  2. Hi seq, that's good. I remember when I first started my DMP there was a lot of uncertanty about the NR situation. Ever since I have always left the unsecured part out and had no issues thus far and I've probably dealt with 100 DCA's (not kidding!). If it's not broken don't fix it, but if doing your own DMP I would recommend keeping it out. Southn if your unsure seek professional advice from a FREE DMC that can negotiate on your behalf.

  4. Thanks Tingy, I have the whole website in development and I am hosting the software there (My webdev is all done by myself and my hosting is VERY cheap!). I am putting a donation button on my site to help with the costs and I am setting up a little community to help give feedback and improve it. I did contact CAG (are you reading CAG ), but didn't get a response after 3 emails. I appreciate (CAG) you probably get thousands of emails and I am very grateful for the help I have received on this site by you providing the means. Just been hard going these past few weeks. But same goes for you with the link etc, Would be grateful for that and I can put a link to your site on mine - would help us both as I have some interesting people working on the SEO and all that technical stuff to help get the site noticed (which in turn would help yours too). I am 100% sure I am not going to charge for it now and it will be free. Once it is all up I will let you have a look at it and you can decide if you want to put a link to it as I don't want it to do more harm that good - its just another option for people to try. A comment you made to me during the week kind of made my mind up about doing it for free. Thanks Tingy!
  5. Hi johnbhoy, thanks for your post, wont be entering into the PTD. Don't want to say why, but all I can say was that the people were nice enough. Not for me though and I would also like to say that anyone considering this option, give it some serious thought (as with any option you choose) and think about all the implications that may affect it i.e what protection you have if you lose your job, is your home 100% guaranteed IN WRITING, are you comfortable, do you have any doubts? IMO if you were able to clear your debts in say 5-7 years I would seriously consider the DAS option (if in Scotland) as recommended by Seq. Seq - I now realise why you may prefer this as it does protect your home without "forcing the creditors hand" - or does it as a PTD would. Jonbhoy, glad you are debt free and hopefully we can take the league next year!

Apologies for this rant - been a tough old week with fee charging DMC's promising the world and refusing to put it in writing, treating you as if you know nothing and just general door slammed shut in my face from Orgs that should be helping IMO. OK, have met some resistance in doing this properly. Money Advice Trust do not want to help by issuing my CFS license (apparently it would be in conflict with their My Money Steps) - so what is the point of them offering it!? Maybe it is because it is supposed to be a commercial project - I don't know. Attempting to get on a Money Advice Course is almost impossible unless you are a involved with CAB, CCCS, ridiculous fee charging DMC's or you have money to burn by giving up full time employment and entering into a full time course and paying the ridiculous educational fees in place. (I'm still paying my bloody student loan from doing my degree 8 years ago). Basically, what I have learnt these past few months is that you either half -heartedly help someone or help them with your financial interests in mind. I am not going to apologise for these strong comments as what I have learnt this week especially ****es me off a little bit. Protected Trust Deed, typically creditors will accept 10p in the pound. The Org administering this pretty much also takes 10p in the pound in fees (well maybe a penny or two less!). So why not offer to settle the debtors debts at 30p in the pound and not take action against them (yes everybody would do it, but no, they wouldn't their Credit rating would be badly damaged!). The debt industry is more corrupt than I thought. I shouldn't be surprised, but I am disgusted. I sat this week and was told that when calculated, my debt would be 30K, when in fact it is 20K with 10k due to be written off due to some technicality. Honestly, when I was shown what a fee charging company makes from someone being in debt I was disgusted. It seems that you only get anywhere if you provide a plan that benefits the Creditors, i.e. PayPlan, CCCS, CAB (this is not an attack on the genuinely helpful people at these Orgs who I have the utmost respect for- it is higher up you have to look!). You can also get somewhere if you want to (in my opinion) shaft people out of more money by providing a fee charging service. Anyway, way off here on a rant as I have been annoyed this week. What has this got to do with this thread, well, the CCL I have given up with, my program is going to be made free - so no need for one. I have lost 5k of my personal money that I could have put towards my debts. You know it doesn't really bother me, what bothers me is that people who are in genuine distress are (most of the time) taken advantage of. People like jellycubes, honestly, should not be in the predicament she is being forced into by her Creditors - she has a young kid for god sake. I don't want to be compared to these cretins in the slightest who charge money. Not going that route any more, my project will be free (but I'm still not naming it here, that's not what I'm about). Money is nothing if you don't have family, friends and make peoples life a misery. How can you sleep at night in the knowledge that you have a woman with a young kid who hiding from you - utter disgrace. I have seen first hand what it is like to have someone trying to take their life over debt - not nice, not nice at all. THIS SHOULD NOT HAPPEN IN THIS DAY AND AGE SO THAT THE RICH GET RICHER BY INSTILLING FEAR INTO THE POOR AND FRAGILE. Debt is debt, I'm pretty certain you are insured against losses! Sorry, rant over, feel better though. And to all the people who work for these Orgs, I don't blame you for trying to make a living for your family by doing what you do - you may not sleep at night, but your bosses will.
