  1. Hi mine is here http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/163292-morgan-stanley-1st-credit.html?highlight=1st+credit. I had an account with Morgan Stanley, then it bacame goldfish and it has now been sold to first credit who have been very abusive. But following advice on this forum I CCA'd them and it has now been 12+2 days, and then another 28 days and everything has gone quiet for now. I will keep you posted. many thanks

  3. Hi All Well the 12+2 came and went, and the letter which 1st credit wrote to me advising the CCA will be with me in 28 days expores tomorrow. Upon reading the threads on this site I am unsure as to what I need to do. It is unclear what my rights actually are once the 12+2 and the 28 days have gone by. there seems to be a couple of answers, should I just leave it until they contact me, or do you think I should contact 1st credit with the offer of my payment plan again? As I said I don't want to dispute my debt and would like to come to a fair agreement. 1st credit haven't written to me or phoned me since the letter so I assume it's not gone away, but they have been unable to locate the CCA. Many thanks in advance for your help.

  11. Hi I am new to your site and had a payment plan in place with morgan stanley (now goldfish). its for £2800 and I was paying £25 per month. This was all going fine but then out of the blue they sold to 1st credit and I had my first threatening letter and called them when they told me they would settle for 2200 and i would need to pay half in 7 days and could pay the rest in installments over 2 years, which is a lot more than i can currently afford with 2 small children I asked how they expected me to come up with that sort of money and they suggested I ask family and friends (I thought they weren't allowed to ask you to borrow money to pay them off? . Once the 7 days were up they were back on the phone sharpish and were very abusive when I asked for a CCA saying I had already admitted the debt when I called them last time, they basically had a huge rant down the phone advising me they knew i was a homeowner and so would be putting a charging order on the house and could make me sell it, then said they would start legal action straight away and slammed the phone down. I found this really upsetting as I wanted to carry on paying them the £25 but they refused. I don't want to dispute my debt or not pay it by asking for the CCA but think it is the only thing I can do with the way they are treating me. I really don't want a CCJ against me - the credit crunch is hitting hard and I think I am being reasonable. I rang the CCCS after as I was so upset and they were lovely and advised me to do exactly the same as on your site. I sent the CCA request recorded delivery yesterday with a postal order for £1 all unsigned so i will keep this thread updated with any updates. Any other advice would be appreciated, many thanks:)

Hi there I am new to this forum and am in exactly the same position as you - my '7 days' to find the full amount is up and they rang me on monday with the usual threatening behaviour saying they can make me sell my house, put a charging order on etc etc which really upset me as i have 2 small children. So I asked for the CCA and they said i had admitted to the debt already and they would commence legal action immediately and slammed the phone down. Yesterday I fired off the CCA letter recorded delivery with £1 so we'll see what happens. I rang the CCCS and got quite upset but they were lovely and are giving the same advice as you guys. I've had a few sleepless nights but now I say bring it on because they are cretins - incidentally - i went on their website and they say they are leaders in debt collection and try to come to sensible agreements which is a load of bull, and then i looked at 'carreers' and they get commission. no wonder they are so abusive. I'll keep my eye on the thread and let you know what happens! thanks for all the advice and template letters so far X
