Just spoken with 'Tony' from CSL who in a increasingly agreesive tone, suggested that CAP ONE would go for a charging order as the next step, even though there's no CCJ - Can they do that or is it BS? Also, he said I had never disputed the account (not true) and the next step was a door step collector. Asked what would be the conversation with the door step collecter would be and he wouldn't say. Told him door step collector wouldn't be welcome and that I'd be writing to them, he told me not to bother. I did a CCA request last October which they haven't compiled with, they will accept 70% of money owed, but I can't stetch to that, what should I do? I can scrap together 50%
  2. I have 10k CC with HBos which is currently on a very high interest rate. The CC want started in July 2007 I started a Payplan in the hope that they would reduce the interest payments but that never happened. (I had no job at the time) I came accross this site in Jan and the asked HBos for a copy of my agreement which they haven't produced. So I stopped paying payplan and have ignored the phone calls for the last 3 months. But, I've since found that as my agreement started when it did I may have an enforceable agreement. The reality is I'd like to pay off the debt, with reasonable interest (they hiked it up when they banks got in trouble) at the same time as my business failed. I can't afford to repay it all at once. Whats my best way forward?
  3. I also started an agreement with pay plan @ HBOS suggestion, but they didn't stop the interest charges (25%) so I stopped pay plan. Did they stop interest charges for you? I also wrote to them and got the same letter back; but my agreement was July 2007 and I'm not sure I'm covered under the not enforceable due to the amendment to section 127
  4. I got my list of charges from NW (£2,700 ish). I had an overdraft of £3,400 ish. I sent a letter offering to pay the difference. I'm in debt payment plan so had I&E. NW returned £900 to account, but the following day handed the account to Moorcroft for collection. Moorcroft want to collect 4k for NW and £200 costs. Letter is intention to litigation. I want it to go to court, as I want my offer of fair payment heard.... Is moor croft just bluffing or will this go to court? I spoke with NW flex collections who told me that as the account was in dispute nothing would happen until after the test case. (I recorded this call).
  5. Hi All, My first post, I've searched but not found an answer. I sent a request for my copy of credit agreement to capital one, have have recieved a new one, not the original. Is there a template letter to request the original? Regards
