ok well i stopped with the claim after the test case was announced, now ive seen the advice on here to continue, thats what i plan to do now..... So the banks are still applying these charges to peoples accounts, even though they have immunity from dealing with complaints ? ? is this right? ? i went a few pounds over my limit again after a bigger bill than expected from BT came out via DD.... IM Expecting a charge to be applied to my account, but the bank has immunity from dealing with a complint ???

Hi, Thanks for the info on the Bournemouth court, are they sure to reject MCOL then ? because its kind of difficuilt for me to get to the court.... do you have to pick up the N1 form from the court too ?

im near bournemouth, i dont know what court i would use as in new to the area, the account is indeed still open, its a graduate account and they are now charging more interest on the debt as well !! grrr so they advice would be to get an N1 form ? where can u get such a form ? do you still have to fill in the particualrs , which i dont understand ? thanks for your replys guys

Hi, im looking for a bit of help after leaving my claim to go stale since the end of last year. Ive sent off both the premiminary letter and the LBA and now ive had ABBEYS response saying that they will not refund the charges and if i want to complain then i should go to the financial ombudsman..... I take it that the right thing to do now is to enter my claim on Money Claim. ??? Ive started this but im a bit stuck with the particulars section, would anybody be able to point me to an example ? Basically i have about £900 + interest due back to me but i dont want to mess up the form online in anyway, Any help or guidance would be greatly appreciated ! (i must have missed the section for this in the forum if there is one, i cant find it ? ) Kev

Hello to anyone who has the time to view my thred. Its been a while, infact over 2 months since i requested the statements going back six years on my abbey student account. I have finally recieved the full set of statements and counted £901.84 in charges without claiming interest. Its been so long since i asked for them that i have forgotten the address to which i sent the request. I will now keep this thred upto date as i aim to reclaim my charges as soon as popssible *had no idea they were this much !!!!! ive had a look on the forums here again, but i cant find the address i need to send the LBA to, would anyone be kind enough to help me out here please? Full statements arrived by post today, initially looks like 900 of chargeS. iT WAS more like 1200 but looking back, i have complained and already had some refunded over the phone. Starting to make the hit list spredsheet for charges, then hopefully i should have my LBA in the post to them by the weekend ! Kev

Im at the stage of sending my LBA to abbey for £900, recently they changed my overdraught to £900 without asking me. I was thinking that this may be to close my account when i ask for the 900 back.... that will make the balance 0 Has anyone else had their accounts closed by abbey yet

Mike, Im in exactly the same stage with shabbey providing nothing more than the last years statememnts. Really i would like to take them to court to force them to provide the remaining statements, does anyone know if we can do this online or would we have to go to the county court?

I have exactly the same letter as you in front of me here, im thinking maybe we should give them the extra time they are asking for and wait for the microfiche statememnts to turn up, we could submit a LBA based on an estimated charges, and ammend the claim if/when abbey send the rest of the statements. or we could try to force them to disclose the info in court (i think this would take longer than they are asking for?) Personally i was going to give them another month to supply the details and then if not i was going to submit a big estimate of my claims, they cant say i didnt ask them for the full breakdown ! I would be interested to know what you are planning on doing, like you say it seems that we are both at the same stage in our claims with shabbey irrational.

Thanks for the comments! I will apply for the natwest account They have said that the rest of my statements going back further than this are on microfiche and will take 6-8 weeks longer to provide. I cant understand how im ment to force them to cough up the info though and i may go with an estimated claim? any thought on the best thing to do next?

I feel its time to start my own thred here to log my actions against shabbey irrational. I hope it will help others in some way but i am not 100% sure what im doing myself ! Today i have recieved the last 2 years of full statements in the post after requesting DPA on the 26th of May. Shabbey responed to my DPA initally with the standard microfiche fob' off garbage. Within two days shabbeywere looking at the microfiche response letter from the template library on here I estimate my claim to be around £2,000 although they have conveniently, only provided my statements since ive been in full time work, i know the bulk of my charges are from my student days ! I plan to leave it another 2 weeks before sending my LBA with an estimated claim, as i see abbey are closing peoples accounts down and i may not be able to get aother one easily! can anyone suggest an account for credit problmes that will allow direct debit to be set up ? I would appreciate any comments if someone happens to read this ! Kev

Thats the same address thats on my letter from pam speed, interesting that she gives the standard 0845 654321 abbey phone number for any questions you may have ! She has my microfiche template letter on her desk this moring i would think ! Bring it on abbey you (edit) little gits !
