  4. Thanks for that. I have had a complaint case with Barclays regarding the account and who holds it. I would assume that even after selling an account would Barclaycard not need to keep a record for 6 years? Thanks,.

  6. Wording from my claim - The claimant HFO Capital Ltd is a debt purchase company. The claim is for monies due under a regulated interest-bearing credit agreement. The asignee HFO Capital Ltd purchased the defendents account and all rights and obligations attaching therto from the original lender on 25/02/2007. The original lender was Monument. A letter of assignment has been provided to the defendent previously. The claimant also claims interest thereon pursuant to S.69 of the Count Court act 1984 at a rate of 8% etc etc.... HOPE ALL THIS HELPS. Still no date for court hearing, will chase them up again tomorrow. Thanks.

On the other side it says: Declaration CREDIT AGGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974 I am applying for a VISA credit card, PIN and cheques issued by Barclays Bank PLC, subject to starus. I have read and agreed to be bound by the Terms and Conditions (T&C's). I am uk resident who is at least 18 years of age and am not bankrupt. All the information provided by me is accurate. I authorise you to send me a VISA card with the terms stated in the enclosed T&C's. I am not an existing Providan or Monument cardholder. IMPORTANT - YOUR INFORMATION I have read and agree to Condition 21 of the terms and conitions which sets out how my information will be used. This is a credit agreement regulated by the consumer credit act 1974, sign it only if you want to be legally bound by its terms. HOPE THIS HELPS. AM I IN TROUBLE NOW? IS THIS ENFORCEABLE? There is no copy of the relevant T&C's. Turnbull Rutherford state that they have enclosed a copy of the signed agreement? Is the above a signed agreement, which is enforceable? Thanks.

  10. Guys, just hoping that some of you that have been following my case, may have enough knowledge and know my case well enough to confirm the strength of my defence and n particular the main flaws that I should highlight in HFO's claim, when this gets to court? Thanks.

  13. Still waiting for court date!!! Thankfully have managed to secure a mortgage in my wife's name only. Not ideal and make me feel a bit useless and all thanks to Barclaycard/HFO/Turnbull!!!!
  14. Still feel that the whole world of DCA's is under regulated and HFO in particular seem to push the boundaries of the law. I just do not understand how they are a legitamate business???? I am guessing that I am one of many being harrassed by them. Begins with phone calls from India and ends with Turnbull calling up (seems to be South African staff) and threatening legal action. Makes my blood boil the misery they cause.
  15. Hi DonkeyB, hope you are well. Look forward to you and others on here confirming that my case is water tight and that I have nothing to fear!!! Must admit this whole episode has very nearly cost me buying my own home, but due to my wife's salary being so high, we are able to buy in her name. Just wishthat if I win, I could sue HFO for my troubles. I did a rough calculation and at a conservative estimate, they have cost me over £3k in time and emotional stress.

  17. Hi DonkeyB, yes unfortunatley the best copy I have, although I did put it all down in words in one of my posts. As for Barclayscard they want my fathers bank statement, but as he is unwell and I do not want to worry him, I refuse to ask him to do any more than he already has for me. All I have are the copy of the cheque, copy of letter, proof of posting and confirmation of receipt. What I do not have is whether the cheque was cashed or not. This is the great problem, although at the same time my father paid off a Barclaycard debt as well, which was settled, so bit of a quandry. Also as I never received anything further from them, I assumed the debt settled. Thanks.
  18. One step at a time I think. Will wait for my hearing date and go from there. Hopeful that those more knowledgeable than me can assist me in compiling my case and highlighting if there are any areas which HFO/Turnbull actually have an advantage over me. I think my case is strong, but look forward to DonkeyB and some other more experienced members giving me their valueable time and experience in assessing my case. Many thanks once again to all who have assisted me thus far.
  19. Off topic a little: I see that many others have had problems with HFO/Turnbull and from their experiences it is easy to see that they operate outside of the rules. Surely there must be some way in which they can be shown to be of bad repute and that all their court proceedings be struck out due to their constant breaking of rules and disregard for the debtor? They seem to have got away with an awful lot compared to most other DCA's and feel that their haphazzard approach to collecting these debts, many of which are unjust or simply cannot be repaid due to circumstance, must be addressed. They are bullies and as such should be shown the same distain that they show towards their supposed debtors.
  20. UPDATE - Just spoke to County Court officer - he advised that I will receive notification of a court hearing and date within in a couple of weeks. Still got time to get myself ready, although this procedure is extremely timely!! Thanks.

  22. Desperate - need this sorted ASAP - the fact this shows on my credit report as an outstanding default means I cannot get a mortgage. How quickly can I get this sorted? What options do I have? - I did read somewhere that if 2 companies have put a default on your credit report for the same debt that is against the rules and seeing as Barclaycard had placed a default on my file as well as HFO, is there anything I can do? Thanks.
