  1. My health is ok at the moment, it's just that with this threat I am worried that I will take 10 steps back and be where I was 2 years ago! The bailiffs don't have my address now. What they have is an address that I moved out of a few months ago. I am currently staying with friends. I want to pay my arrears and would like to pay this to the council. I am happy to pay 100 a month which will be over 12 months. I have read somewhere that the council have to accept my payments if I attempt to pay them. Is this correct and if so, can someone direct me to where this is stated in law? At the moment I am unemployed and about to start a new job - in roughly 4 weeks. I am not claiming any benefits at present, although may be entitled to them. Not sure if this makes a difference. Even if the bailiffs were to enter a property that I was at, I don't own anything of any value. Some cutlery and crockery and similar is about it! I am seeing Citizens Advice, but I am really desperate and need some help! As I am going to be a father in 3 weeks time, I want this sorted!
  2. Ok, so I could do the same thing then, make payments to the Council? I have had no telephone contact with the bailiffs. I think they may have sent something to an old address - the Council have and I contacted them. They have refused to recall the debt from the bailiffs. If I write a similar letter and start making monthly payments to the council, would they accept my payment? I would be going in and paying in person each month. Could they refuse to take my money?
  3. Hi, am new to this so sorry if this is wrong. I need some help as I am terrified and find myself in an impossible position. To give some background, after a marriage breakdown and an incident at work, I was signed off with stress by my GP. I managed to get into massive debt as a result, which caused my stress to increase - I was in all probability suffering depression as well. In the event, I had my house repossesed and am unsure what debt I have left. Recently I have started to try and get my life back on track. I have moved out of my last property, but when I went to retrieve my post I found a letter about a debt that has been subjected to a liability order issued at Magistrates Court. I called the council and left a message for them to call me back (it was a Friday and their office must have been closed). I didn't hear so called them back on the Tuesday and they said that they have given the debt to their Baliffs on the Monday. The amount is for over 1,000. Part of the problem is that I was a student when most of the debt was accrued, therefore exempt, and also not living at the address. I have sent an exemption form which the council claim never to have received, and they have asked for this again. My old University should have sent this in, although they don't seem in much of a hurry! (I was the owner and sometimes stayed there at weekends, but mostly was too afraid to). I e-mailed them to outline what has happened and asked that they could take the debt back. I know they can do this if they want and thought as the debt was being disputed that they would. They do not at present know where I live and I am reluctant to tell them. The Council have refused to do this and said I must deal with the Bailiffs. I also mailed the Bailiffs who said I must contact them. I had tried this but the phone kept sending round in circles (press 1 for...., 2 for.....etc). I want this cleared up as I am about to start a new job (if things aren't scuppered by my debts). Am I a lost cause or is there anything I can do? Please help. I am going to be a father soon and don't need this stress! I can feel my old symptoms coming back and I am just about to start a new job, ironically so I can afford to pay back the council. Please help, I am desperate!
