Sorry been busy studying, but got a letter from County Court on Saturday which was a copy of letter sent to HFO stating that unless they file the paperwork and pay the fee by 29 April 2009, they will throw the case out. Cheers.

Hi CCM so this is the letter they will be issuing. Then say they give HFO a week or 10 days and they do nothing, what happens next? Also how/what do I have to do to get the default that HFO have wrongly put against my credit record struck off?? Thanks.

I had them double check and called back and spoke to someone else and same response. Fingers crossed. By the way if they fail to file their AQ what happens to my case and also the default on my credit file? Cheers

UPDATE: Spoke to court today and they advise nothing received from HFO. They have my AQ and will issue a reminder to HFO today giving them 7 days to comply. The girl at the court advised me that should they not respond the case will be thrown out. Is this correct? Thanks.

Guess we just have to all sit back and hopefully patience will be a virtue and we will all get the result we want at the end of the process. Good luck guys. Let's hope for some good news for one of us soon.

Hi guys, still no news. Court yet to process my papers and so can't confirm whether or not HFO have filed their defence. This is such a long drawn out process. Fingers crossed they can confirm one way or another next week. (My deadline was 30/03).

No news yet guys. Will call the court later today, no doubt will be told as seems to be standard practice that they have a backlog and have not got to my case yet!!! Fingers crossed they haven't filed anything and I can win by default!!!

Yes I am not sure what all the rules and regulations are but the whole process seems to favour the enemy!!

Hi guys, update. I called the court today and nothing in from HFO. They have a backlog and so they will double check nothing has been received next week and then write to HFO giving them 7 days to respond. Afterwich the case will be suspended (I think that's what the lady said). What now? Guess like with a lot of this case, just sit tight and wait.

So given my deadline was today. what should I do? Wait till tomorrow to find out if they have filed their AQ? Thanks

Thanks for that yeah good news. Just wondered how long have you been waiting? Keep me posted. They keep trying to call me to discuss a settlement. I am tempted to call them and offer them £5 as full and final settlement and on the written premise that they have my default removed and confirm that any obligation or liability i have with them be fully exonerated. What do you think?

Just filed my defence with the court and surprise surpsie they have had nothing from the claimant yet. How come I received a copy already?? what are they playing at?

Spoke to Barclaycard again who have no record of my account and spoke to Monument have no record, so it's all on HFO having a copy of the quick reply card that i have signed, see scanned doc and also copy statements and then their made up letters. Also as the claim is under £1500 does that mean HFO/Turnbull did not have to pay to submit their AQ? Thanks.

Hi Atwozee , sorry but I don't have a default notice, I requested a copy of it, but all they have sent me were a copy of a quick reply application, copy statements and the notice of assignment. I requested a copy of CCA with all T&C's (not what they sent), default notice togther with proof of service (not provided), notices of assignment with proofs of service (not provided), the deeds of assignment to be brought to the hearing, full complete statement of account (provided)

The NOA is dated 25/02/2007 but there is no date by which to remedy the situation. It just states that with effect from the date stated that HFO have been assigned my account. That from now on I must accordingly direct all payments to HFO and then they have put their address telephone number and Company Number and then at the bottom it says Yours faithfully Monument (????) and no signature and lay out completely unlike anything they have issued previously.

Any help much apprecaited especially from this who have helped so much so far. Does what they have sent me, change anything? Shall I change my AQ? Help - going to submit it tomorrow. Thanks.
