  1. Hi All, I've recieved a leter today from Macenzie Hall. They are chasing a debt passed onto them by Aktiv Kapital that is statue barred and also in dispute as they failed to provide me with anything when i CCA'd them over 18 months ago. Do i tell them to go away as its in dispute still and also statue barred or just go down the statue barred route? Many Thanks
  2. Thank you. I've never CCA'd them before but i think thats my next step now they've messed me about. I've never spoken to them on the phone, the line is only for the internet and somehow i've managed to keep my mobile number from them. I'm so annoyed that i've been trying to do the right thing and they penalise me for it. The thing is, i know if it gets to court then they'll probably end up with less than they do now!
  3. Hi All, I've been repaying an Egg debt back through ARC. After a few initial problems with them we agreed a monthly amount and i've been paying by s/o for aprox 6 months now. 2 weeks ago i got a letter with a 'fantastic offer' to reduce the balance by 20% if i paid up within 7 days. The letter did clearly say that if i didn't want to take them up on the offer then my agreement would carry on as normal. I didn't take them up on the offer but i did up my monthly payment to £35 and also increased the payments to 4 weekly so i'm making an extra payment a year to try and clear the debt a bit quicker. I've recieve a letter from them today saying that as i've broken my agreement with them they've issued court proceedings if i don't pay the full balance within 7 days. Have i missed something or does increasing payments break the agreement? When i first agreed the payment terms they made it clear they'd be on at me to up it on a 6 monthly basis. Just wondering where i should go from here. i'm not going to stop the payments as if it does go to court i want to show its not me thats been messing them about. Any help appreciated. Thanks
  4. I had a letter along the same lines from them today. They've tried to up my payment to £4o pm and because i said no i've now got the letter that says i've defaulted on the agreement. I'll be sending a complaint today and asking for proof of this so called agreement. As far as i was aware, me saying no its not happening doesn't equal an agreement!
  5. Hi All, Just wondering if anyone knows if Moorcroft actally ready any of the letters that get sent to them or do they just get chucked in the bin?! For the last few months they've been chasing me for a Natwest debt. I'm already paying NW direct and they are happy with the situation but Moorcroft are still chomping at the bit. I've sent several letters explaining i'll not be paying them and its already being dealt with etc but they still send out the automated rubbish that says i need to pay them now or they'll sell my kidneys etc. The last letter said they realised i obviously couldn't pay so would happily accept £40 pm, i sent them a letter to say get lost. Todays letter says i have not honoured my agreement of paying £40 and so they are adding a £25 charge:-x. I thought an agreement was when you actually agreed with something?! Can they actually add charges if they are just collecting and don't own the account? Thanks

  7. Thank you for your help Mistermind. I guess i need to get the idea out of my head that Egg will be more resonable than a dca. I was quite happy dealing with DLC, i'm just angry that the account has been passed across to ARC with no warning or reasoning and they seem like the worst dca i've dealt with so far. The reason i don't seem overly stressed is because they don't have my phone number so all contact has been written only, it's taken the pressure off immensly and is probably making me feel braver in dealing with them as i know they aren't calling 10x a day. I will compile an i&e to send to them but am i also able to stress that even though i've provided this i can't juggle my money to pay them more. What happens if they decided from my i&e i can up the payment? Thanks
  8. I think i'll post one last letter to say i won't be sending an i&e as it won't make a difference to the amount i can pay. I've also made sure my payments are set up through Egg's online site so i have 2 records that i'm actually paying. Looks like i might have to end up down the CCA route after all though.
  9. Mistermind, i have no problem doing a i&e and sending it i just don't really want the info going to them. I've been paying Egg directly for the past 2 months and they've never contacted me to say please pay ARC instead or that my monthly payment was not enough. I know if i start coughing up to ARC then they'll take a cut and the debt will take longer to be paid off. I've got records on my bank statement to show i've been paying apart from when this was in dispute so hopefully if this does go before a judge they can see that i'm trying to clear it.
  10. Well as i thought ARC have rejected my payment offer and have said they/their clients require an income and expenditure from me. Am i right in thinking that the only people i'd have to provide this to are the courts? Even if i do provide one it doesn't mean i'll be able or willing to pay any more per month than i've already offered. They've said i've got 14 days to send the info or they'll instruct their solicitors who i believe are Trevor Munn. Does anyone know if they ever take anyone to court? I've seen threads where they've made threats but no idea if they ever take it further. Thanks

