Hello was wondering if anybody could give any advice on my old capital one account! Im at my witts end and im not the brightest spark! Just received an agrrement wich has my signature and a date on it that does tally with my old capital one card which i still have! :-| What i wanted sent was a breakdown ideally something showing balances,dates and why the account reached such a high debt? When i only had a limit on the card of £150.00 now they say i owe over £650.00 this is ovoisly interest? I have a ccj due to this it went to court and i pay back £5.00 amonth due to my current circumstances! But they only took me to court for half the amount and im worried that im still going to be owing everything?

Not sure how to deal with it all gonna seek some advice from CAB? I get hassled by phone everyday,have moved house 4 times! Have a ccj from it all! The credit card was with capital one with a limit of £200 and when it went to court i admitted the debt and was told to pay £400 some court cost to they went easy with me told to pay capquest £5.00 amth but capquest made it impossible to pay saying they had no agreement? Then starting sending letters saying i owed £800 and that they splitt the debt basically? this is my only debt and i cant seem to get rid! Has any body else had any simialar dealings? Ive had enough of it all any advice would be great? Thanks xx:sad:

oh yes they must owe me more! I was dumb and admitted i owe some of the debt and got myself a ccj, but after 9 years they still won't just fade away! Its funny when they ring cause i just giv them crap on the phone and they can't handle it lol and end up hanging up on me! Im not paying a penny more than what i said i owed, they can go swival lol, i do have my papers from last year when they took me to court and thats it! they said they will take me to court again,if they do i will just denie it as like i said the visa card only had a 150 quid limit! They added all the charges, and interest over the years not me! Its hard enough trying to suprport my kids on my own let alone pay stupid charges (lesson learned anyway)! I dn't get credit i pay with cash only and live within my means if i can't afford then i dnt get it simple!

Hi im receiving three calls a day before 9 am after lunch and early evening now! Have been for the past two days! ONE CALL ENDED WITH THEM HANGING UP ON ME LOL.. Capquest are chasing me for a debt which is nearly 9 years old lol they took me to court last year for half the money and i told them i wz a single mum ect and didn't owe all the money,thing is it wz a £150 pound visa card and has somehow tripled,quatripled out of control i have seen no statements ect or any paperwork for any charges! So i ve been paying £5.00 back every month by cheque which the have been cashing, but last month i wanted to pay by my card so i rang them up but they made it impossible to pay stating the had no aggreement when into how much money i get i could pay more ect.. i told them that wz the amount the court said i had to pay and i wouldn't pay any more as they said i owed more but only took me to court for half the amount and i needed to pay the full amount ect.. wHAT SHOULD I DO,ive since moved address and thinking of not telling them also?

Hi im a bit worried .. need some advice plz! Im getting both benefits at my current property which is council,but have just been offered another property which is housing ass my new tenancy starts monday and i have put forms in and been assured by my new housing ass rent and council tax will be paid on both propertys whilst moving! But my housing officer is being a pain stating i need to giv 4 weeks notice to end the current tenancy and have an inspection of the property before i hand the keys back! i ve been told by housing ass that this is not true and housing benefit will pay up to 4wks for both propertys whilst im moving? I am being stitched up here and going to be either taken to court for moving out within 4 wks or being stitched up for rent and council tax? Bit woorried! I have two propertys now! what makes me laugh is my housing officer nominated for the new house?

Hi Thanks for your reply! Been speaking to all the neihbours about parking today and they have heard that the ho is going to put stickers on the cars and charging £150.00 for removel of cars/vans.Have now read the letter she handed me yesterday and in it does state about breach of tenancy ect and how they can end your tenancy at county court ect... Also saying you can park on the pathway if a buggy can pass thru ect.. but then in another breath saying not in front of your garage ect.. We spoke to a police officer yesterday about this ongoing parking issue and was told the council couldn't do much .. but im unsure of this! The problem is there just isn't enough parking bays in our road for everyone most people in our road either have 2-3 cars or vans, i have a car in my garage already but do have 5 kids youngest is 6mths and my son 18mths suffers badly with asthma most days struggles to breath let alone walk up the road to a parking bay! So i have parked my car a differant way today in front of my garage,not on the pavement,on the road not obstructing any driveways allowing room for pushchairs lol and have filled a complaint form out about the ho on the councils website. She has told me once afficially in my house,twice in the road stating shes seen my car 3 times outside my house ect and moaned again yesterday! I have pictures of other cars parking more dangerously,obstructing ect including the police mans wagen but its me that seems to be taking the brunt of the complaint! What a nightmare! Wish they were more concerning about house repairs lol ive been waiting two years for a bath panel to be replaced and a year for a new backdoor!Our guttering leaks,our windows are crap with gaps between the frames causing draughts and needs repairing but they never have any money in the budget! I don't have to talk to this ho again do i,or have her in my house i can't stand her shes,rude aggressive and talks to me like a 2yr old! Thanks Becky

I park my car in front of our garage but apparently im obstructing a path public right away,weve just received a letter about it now but its the way that this housing officer is going about it! She stopped me in the middle of the road twice last week trying to talk about it but the conversation just gets hyrated! I told her i didn't want to talk in the middle of the street in view of my neihbours who complained and that she was upsetting my son,so i walked away and rang up the council and spoke to her boss and was told she would speak to her about it! But today she was hand deliving these letters and posting them to all the residents in our road about parking but instead of just posting my letter like she was doing with everyone elses she knocked on my door and thought she would tell me to move my car and went on and on about parking i told her i didn't want to talk to her at the door, as she was being loud and aggressive which woke my son up and ended up shutting the door on her and left her outside shouting stuff out! I am having sam trouble with coverplan I have a laptop with pc world coverplan & they refused to fix my laptop thay say because its been abused which was not the case i tripped on my sons toy on top off stairs & laptop went flying down & screen came apart from main unit i have appealed this decison nothing is being down anyone what i can do to get my laptop repaired?

