  1. Sorry to be a pain, I am trying to contact the court about this, what do I need to put in the defense?
  2. We had one other letter from Phoenix before the Bailiff came to our house, and yes its from the Council.

Hi we received a PCN and in December we had a call from a bailiff working on behalf of Phoenix Collections Limited, he stated that 2payments of £138.02 had to be made on 4.1.12 and 4.2.12, he failed to introduce himself (only found out his name due to email) but as he caught us off guard my partner invited him in, however due to family circumstances we have asked if we can now pay this at £50 a week to be told he is doing us a favor and he wants payment asap and not to ring him again today as hes not working? I have emailed Phoenix to which I got consult your bailiff, I have spoken to the Council who say that they cant take it back over, and I have also noticed that there is small print saying payments made via credit or debit cards will occur a charge?? Anyone had any dealings with this company and any advice at all on how I can proceed with this?
  4. Thank you rang the court and they said I needed to send it all in again asap and if the bailiff calls to make him aware that I have sent the documents in and that it is pending
  5. I have requested that I pay £40per month starting next week, and will be paid off sooner should finances allow, just going through a tough time at the moment so shook me up a bit, thank you for your advice

  7. Thank you danboy381, will ring them and see what is happening, as its a new application for suspension as I couldnt make payments on the first one in January 2011, hopefully I will be more at ease tomorrow after speaking to the courts.

Hi looking for some advice, I have an outstanding debt for Yorkshire water for £172.25 and the baliff from the County Court has been and put a card through my letter box, stating that because of the age of the warrant and no payment been made there will be a locksmith and removal van present at next call, but no date of next call. I rung him and explained that I have sent in a request for suspension of warrant for the second time this year as my partner lost his job and we had no income coming in and offered payment of £40 a month with the fee remission form been sent 1.5week ago due to not sending it with the first application, he said I had to ring the court office and ask if it had been received and if not he would be back! He was quite aggressive on the phone and did really scare me, I have just finished filling in all the forms again to take down to the court office tomorrow should they say it hasn't been received. Can he actually get a locksmith and force entry if I have applied for suspension of warrant? I feel like we get one thing sorted Council Tax was a big one as they were starting committal proceedings and then something else comes out of the woodwork to bite us hard. Feel like our whole Christmas is going to be spoilt and so scared my son will witness someone taking our belongings even when I have offered a realistic affordable payment. Thanks in advance for any advice

  10. My partners capital one card was taken out around 2002/2003 and he last made payment in 2003 from what he can remember does this mean it will be barred?? think I will CCA them and see what happens then. Thank you again
  11. Will look into CCA request, been reading a lot about them on this site and think that maybe the next step we take.
  12. Not 100% sure when the debt was last acknowledge as it was taken out before I got with my partner, but it hasnt been acknowledged since we have been together.

  14. Hi, I hope this is in the right place..... this morning I opened the post to find a letter from RED addressed to my partner as it is his debt. The letter reads... Warning This is an important document. You should refer to section 2 'How to comply with a statutory demand and how to preven a bankruptcy petition being possibly served upon you' ATTENTION Please read the following information below carefully, if you feel any of the information is incorrect then please call immediately on telephone number 0844 844 4722 in order for us to ammend your details. If a statutory demand is served upon you, the below details in Section 1 will be incorporated into the statutory demand. Section 1 Debtors name Mr xxxxx Debtors current address xxxxxxx (this is wrong however) Original Creditor Capital One Current Creditor Lowell Portfolio I The creditors claims you owe the sum of £1,123.66 The creditor has sent you a letter of assingment dated the 28/07/2006 The creditor on more than 6 seperate occasions has requested payment by way if lump sum in full and final settlement or by entering into an affordable repayment program. The debtor has not entered into or adhered to an arrangement of payment All the above information is believed to be accurate and true, witnessed by Kevin Allmark Collections Manager Warning section 2 If you wish to avoid a bankruptcy petition being presented against you, you must pay the debt described above within a period of 21 days once the demand has been served. Alternatively, you can attempt to come to an agreement with the creditor by calling us on 0844 844 4722. you will have to inform us that you are willing and able to offer repayment payment, You can either offer an amount of money to close your account or enter into a repayment program that we see your outstanding balance been paid over a period of time. Sorry this post is so long, my scanner isnt working so had to type the letter out, they have the wrong address on the letter and we havent recieved anything from 2006.   15. Its a charagable debt management company but I seem to be having nothing but trouble from them so Im going to look into switching debt management companies. Its been 5years since anything was paid, going to ring Gregory Penningtons and ask them to get intouch with them as Ruthbridge denied payment from them due to my partner working which he is not. Had yet another letter from Ruthbridge Limited, from their LITIGATION & ENFORCEMENT CENTRE, saying that unless we contact the deprtment to arrange a time for an agent to call they will send one anyway between the hours of 8-8 mon-frin and 9-5 sat, with a view to either serving papers or to arrange repayment. Not sure what to do now ALSO after looking into RUTHBRIDGE and the assigned from client I now realise this is a closed bankaccount overdraft my partner had so is the letter above still relevant??
  17. no dont think they have ever sent an EXPRESS DELIVERY letter, however they did try to send a stat demand, which my debt management company said was a ploy to get us to pay as a stat demand has to be hand delivered or something. The stat demand was sent about 4months ago.

  19. Thank you for your advice can i still send this letter even though we are with a debt management company? The debt im sure is from when 1st got together which is 6years ago and nothing has been paid for 4 at least, they have rejected our offer through the debt management company. Going to print off the letter and send today and will keep you informed, thank you very much for all your help so far, this has put my mind at ease

Hi, me and my partner have been recieving lots of letters and phone calls from this company, they are demanding that even though we are with a debt management company the payments are not enough, and we have to pay more or they will be instructing someone to come round and start bankrupcy proceedings. We have explained on a number or occasions that we are trying to deal with our debt, but the woman on the phone just says its not her problem and unless we want things to be taking from our home (which is rented) and from our 1year old baby we need to pay in full!!!! We cant afford to pay in full hense why we went to a debt management company. Any help would be appreciated on this matter. Thanks Upsetmum xx
