  2. Hello! Time to drag up an old thread here! It's been a very long time since myself and legalpickle had to delete all the posts from this thread, the reason for this was that the Defendant found it and was trying to find any comments he could within it to twist to his argument. If ever there was a case of changing the facts to suit the hypothesis it was in his defence to this case! Back in August I had my hearing with the car dealer and I am very happy to announce that I won! I received my money back, interest and court fees which was extremely satisfying! I would have loved to have updated this thread long ago but the defendant showed his true colours when I had to take him straight back to court! Basically, there was property belonging to me on the car, that was fitted in the original work, which I rightly demanded back. The Defendant disagreed with this and refused. Needless to say, after many offers that were refused by him I had to take him straight back to court. I think we got lucky this time as he, for reasons unknown, acknowledged the claim but didn't file a defence and Judgement was filed in my favour by default. He paid 2 weeks ago so it's finally over and I can start 2010 without the hassle of dealing with this dodgy car dealer. Oh, and I'd just like to say (because it makes me happy inside) that the District Judge told the Defendant that he had no defence whatsoever! I understand that the primary reason for advising in public is to assist others with their potentially similar problems. legalpickle & I removed our posts because of the potential damage this was causing, but it was not our intent to refuse others the chance to benefit from this advice. Therefore we have scanned in the main documents relevant to the first claim, and attached them as PDF files - removing confidential details - so that others can see how it's been done. The man has been a great help and at the very least has proofed my work, most of the time giving very constructive criticism and suggestions on how to better write the documents. The amount of time and effort he has put in to help me with no expectations of reward (apart from another win to add to his collection) has been nothing short of amazing! I seriously doubt I would have got this far without his help, and I certainly wouldn't have learnt as much about my rights.   3. Mopeds are usually restricted in some way though, and that is how they stay at around 30mph. Usually this will be a rev limiter. If this is the case then it could weigh 1kg and it will still only hit 30mph. In this situation a dyno test would be completely adequate.