  7. got "acknowledgement" letter from FOS today. Just a wee update, nothing much, so should hear back from them in a few weeks. Wonder if the spineless bunch will uphold my complaint
  8. Hi Sorry Seq, I have to STRONGLY disagree here. I have been in a DMP with NR with a together loan for the past 3 years. I have managed it myself and you should not include it in your DMP. Your unsecured part is taken along with your mortgage payment so DO NOT include this in your DMP. Your Bank Statement will show the secured and unsecured part of your NR mortgage as one payment. Keep your payments to NR as they are. The together loan is a nightmare! One thing I have learned is don't upset your mortgage company or take that chance. The argument of whether it is fair or not - don't worry about that Creditors (or the vast majority of them) have no morale's when it comes to collecting your debt - so don't feel guilty about it being fair. Just my opinion, but it has worked for me leaving it out. Good Luck.
  9. For as long as she is happy to contribute, then fine, but you only need to include your pro-rata contribution into your I&E. It's always complicated when you include single and joint loans etc, but if you want to clear your loans quickly, then you can combine your income. I'm one for getting debts cleared as soon as possible and not for trying to find away out of them - well maybe as a last resort ( I have got out of a few debts, only as I had no other option and the creditors were complete ar*eholes!). If you can easily afford to include your partners income to get the debts cleared (i.e you have enough disposable income) then go for it, but if you want to maximise your disposable income, then only consider your pro-rata obligation. Sorry if I am not explaining this properly. If you need any clarification, then let me know. The spreadsheet I PM'd you should help you out - if not, you know where I am. I have a few things to sort out next week so may take me a day to get back to you - got to sort out a formal solution for my partners debt and maybe mine with the house on the line, but if you are unsure of anything, just post it on here.   10. No it should be calc'd pro rata. If you can give me a couple hours until I get the weans in their bed I will PM a spreadsheet to you if you have no objections. The cards are in your name unfortunately so you are responsible. Well legally. I will post the formula I used but unfortunately if I post the spreadsheet I may get into trouble.
  11. I have to disagree slightly with the letter being too aggressive (sorry Tingy!). Personally I have sent a letter in the past similar to your original except for communication in email. Get everything in writing that way if anything ever goes to court just take their letter and save your stationary costs:) my last batch of letters basically said that I would continue to pay them 1£ until they accepted and froze interest and charges as their was no point wasting money if it wasn't going to go towards the debt. Also I couldn't be bothered with letter tennis so basically it says your not prepared to f*** around. Go with what Tingy says to begin with and see what happens it will do no harm and I suppose you don't want to pi** them off too early! And I wouldn't put 60£ as a haircut cost, put 30£ and distribute the other 30£ through the rest of your I&E
  12. Do you think I should ask them to remove the Interest Element of the loan and I will offer to pay them back the £6k and use this as leverage or not bother to pay it back? To be honest, I want this shown as settled on my Credit History, mind you it is defaulted, so will be off my Credit file in about another 3 1/2 years. Should I just "avoid" it - although that is morally wrong, I am the one who has been shafted by a ****** broker as he told me the total amount I had to pay actually turned out to be the interest element only and there is no total charge for the loan?
  13. I have had one creditor stop chasing me and writing off debt on another loan where I pursued this route, but that was due to the fact I caught them comitting fraud - so they gave up. I though I read somewhere that this could be rendered unenforceable if it was signed prior to april 2007? If it can't be rendered unenforceable, then what do you think is my best bet as clearly this agreement has issues? Other than to reclaim the PPI and pay the rest of my debt?

  15. Hi Will make this as brief as possible. Have a loan that equates to half of my debt, or almost half. Agreement was signed in December 2006. i have always thought the agreement was suspect (before I continue, I don't care whether it is morally right/wrong to question a debt that I have given good faith that I would repay - the ins and outs of this are pretty bad, from the lies the salesman told us we had a CCJ on our records which we dont and we had to go with a high interest rate lender etc etc to the fact that the debt has more interest than the loan itself......) sorry, back to my point: Went to a well know agreement checking website and paid a fiver for my report, which I thought was well worth it. In brief it has the following issues: - Has PPI that was no use whatsoever - so that is definitely getting reclaimed; - Amount of Credit calculation is wrong; - First payment calculation is wrong; - Regular Payment calculation is wrong; - Total Cash Price - wrong; - APR - wrong; - Total Charges/fess - missing; - Total Charge for Credit - wrong; on the basis that I have entered the details correctly and this site does work, then there is not much right with this agreement! Is this agreement worth challenging? I have successfully won against First Response - but by 'eck this was an effort - worth it in the end though! I have heard that challenging agreements this way is not worth it, but to be honest, if I "win", then half my debt will be "unenforceable" which helps me out - big time. I'm ready for a fight, but am I right? Can upload the docs tomorrow if anyone wants a look. Any help is appreciated.