Still receiving annoying letters from them! I had a credit card with a limit of 200 pounds with a high interest rate and fell behind with payments.. the debt was in 2005 and the added the default on my credit report in 2006the amount was for £680.00. Got papers for it to go to county court for £299.99,court fee £15.00,solicters cost £50 so a total of £364.99. So exceted it and filled in the county court paper work and offered a payment of £5.00 a month back as im a single mum on benifits and can't afford much more as repaying other debts, now the jujgment has come back saying the claiment accepted my payment i should pay £150.63 for debt and £105.00 for costs so a total of £255.63 at £5.00 amth and pay by the 22nd of nov-2008. Now capquest have sent a letter to me stateing they obtained a judgment against me for the sum of £299.99 plus costs of £105.00 making a total of £404.99 and say they have reason to pursue for the outstanding money owed and have a balance of £720.85 otherwise further action will be taken for another judgment order! Then i get a Direct Debit Mandate this morning thru the post with the balance of £720.85 to pay them by the 10th nov at £20 mthly stating to my recent communication of their office and agreement to clear my debt! Im a bit lost and my dad says to me wheres the paperwork then showing evidence i owe this amount and for what as i say i spent my limit on the card and failed to make payments due to being unemloyed and they ignored my request to make small payments years ago so i just ignored it all.. now what is £200 seems to be just going up and up and don't know what to do about it! Help:-? please

Thanks for address, yes think it was rembering sat in hsbc crying about them taking my money to pay my overdraft threatened to take my money elsewhere and then they got this aktiv capital to sort out my overdraft but it was their bank charges that made me overdrawn they just piled it on. I think that is the company it says sherforceplus on my paperwork lol one peice but phone numbers are differant,same purple logo little sqres

Not sure where to start being chased for old debts been on my Eperian report and found that ive defaulted with two companys years ago! Id ignored it all and since moved house and since being at new address its caught up with me again! One is of £680 and with capital one started on 04/04/05 and the default was added 21/04/06 and they have just sent forms for a county court jugment which im not sure what to do with although it says don't ignore ect... The other is AKtiv capital of £847 which started on 06/11/2001 and the default was added 03/11/2006 but they have since sent round sherforce debt collector to chase payment who i gave my mobile number out to and wishing i hadn't as they keep phoning me and threating county court also, they rang 5 times today leaving voice mail and i asked them nicely to stop calling! Are they allowed to chase these debts still and was wondering what to do all about it as years ago i offered both payments but they were refused ans capital one just added interest to my account each month so i just ignored these debts but with another baby on the way and no money,xmas round the corner,being harrased on phone getting fed up with it and they arn't just going away lol... any help would be great!

Didn't mean to cause any probs, sorry if i haven't been clear in what ive been trying to say! Im very apreciative of the help and surpport ive been given by the CAB as i simply can't afford a solicter to act on behalf and did ring round to find one that would act on my behalf and take legal aid but didn't get much luck! The CAB have helped me with all sorts of information and issues and have done a fantastic job solving all my problems and acting on my behalf as i am not the brightest person when it comes to issues that i don't know how to deal with ie debt, benefits ect... Ive posted my letter and expenditure forms by recorded delivery so fingers crossed that i get somewhere with it all and im paying the council today rather than the bailiff, but sill worried they may call upon my house still! Thanks guys basically she said copy her draft letter will put up for you to read and let us know what you think, also im having to ask for all the info and case number as it went to court without me and at the time i just buried my head in the sand i chucked everything away it was a suspension of a warrant and or variation of an order form, not sure what it is thou! I do think thou your template is proberly better than what i have wrote thou! Yeah totally agree as CAB are volunteers but in my experiance have been really good so far but then saying that ive never had to do all of this before and not totally clued up about my rights and stuff! oops not sure how to put my letter up doh!:-?

Hi all Printed some templates off to show the CAB she suggested just writing a personilised letter to the council and adding an expenditure form and sending it on to the bailiffs also but recorded delivery, she then said just continue paying but to the council department as all i am doing is paying the added charges of the bailiffs bill! Ive invested in a new garage lock to lock awaymy car in my garage everytime im finished with it. The lady at the CAB advised me to lol. She also said if the council didn't take the debt back the next action would be to apply to the court for a warrent variation of order. She did say i could have the money deducted from my benefit at £3.00 a week and recommended we did that also... Feeling lots better about it all and checked my credit report and score last night because i thought all this had given me a ccj but hasn't i have also found ive been defaulted for £36 by o2 can you beleive that! So gonna get on top of that! I only had the phone for ten days and ended the contract!

Ive done things round the wrong way so i apoligise for not saying hi first but needed some real help with a council tax debt issue grrrrr! Well found this site doing a search for some info on the above problem and plan to post lots more, didn't relise there was site like this and wished i had found something sooner! Thanks been reading up on peoples threads and can't beleive bailiffs act so badly, ive copy and pasted lots of documents to send to bailiffs and council and going tp print these of to show the CAB and hopefully ask them if they can get this returned back to the council, as i was paying my debt to the council and then told by them i had to pay the bailiffs. Gonna ring the bailiff on hes mobile earley again tamara, as i think i woke him up lol this morning and gave him crap down the phone, but this time simply ask for hes certificate number, not phone the company anymore as they are rude to me normally. also i think ive been overcharged deffo and have found that document also so gonna sort that out! Thanks so far for advice its BRISTOW AND SUTOR im dealing with and Reading Borough Council and i have the bailiffs names and have seroiusly been overcharged grrr makes me so madd!
