Yes sure do, the Girls name was Naomi, As the message I received also implies its still a pre sale opening offer, the following is on the cooling off form on there website "Those who have joined online or during our pre-sale club openings and wish to cancel during the 14 day cooling off period will be entitled to a full refund."

  12. The 9.99 was there pre sales offer as the normal 12 month membership is 14.99, plus the email acknowledgement I received said I was an online member. There T&Cs are very contradicting. My membership cancellation request went in under 24 hours from when I joined so same day retrospectively. Not sure best course of action to take, when I signed up in the club the girl said I had the 14 days but guess they're just puppets on strings.

Hi, Seems these guys are popular I joined the new gym in person on their 9.99 offer, the next day I filled in their 14 day cancellation form on their website 10th Feb, I have the proof of email from their end. Does anyone know if they actually get back to you, is it safe for me to cancel the DD, would they make any entries on credit files? I've read stories that if you sign up in house you're not eligible for the 14 day cooling off is this true? TIA
  14. Hey, haven't been around for a while, still trying to deal with 1st Credit. I offered them a full and final as they haven't been able to come up with the goods, have been corresponding via email after the original letter sent to them. Then sent me this after I raised my offer from 500 to 800, can someone take a look and give me a decent reply. Thank you for your email and comments in respects to the situation. Your offer of £800.00 is not deemed a reasonable offer based on the fact this is a credit card debt. This is regarding purchases made with a card which have not been paid back. We are still looking into your request for copy of the invoices to provide you with details of the amount. I have put another request for the copy agreement since we are still waiting for this information. We are not prepared to remove default that we consider to be correct.[/font] You may wish to consult the website of the information commissioner who defines a ‘default’ as follows; The term ‘default’, when recorded on a credit reference file should be used to refer to a situation when “the lender in a standard business relationship with the individual decides the relationship has broken down”. In our opinion theagreement does not become illegal or void because we have been unable to provide a copy agreement. We are unaware of any sanctions expressly stated in the Consumer Credit Act that provides for any remedies or for sanctions where monies are paid by the customer where the creditor is in breach of this section.   15. For an IVA you need to have been in full time employment for at least six months. I would ring the debt helpline or CCCS or Payplan, they are all charities Also at the same time send CCA requests off for your Loan and CC and see what they come up with if anything
  16. Thanks for that, but where does it state the twelve days, also in there it still says after one month he commits an offence - I thought that was repelled or am I wrong? (6) If the creditor under an agreement fails to comply with subsection (1)— (a) he is not entitled, while the default continues, to enforce the agreement; and (b) if the default continues for one month he commits an offence.
  17. Can some one do me a favor and post up the legal bits in the Consumer credit act that says its 12 working days to supply the agreement, and also the legal bit in CPUTR about the 30 days being repelled Thanks:)
  18. When I spoke to them they offered my 25% off my outstanding over 3 months or 30% over 6 months, quite a good offer if you've got the cash and want rid of them
  19. When I was talking to someone at MBNA they said that they would go as low as 25% of the outstanding balance and give you 3 months to pay it by installments, although it wasn't in writing I did believe her

Rob thanks for the reply, yea they did start going into one about borrowing the money from friends and family etc, they also said I could use my redundancy money as well, like thats going to happen!! (its long gone), I hope they go quiet, I applied for the citi card online in 2003 so don't know what they will find if anything.
  22. Cool thanks babybear I will get that off to citi later - is that 40 working days to respond? I haven't yet informed payplan of this yet, do you think I should or do you think they will cock it up with 1st crapit, they are still paying citi at the moment too