  13. Thanks for merging these for me, wasn't sure if i could do that or not. dx100uk, i didn't CCA them, i did send a S.A.R though to claim back the charges which they replied to. I know i should be sending a CCA request but i'm reluctant to open that can of worms at the minute. After reading some of the other threads it seems that a lot are enforcable and i don't want the stress of trying to argue it out with them when i've got a new baby. ARC keep stressing that the clock is ticking and no matter what i ask of Egg they'll still be chasing me. I just want to try and get it under control before i have any more on my plate! I'd like to avoid an income/expenditure if i can as i want as little to do with the dca as possible. I know its likely they'll force the issue though and say they need one before i can set up a payment plan.
  14. Hi all, I previously posted in the debt collection forum but thought it might be worthwhile doing a post here too. Basically i have an outstanding Egg card debt that has been passed to DLC and now onto ARC for collection. I was making payments to DLC and only stopped when i disputed the charges on the account. At first DLC forced me to pay more than i could afford as i didn't know i had a choice. I susspect they've passed the account on as i reduced the monthly payments. ARC sent me a letter saying i need to make a substantial payment and set up a repayment plan with them. I don't want to cca them as i can't deal with the stress right now and just want to get something sorted so i can forget about it for a while. Just wondering if anyone could help me put a template letter together saying that i'm willing to pay but can only afford xx amount etc. I'm hoping to get this sorted asap as i understand the next lot of letters will be from Trevor Munn saying it'll be going to court. Hope all that makes some sense. Thanks in advance
  15. Thank you both for the advice. I don't really want to go down the CCA route as i'm pretty sure its an enforcable agreement and also i'm willing to repay the debt i just don't want to be forced into more debt by making stupidly high repayments just to please the dca.

  17. Hi All, I've got an outstanding debt with Egg that went into default in 08 and was passed onto DLC for collection. Before i knew where i stood they bullied me into paying way more than i could afford each month. Thankfully i found this site and reduced the payments. They complained a bit but seemed happy enough to accept a smaller payment over none at all. I've been paying the debt back for a year now apart from 3 months last year when the account was in dispute over excessive charges. I've always been willing to pay back the debt and have always reponded to every letter thats been sent. Lat week i recieved a letter from ARC Debt Management saying my account had been passed to them to collect as Egg have been unable to get anything from me! They've said i've got 10 days to make a substantial payment towards the balance and agree a repayment plan with them or they'll be taking me to court. I don't really know where i stand with this one a i've been making payments and at no point have said i'm not paying it back. I don't want to call them as i know they'll just go all out with the threats so i start paying them. Any advice would be much appreciated. Sorry its so long!!
  18. The debt is basically made up of charges i think. I had a small overdraft and went over it so got the £40 a time charge for it. It built up when i couldn't repay it. Its for a normal current account. They are calling but i don't answer as the line is just for the internet. Had about 4 letters though so far. I'm not too worried about the threats, i'm just annoyed because i've already started repayments with Natwest and these guys have waded in.
  19. Hi All, I've had some invaluable advice from this site in the past and was hoping i could get the same again if possible! I've got Moorcroft chasing me for a small Natwest Debt (under £500) for and overdraft. I'm recieving all the usual threats from Moorcroft saying i need to repay the whole amount or they'll take me to court etc. I've already set up a repayment plan with Natwest on their automated site - i'm more than happy to repay the debt but haven't been in a position to do so until now. What i'm wanting to know is if these are empty threats to scare monger as usual or if they will take me to court for what i think is quite a small amount? Also if anyone could help me word a letter to stop their threats i'd be most greatful, i'm a terrible letter writer! Many Thanks

  21. Hi All, Just wondering if anyone could point me in the right direction. I've sent an SAR request to Egg, not well over the 40 day limit and i've had no response. The account is being collected by DLC and i've reduced their monthly payment to one i can afford - the pushed me into paying back more than i could afford before i found this site! DLC are threatening me with court action even though i've sent repeated letters stating i'm disputing the charges with Egg. I'm not unwilling to pay, just unwilling to pay the charges as i know there must be a hefty amount making up the balance. Just wondering if there's a letter i can send to Egg to chase up the SAR request, i gather they tend to drag their feet a bit in the hope you forget. I don't want to ring them as they just say i need to deal with DLC and there's no way i want to speak to them. Any advice appreciated.

I'd like to S.A.R Egg so i can claim back the charges on my account, it's in default at the min and i think there's probably a lot of charges so should make quite a dent in the balance.   23. No definately not a big discount! I think the debt is only £340 so they're not willing to miss out on too much commission. I think they've realised they're plogging a dead horse but seem to carry on regardless.
  24. Hi All, I sent a CCA request to BCW before Christmas and got the usual response back that they don't hold copies so they would get in touch with Aktiv Krapital to send me the details. In Jan i got a few photocopies of some statements and a few pages that even belonged to someone else! They sent another threat-o-gram about 6 weeks ago so i sent them the Account in dispute letter on the 3rd March. Had another letter saying they would pass it onto AK again but heard nothing from them until yesterday. The letter was offering me a reduction in the debt or to set up a payment plan blah blah. Just wondering what the next step is as they're over the timescale for the CCA. Has anyone got a template for what i can send next? Many Thanks:D
