  1. your right clemma, obviously they can still do what they want but we would not be where we are today without you. were not worried about them coming to the door as we know our rights, you are a godsend and i didnt realize angels flew so low. will keep you posted on anything else that happens. thankyou
  2. thankyou for the advice its very welcome and greatly appreciated. thanks to clemma, lefty and plumberjohn we now know our rights so we are not worried about someone coming to the door. our only concern is the legal stuff. Im surprised that we had nobody from the store visiting us though, but saying that we did record a particular conversation with them and advised them of it and it was a serious issue.
  3. things will eventually come back to bite brighthouse in the ass, just look at welcome finance, they are on the verge of going under and its down to there poor business model of ripping people off and of course.. bad accounting.
  4. Just thought i would update my thread. Our last contact from them was 05th march when they put a caversham finance card through the door to ask us to call them or they would re-visit us. Seems atrange that we have had no contact from them since the christmas. Considering that we sent e-mails to ann healey, recorded letters to there head office and local branch, just seems a bit strange, maybe its the calm before the storm. is there normal practice??!!??
  5. what a crock of crap, typical DCA trying to influence people to call and resolve there issues. The reason he has posted this thread is that people that have hit hard times due to this recession and are being chased for money have wised up to there tactics and thanks to the good people of this forum are armed with the information on how to deal with these infestations of society.

Hi all As i stated on my last post we had not heard from BH but we came home yesterday to find a note placed through the letterbox from "Caversham Finance" requesting that we call the name on the card within 24 hours. We sent recorded letters to our local branch and head office stateing that we would only deal in writing. What they have done is completely ignored our request for all communication in writing, infact they have not even acknowledged our letters but just decidede to send someone round. If anyone can give me any help or advice on what steps to take i would be grateful.

  10. We have sent out cca`s to a number of companies (mainly Crap 1) to confirm if they have a copy of our agreements. None have been able to supply us with a copy and we have sent out the second letter to them all advising them of unenforceability. My question is; we have been paying dca`s an agreed amount for a few years but they if they dont have an agreement can we claim back any monies that we have paid to them.
  11. Hi all Arrived home from work today to be greeted with an answerphone message from Bh regional manager. He has stated what we requested in our letter that we wanted to be dealt with by an area manager and has asked us to call him but he will call us on either our home number again or our mobiles. We stated in our letter that we will only deal with them in writing and that is how we want it to be dealt with; obviously this is so we have a paper trail and emotion is kept out of it. What steps should we take now.
  12. well lets hope that clearing there own loans is ilegal and therefore giving more people the ammunition to send them to an even earlier grave
  13. Its interesting that they carry this practice out with most customers. How would there current debtors be serviced if they were to go under. I presume that the debts would be sold on to banks.. ect ect

  15. I am currently trying to resolve some issues with welcome finance, also trying to find out if my agreement is enforceable or not. One thing that is becoming very apparent is that welcome seem to be able to pay off there own agreements with new loans. There is a lot of speculation that this is an ilegal practice and i have not seen anything to sugest otherwise. Does anybody actually know for a fact if it is an ilegal practice or not.
  16. Just to keep you all up to date. Not had a phone call now since my last post so can only presume they have taken notice of our harassment letter. We have had no more letters from them either. Just a bit on edge as to what there next steps may be
  17. Hi Clemma Have all the relevant paperwork and will now contact the police and folow it up with a letter. The calls are ridiculous, all i do now is hang up when they speak. One message however did make me laugh, it said "do yourself a favour and get down here now". I pity them and just find them such a poor, badly trained, moronic cretins. My partners job is regulated by the FSA and if they step out of line by giving the wrong advice or mis-leading people, they are dragged over the coals as the fines can be huge as well as the damage it does to there business. They are mystery shopped by the FSA constantly and it surprises me that regardless of the FSA making there presence heavily felt within the money industry, brighthouse still seem to be flaunting the rules. Its only because of you guys giving up your time to help people like me that prevent them getting away with it.
  18. hi clemma have the receipt for recorded letter to them about phone calls and have copies of all letters sent. looking at these defaults, they are "Notice of default sums" and it states ..... This notice of default sums has been served under the consumer credit act 1974 because default charges have been added to your agreement. It then goes on to say the product and the amount of fee being charged for late payment. DCA, your posts are so cool, i always look forward to reading them, also thanks for the advice.
  19. Hi guys Received default note today but had no respons from either Anne Healy or head office, just constant barrage of calls on both mobile phone and house phone asking for us to call them.

  21. thankyou for your help, i appreciate it so much and its because of you guys i feel confident in challenging them. Im going to speak to the OFT and the fsa tomorrow and seek advice as they cannot legally tie all your agreements together, its the same as the bank tieing in your credit cards and bank loan in one and not allowing you to pay one without the other. Il also send an e-mail to anne healey, DCA, do you have the address of the CEO. Im taking this all the way. In my line of work i am governed and certified by the FSA and have on-going training to ensure that we are always fully compliant. we are are very concious that the FSA are currently doing a generic sweep of any business that deal with finance and insurance through mystery shopping and audits, the consiquences of mis-informing or mis-advising are massive, they are even checking databases and contacting people that have recently purchased products on finance or had pensions or insurance products.,the reason i know that is because they called me and asked if they could visit me at my home and go through the details of the product insurance i took out recently. I invited them to my home and they went through my agreement with a fine tooth comb and the questions were very thorough. I just hope that bh receive a visit.
  22. Hi clemma i dony know if i have explained this properley. I have four seperate agreements, all signed with there own terms and conditions, on differnt days and months. I am two weeks behind on them all. what i want to do is bring one of them up to date by paying my arrears and paying it in full every week so im not in default on that agreement and if i was to lose the goods then i wont lose this particular item. With the other three i am wanting to try and agree lower monthly payments. I understand that Bh will more than likely not agree to me making reduced payments on 3 of my agreements but they have no right to stop me paying my arears on one of them and paying it full every week. they are saying they wont accept payment on one without the others even though they are seperate agreements all signed on differnt days, differnt months and differnt years.This is wrong as its forcing me to default on that particular agreement. Ive not received an official default notice yet, just a letter to say that on will be issued. we have posted a letter to BH advising of our current situation but as yet had no reply. because i am being forced into default by bh on one agreement i just need some advice on how to take this further and what governing bodies to complain too. Clemma and lefty, as always i really appreciate your advice and along with plumberjohn your fast becoming icons on this forum. thankyou so much.
  23. we have drafted letters to attempt to expain our situation and are looking for a bit of help from them and they have been posted recorded.My issue is that the only way to keep the agreement that we want to keep up to date is to pay over the phone but they wont accept payment so are putting us in to default, i need advice on what to do about this. Do i send a letter to the branch with these concerns, do i post it to there head office and who do i complain too outside of brighthouse because this practice must be ilegal. thanks
