looking for, then swiftly after a default notice. i will get them for this though.

no, go for the full amount with interest and costs, also money to cover harrassment, intimidation and unlawfully defaulting against you when charges are involved if this is the case. also highlight how unprofessional they are as much as possible. write to your local newspaper too! -
also my case is with the financial ombudsmen cuz halifax haven't given me the 140 pounds they said in a letter on 19th dec 2008 they would credit that would have made good the unauthorised overdraft and charges, and they have defaulted me for this disputed amount, now risen to 500.

hey maroon, if i have already written a letter on grounds of hardship can i skip any part of the letters? if it's been months already haven't i already given them enough time to put things right? so i can proceed with out the 2 x 14 days?

if they have done a default notice in relation to charges, you can sort them out. however it's not illegal for them to withdraw the overdraft as far as i know. -

i recieved this today. same thing. when i questioned the charges they were trying on me. i think you have to be reasonable all the way along and slap them back with letters to show that you're no fool. boring, this is true. however, write letters to them and hassle them and take them for all you can! harrassment, breaking the banking code etc. -
