  1. Hi again, I have just had a look over the last 6 statements the HFC have sent me, they were paid their monthly payments up till and including April. I put the debt into the hands of GP at the end of April, and no payments have been made since. the last statement they have produced was for 15th June, and as far as I know, they have not sent me a default notice or anything other than the first letter from their solicitors, of which was sent to GP and they could not have responded to it, hence the cc sumons. GP are going to get the sake within the next month, and yes it will save me £100 which I can use to pay my creditors...and I agree, they are a waste of space. I have tried to acknowledge my claim on line as I have been reading another thread, but have been blocked out as the password does not seem to work. I have phoned the court and if I cant do it, I will post it to them. I understand that all I am doing is acknowledging the claim and defending it at this stage, and any help in my defence would be greatfully appreciated. I have blocked out the amount they are claiming, and think I should not have, so the amounts are: 6459.05 inclusive of interest. default balance 09/08 5469.63 collection charge 911.78 amount claimed 6459.05 + fees and solicitors. and this confirms that no default notice was sent, because the first letter i received from solicitors was dated 11/08 and their default balance is 09/08.

  5. Hi, the solicitors letter has not been marked without prejudice so hopefully I can use that...I have just had a special delivery from the HFC as I sent them the same letter recorded delivery. They have sent me a signed copy of my agreement along with the last 6 statements...so the agreement is now enforcable..the only think I can say is that they could not have done many credit checks on me, as I would never have got the card if they had. I have not yet responded to the court, which I will do over the next few days. In my defence, I think I can only point out the facts about them not checking me out properly, the fact that I have no money but have tried to pay them what I can afford, and although they say it would take 8 years to pay off the debt, if you only ever pay the minimun payment, it could take 15 years, so I cant really see their problem!!
  6. Help.............. I have received a letter from Restons solicitors and it says: Thank you for your letter of 9th September 2008. Your request appears to have been lifted from one of the comsumer websites which promote this request specifically as a methord for stalling or halting legal proceedings. As such your request is inappropriate and an abuse of the Court process. Further and in addition the Civil Procedure Rules do not permit you to make spurious requests. If you have a defence you will already know what that defence is and therefore should be perfectly capable of filing a proper fully pleaded defence in responce to this claim. Yours faithfully MR. Hi, CPR must have passed my cca letter on to nationwide, who sent the letter and p/o back to me for the payee name to be changed and account number to be added, so I am sending it back to them today. G/P debt management are really a joke, I asked them to check if I had a default notice from HFC and they have ignored me, so I really dont think that I have had one...hope not!

  10. Please help... I have had a form from the county court for HFC today. I cca'd them following a letter from their solicitors on 26th August, but as yet have not had any responce. I dont know if they have send me a default notice, as all my letters were sent to gp, so I will phone gp on monday to see if they have issued me with one.... my gues is that they may well have, but as I was not a member of this forum then, I simply sent them all of...stupid I know!! what do i do now...
  11. Hi, thanks again, the letter has been attached...I think...They said that they had written to me before, but this is the only letter I have from them. They said on the telephone yesterday, that I should increase my monthly payments to £250 per month. They never offered me a settlement figure as the letter suggested, and I told them that I have no money and have not worked for months. They then told me that they would start legal proccedings against me in court to have a charge put against my house, so that they would get their money when the house was sold. I told them that nationwide had not informed me they had passed this on to you, and they said that they would look into that. The chappie was quite nice to start with, but then started to egt a bit funny saying that I had spent the money, so I should pay it back one way or another.
  12. Hi again, CCA send to K.P.R today as they are said to be acting for Nationwide, although Nationwide have never told me they have put it in the hands of a DA. Should I also cca Nationwide or leave it. KPR have said they are going to start legal proccedings against me, and apply for a charge to be put against my house, is this normal.

  14. Thanks again, I have sent 2 cca's today, one to HFC (MARBLES)and RBS (MINT), and recorded them both. Will the dca call at my house, this worries me if they do. I have not had a letter from Nationwide telling me they have passed the debt on, so should i send the n/w a cca or just wait and see what happens.
  15. Hi emma and all, It was mint that sent the last letter, saying that they were not happy with the proposed amount gp had offered to pay them. The address was from southend on sea, so I guess that I should reply to this address. I have also had a phone call from a dca who i think (has just bought, but am not sure) my debt from nationwide, they left a message telling me i had 48 hours to phone them....dont know what i have to look forward to from them. I also have a solicitors letter on behalf of HFC bank, but cant find HFC's address to send a cca, Any help please!!!
  16. Hi, I have had one of my debts passed on to a dca, who phoned me up and left a message on fone saying that I had 48 hours to call them, what are they doing and how should I respond to them. Will they be coming round my house next....? Any help would be appreciated.

  18. Thanks for that Citizen, One question, if a limited company goes bust owing lots of money, then the directors, I think, dont loose their houses. Normal people who sign a unsercure debt should be treated no differently. If it is not in the terms and conditions that these things can or will happen, or if you are not told about these steps being available to the card companies when taking out a credit cards/loan that is not secured, I would think that the company has not a leg to stand on! If when people took out credit cards, they were told they could loose thier home if they default, then no one would have them, they are not like a morgage where you are well aware of the consiquesces and it is printed by the signature box clearly so you cannot miss it! The interest is alot higher which is there, I think because of the risk of non payment and the credit card companies no this, if your house could be at risk, then the interest should be the same as the morgage interest.. If you are not told the true fact when you take something on, then this is misselling a product, much like all the problems with the endownments. I'm going to look at the other threads so see if I can find anything out on this.

Bin thinking.....if you take out an unsecured loan, as credit cards are... then both parties are aware that this loan is unsecured....so why should it become a secured loan if you default on the payments.. if you had wanted that to happen, surly you would have secued it to start with? Is there anything in the contracts to say that they will secure the debt against your property if you default?

I have decided to get rid of GP as soon as I have the signed confirmations of all my credit card agreements, and those that cannot supply a copy because there isn't one, I dont have to worry about...is this right? Once I know who I legally owe to, it will, or should get alittle better and maybe I can afford to pay more to those legal ones than I am doing now. I took out a personal loan on internet banking with the TSB, and it was an instant loan, they put the money in my account within minuites. This was digitally signed, as all I had to do was put in my password...There would be no ink signed signature of mine on this agreement. also, I believe that when I opened a higher account with them, they just issued a platunim credit card with it, so not to sure if I signed for that, but time will tell on that one.
  22. Emma, Thank you for that, and I will leave it in.. It would help me if I listed all of the cca letters on here as i send them, and let you know what they say.. Can anyone of the credit cards companys make me bankrupt, or if they take me to court, will the judge simply award them what I can afford. Have they got the rite to stick a charge on my house even if the debt is not a secured bedt? I need to know all this just incase they have got legal documents to prove the debt.   23. Thanks for that Citizen, I will post the HSBC of today. I have had a report from GP listing all my creditors acceptance of what has been offered, these amounts they say will continue until the full balance owed is paid off, which will take 8 years. by sending out the cca letters now, will this make them stop accepting the offers and cause me trouble, I thought I would remove the first line in the letter stating that I will not enter into any correspondance with them until they comply, but still request the copy of the signed agreement, is this all ok?   24. Hi, Cant find the addresses that I need, so I will wait until the next statements come in and take the address of them. As there has been a few changes in the law regarding the t&c, I have read that the cc companies are no longer committing a criminal act by not complying in the time allowed, does this change anything else?
