  1. Hi need some advice from you fellow caggers please.

     

    I sent of the standard CCA request letter to BLS collections on the 6th July 09 for an old credit card that I took out in 2005. I never heard a thing from BLS apart from the usual hassle letters and phone calls.

    BUT today i recieved this nice little letter with what they consisder a credit agreement, the agreement is unsigned and is a new one with just my name added.

    The opening letter states that they have fulfilled my request.

    Any advise on how to respond would be good.

     

    I did send them the account in dispute letter already a few days ago.

  2. I hoping someone here could advise me if Lloyds are correct in what I received today?

    I had a coupe of loans and a credit card with Lloyds that got passed on to the very nice people at BSL.

    Earlier this month I CCA’s BLS with 3 postal orders made out to BLS with 3 separate letters, today I have received a letter from Lloyds and 2 of the postal orders returned saying they can’t cash them as they have BLS on the name.

    I thought BLS were dealing with this debt, can Lloyds do this?

  3. I hoping someone can advise me of the best way to approach Swinton regarding my cash back claim.

    I used compare the market to get a quote and was offered £90 cash back with Swinton, during the process I didn’t have all the information. The next day I phoned up Swinton asked if my claim could be retrieved and the operator said he can re-enter the details, I did ask if I would still get the cash back and was informed yes.

    When I finalized the policy over the phone with the local branch they told me it would take 3 months to receive it.

    Well its 3 months gone so I chased swinton up for my money and they informed me that as I didn’t take it out over the net I was not entitle to it!! They have also stated that they checked the tape and there is no mention of cashback.

    I feel really had over by them, can anyone help?

  4. Its been a while but as we all know Cabot are not the fastest at getting stuff done especially when they are charging interest!!

    I sent the CCA request off back in January and got the standard replies back from Cabot, they are looking for the agreement etc etc…..

    Then as if by magic I got a big thick envelope through the door.. oh dear!!

    It does contain the letter of agreement I originally signed it also shows various personal details about myself, work, salary, bank details.

    I can’t see any other information as its just so unreadable, I’m not sure if the terms and conditions are on their as I can’t read it. If they are they only take up less than a ¼ of one side ofA4.

    I also received what they call ‘Notice of assignment’ this has wrote in pencil across the top ‘representation of letter sent’ it’s dated June 09 and is from Barclays and I’m 100% sure I never seen an original letter like this.

    Could anyone help or advise me on what to do about the letter of assignment and the unreadable alleged credit agreement?

    What letters could I send these cowboys?

    And how do I get to find out if they have a default notice?

  5. I got a letter from the DCA today which states:

     

     

    Dear Mr*******

     

     

    RE: CL Finance LTD and Yourself - Balance £****.**

     

     

    Northampton - 8XXXXXXX89

     

     

    it is with concern that we note you have not made payment of this debt as arranged.

     

     

    Further delay cannot be tolerated and you should note that if a remittance is not received at this office BY RETURN OF POST our instructions are to apply to the Court for Judgement to be entered against you. If this course of action is necessary further costs will be incurred which you will be responsible.

    These costs will be added to the judgement debt.

     

     

    We trust that the above mentioned action will not be necessary but should we no receive payment no further notice will be given.

  6. well my friends at howard cohen have been in touch again today, i recieved a letter almost identical to the last one

    The amount of money owed has gone up 2% in 17 days.

     

    This letter is dated 20th March.

     

    It looks like they decided to give me further notice, how nice of them!!

     

    The claim number is the same as the one struck out.

     

    Any advise on what to do, is it worth sending them a letter stating that the debt is in disbute and the claim has already been struck out?

    Or do i just keep ridding the storm and see what happens?

  7. Well met a right bunch of aggresive idiots earlier.

    Had a BT debt sent to CCS then they have sold it on to:

     

     

    ScotCall Debt Collecting Services

     

    These are a real bunch on special people,

    The first thing you get is a threat of a home call, i told them they would not be welcome he just asked me if i lived in a castle and he can come when he likes..

     

    Has anyone any story's of dealing with these or advise?

    Yourbank, they had there claim thrown out.

    They made the claim after they took over the account from HFC, i kept maiking payments to HFC as thats who I thought i should be paying. The first i knew about CL was when i got a court claim against me.

  9. I have had my county court claim struck out that CL finance were trying to bring against me, I recieved a formal letter yesterday which stated:

     

    Before An Officer Of The Court sitting at Northampton County Court Northampton NN1 3QH.

     

    Upon non compliance with court order of the 05 January 2009

     

    IT IS ORDERED that

     

    The claim is struck out.

     

    Dated 13 March 2009

     

     

     

    My worry is that my defence was based on regular payments were being made and no CCA was produced when requested. once the case was over I sent CL the account in dispute letter and stopped payments.

    I'm worried that they may apply to the court to re-instate the claim, does anyone have any experience of this?

    Can I adjust my defence if they do?

    Can i do anything now to stop them re-applying