  16. Hi seq, I totally agree with that . They have profit making at heart. This is the reason I want to go there first, so that I can take the info from there and run it past someone who will give me impartial advice. I have about 3 months before my situation gets bad, so I am taking half of that to get an insight into ALL my options and not getting rushed into one that may be wrong. Paid companies are full of salespeople, they have to be sp kist want to see the pros and cons of it all it has to be right this time. Thanks for the advice.
  17. yeah I figured that but I want to see what a DMC offers compared to a charity. Personally I think people make too much profit off people in debt and it works both ways. If I get something that works for me and benefits me then I'm happy, tha DAS does look like a good option. From CAB though!

Have blocked their number, maybe should unblock it as they will call back I know they will. Even if the FoS tells them not too. If the FoS agrees with me and they do call, I will make sure someone from there ends up in the dock!! PML!
  20. I am so tempted I assure you. Once the FoS have their say I will upload the letter, pure utter contempt for the law, the oft guidlines and the welbeing of their customers. If it was up to me they wouldn't get another penny.! If the FoS bottle it as usual will send the wife down to the PS! Thanks for that post! I thought I was being a grump as usual!
  21. when you say doorstep sharks - do you mean provident, greenwood and the likes? It worries me that you mean 'real' loansharks - as in the illegal kind. If Provident/Greenwood and the likes of them, don't let them worry you, if they are still coming to your door looking for payment this should be stopped through PayPlan. They are no different from any other Creditor, if they are still coming to your door, speak to PayPlan about this to get it stopped. If that doesn't help I will draft up a letter for you to send them, if they still don't take note, the FoS can get involved. No-one should have to worry about answering their door or opening their blinds. If it's the other kind, Crime Stoppers via 0800 555 111 is your best bet - thats a debt you won't have to pay.
  22. it's amazing that the simple things in life make people happy - i.e. your frozen roast beef dinner and a game rental for your kid. Thats what you should be remembering - all the good things, not the crap you get from Creditors. Chin up, keep fighting and stay strong, remember creditors like to make you feel vulnerable and ashamed and as if you are doing something wrong. They dont want you to seek help or think for yourself or appear as if you know more than them, you have done the right thing going to PayPlan, you are dealing with your debts with a FREE reputable provider. Creditors want you to cave in, I know, I have seen it happen, but what doesn't break us makes us stronger. To help keep me strong, I look around and see my family is healthy and will always be there for me. That keeps me going. You have to have hope. What does annoy me is that people mess up, we make mistakes and we pay dearly for it, the Banks, mess up, we (the taxpayer) bail them out - still they have no shame in spending money on their flash cars and expensive Champagne parties. Here we have someone who has their head in the right place, making their kid happy with a game rental and who is our government helping more? This is what we are up against. Smile in the face of adversity, you will get through this. I know I have ranted ( I am getting bad at that), but I dont think it would do any harm to fire off a CCA request to all of your Creditors, just to see who has some potential to be taken to task. I don't think it will do any harm, but you will have all your agreements with all the terms so you can see what is what should you want to challenge it. I was with PayPlan, did that, managed it myself and wrote off almost £10k. It's hard work, really hard and stressful but gives you an option and more importantly a wee bit of hope to keep you strong. Either way, you are dealing with it and that's good enough. With ref to your CCA's I basically fought tooth and nail to "write-off" the debts I could - it was quite stressful, so you may be better avoiding that for now, but it is always an option in the future. Small steps at a time - you will get there. I have learnt so much from people on this forum to which I am very grateful and always will be. You too will probably get more confident in time, so stay as you are for now - you have actually put me in the mood for one of those roast beef dinners!!!!
  23. Hi Seq, the factsheet has been pulled The property must be kept at all costs! I'm happy doing my own DMP and managing on my own behalf as that is what I have been doing the last few years and I'm comfortable in the fact I have managed to freeze all interest and charges and come to an arrangement I can afford. The 10 year thing - that is a long time to have a crap credit history and to be burdened with all this hassle and then there is the fact that the creditors may just say, bugger this lets go for a CO. I know this is probably a long way off, but, will see what comes of it. In limbo just now so have to see what options I have. Will google info on the DAS, but would like something shorter term - of course I know I cant have it both ways.
