  3. Form arrived today. It seems straightforward enough. The hardest part is going to be tracing all the debts as quite a few of them have been passed on more than once so its getting a bit confusing as to which is which and what it was originally!
  4. First big sigh of relief, spoke to my shopacheck agent and told her what I'm doing. She was absolutely fine about it and I'm not taking food off her table really she's only gonna be down by £16 per month by not having me as a customer anymore, phew!

  7. Is there anybody else I can get to check the form is filled in properly? I can't afford to wait until April to be seen as that would only be the initial appointment I'd still have to wait and.go back.and forward... My sister is going to help me fill it, she used to deal with sequestration when.she worked for hmrc but that was years ago and she hadn't heard of LILA. What happens if I pay the £200 but the form isn't filled in right?
  8. Thanks for replying. The trouble with stopping paying the doorstep loans, I've been dealing with the woman for almost 15 years, she isn't gonna take kindly to me saying I'm not paying her anymore, she has almost become a family friend but that's part of their tactics isn't it. I'm trying to collate everything I can think of, got my credit file and searching for any letters and emails I have. So if anything gets overlooked it definitely won't new done on purpose because I want to do this right. You have to disclose all bank accounts on the application don't you? This is what's confusing me as I've read some banks will close your account when you go BK but I have tax credits paid in weekly so would need somewhere else for them to go asap.
  9. Hi, after doing some research I've decided to go for this option, I'm a single mum of 4, work part time and have about £8k of debt the majority of which is doorstep lenders. I'm awaiting my debtors application pack from AIB, I'm to attempt this myself as the CAB could not even give me an initial appointment until April and I can't wait that long. So I have a couple of questions, my shopacheck agent is due to collect £220 from me in friday but I don't have it, would it be worth me phoning in to the office to let them know of my intention to go bankrupt and ask them to stop calling for payment in the meantime or would that be detrimental? I already spoke to Buchanan Clark and wells and they've put a hold on my account with them for 30 days while I sort it all out. It'd going to take about a week before I can submit the forms but I'm unsure what to do about paying things while I'm doing it, I simply don't have it to give them as I have to buy food and pay my rent. Also wondering what happens if I miss any debts off the form when applying, some of them defaulted years ago and I've moved house twice since then and don't have all the details. And would it be worth opening a new bank account now or after? I have outstanding bank charges with hbos that I intend to include in the bankruptcy so not sure they'll be to keen on me continuing to bank with them!
  10. Hi Folks, I'm just wondering if anyone can shed any light on this for me. I have had my interest and court fee refunded to my account on monday but so far no sign of the actual charges being returned. Has anyone encountered this? I have seen that some people have had their settlement in 2 parts but they've had them both at the same time. I've had no correspondence from the halifax at all since I filed the court papers. Should I give them more time to pay the other part or should I be phoning them in the morning? I dont really know what to say to them if I do phone tho
  11. Update, I've had some money! £193 and something pence, my claim was for £720 + interest + court fee. I've had no correspondance from the halifax at all but I did phone them to ask where the money had come from (thought it might've been CSA, HA!!) and was told it had come from customer relations. Does anyone know if this is normal practice for the halifax and can I expect a bank credit of £720 soon? Cheers
  12. Just a wee update, havent heard anything from the Halifax yet, thats been 3 weeks. I did phone the Sheriffs office but they cant give me any info until the return date, even if they have had a response. I thought that was a bit strange!
  13. My case is against the halifax, the return day is 14/08 and the hearing date is 21/08 What is likely to happen? will the halifax get in touch with me about it or will I hear from the court if the intend to defend or what?
  14. Got the spreadsheet to work at my mums Target date for submitting the forms to the court monday 3rd july £993 + £160 interest + costs Yikes!!!
  15. Thanks for your help barracad, unfortunately I couldnt get the one you sent me to open either! I'm off to my mums later to see if I can get the spreadsheet to open on her PC. Out of interest, how long are the halifax taking to cave after they get the court summons?

  17. Hiya everyone OK, I've done the easy bits, prelim and LBA sent claiming £993, initially offered £195, that was increased to £390 today. No Deal! I have the forms to fill in for court (I'm in scotland, doing a summary cause) but I need a bit of help working out the interest. I cant get the templates to open as it just keeps telling me the file format is invalid I dont have any interest to claim back as I dont have an OD and I've only been charged pence on unauthorised OD so not really worth the hassle. But how do I calculate the interest they owe me on the actual charges? I understand its 8% but thats about as far as I get, I dont know how to do spreadsheets or anything like that, is a spreadsheet essential for my court claim? Also, which address should I be sending the court thing to? Thanks. Viv
  18. Can anyone help? I cant get the template to open, just keeps coming up with file format invalid. I dont have a clue what I'm doing!! I'm not claiming any interest back as I dont have an OD, but I can charge them 8% on what they've charged me is that right?
  19. I'm filing a summary cause against the halifax, got the paperwork here to fill in and all I need to do now is calculate the interest. You can also fill the forms in online and print them off. As far as I know it doesnt cost any extra to do it this way than to go through small claims, I read it somewhere but cant remember where but I think the fee is the same. I'm putting mine in on tuesday as thats 14 days from my LBA, I received a letter today offering £390, but I'm claiming for £993 + interest. Its very nerve wracking isnt it :o
  20. Hi, Just wondering, did you send them the preliminary letter or did you go straight ahead with the letter before action? I sent my prelim one over 2 weeks ago and heard nothing so sending my LBA tomorrow. Fingers crossed all round
  21. Thanks, They've already refunded it onto my account so if I reject it will they take it back off? Do I just send the LBA from the templates and add in an extra bit to say I accept the £40 as a partial refund and will continue with proceedings to reclaim the other £160?
  22. I sent off the first letter asking for £200 back, they have refunded me £40 When I send the LBA do I mention the £40 at all? Thanks
