  1. Thank you so much for all your kind help and advice. I feel stupid now for doubting that there are still good people like yourself on this forum. I wish there was some way I could repay you for your efforts. If you ever need any car mechanical advice or advice about Civil Engineering and Drainage...I'm your man:)
  2. Don't know what's happened to this forum since I last used it. People used to be only too happy to help or offer advice...not so anymore sadly. Seeing as nobody had the decency to even try to offer some advice, I bit the bullet and just rang Eon who were extremely helpful...unlike this forum. That is my advice to anyone in a similar predicament...don't put all your faith in these forums as you may never get a response. Be brave and ring the company and offer a small payment, then ask about a monthly Payment Plan. It was certainly far quicker than waiting for some holier than thou Moderator or Forum anorak to have the decency and manners to point me in the right direction:mad:.
  3. Hi folks. I rather foolishly buried my head in the sand regarding a debt to Eon of £400. I received a letter yesterday that appears to have been hand delivered but came with the rest of my mail delivered by the Postman. It says "We called today at -blank- to discuss any problems you may have?" Firstly they didn't call at all as I was in all day and I've been charged a further £30 for this letter. I really want to pay them as it isn't a massive amount of money and I would much rather be on the tariff I'm on now as prepayment meters are an out and out rip off...I know this from working for Southern Electric many moons ago. The situation I'm in currently isn't the best as I'm not able to work at present as I was a Groundwork and Drainage contractor until a serious knee injury put paid to my job prospects for the time being and I currently am in receipt of benefits because of the injury. What can I do? I was given a payment card a few months back and have made a payment but not as much as they wanted. I know I've been stupid to ignore this for this long but I just want to get the matter sorted for now. I'm pretty scared by all of this as there is mention of involving the Police to assist them.
  4. Hi folks. Npower have just hit me with a bill for £1494. I don't understand how I can owe them anything as I pay my electricity in advance via a prepayment meter which is already a rip off. I pay nearly £10 per week for a very meagre amount of electricity usage. There's only me and partner and the place is tiny. We do all our washing at night during the cheap period and have energy efficient lightbulbs throughout the house. It's worse now as we're coming into winter as I need to heat the place also. There are storage heaters but I daren't use them as they would cost about £3-4 per day to run. I use oil-filled rads sparingly in the evenings but surely this isn't the way it should have to be. I'm currently on Jobseeker's Allowance and only have roughly £12 per week to feed myself and put electric on after paying my rent etc. I think it's very unfair that people who are on low income are penalised so heavily by a tariff that is supposed to help them. I've heard of a social tariff...does such a tariff exist. Thanks in advance for any advice or info anyone can give.
  5. Hi folks. I rang the court that Capquest have listed on the SD to ask them for form 6.4 to set aside the SD. The court said they didn't mind sending me the form but they say it isn't their jurisdiction and i couldn't swear my affidavit at their court. Is this a good cock up that'll benefit me in any way? Also i've not had the CCA back yet so on my set aside form do i say that i do not admit the debt.
  6. Hi folks. I was laid off in April (another victim of the construction crunch). I had to swallow my pride and make a claim for Jobseekers allowance. I was having my Housing Benefit paid into my RBS account but because SkyTV insisted on incorrectly doubling my subscription fee, I ended up having some charges applied to my account at £38 a time...£38, no wonder every working man/woman in this country is skint. The charges got so bad that I can't even use the account anymore and Sky can really f*** off as well as I've had no end of hassle just trying to get them to take the correct monthly payment. But anyway that's a thread for another forum. The story so far is that I've sent a letter template that I found posted by a forum member called TopcatDC where I've asked all charges to be refunded within 7 day as the Social Security states that not one charge can be taken from money a person needs to live on. 7 days have now passed and I've heard nothing. Does anyone have any advice on the best course of action to take next?
  7. Well as i currently owe a disputed £3,000 odd to my local council and all told my debts are around £7,000. As I'm currently unemployed it seems like an impossible mountain to climb so I'm really considering the bankruptcy option especially if Capquest have to foot the cost me going bankrupt. I'm not worried about any detriment to my credit file as it went up the swanny years ago I'm afraid to say.
  8. Hi folks. Thanks again for all your wonderful advice...you've all been brilliant. *UPDATE* Received a reply from Capquest today dated 6th August saying they are putting the account on hold for 28 days in order that they can obtain information required. I sent my CCA on the 2nd so does that mean if they haven't satisfied my request within 12 days of when I sent the request, I then apply to the court to have this set aside? Is that what would be the next course me action? Or do I just hope that they don't provide the CCA?I'm just a little confused with the SD saying 18 days response and Capquest now saying it's on hold for 28 days. Thanx as always guys and girls. You are a beacon of hope in my stormy sea of current hassle
  9. Oh it never rains but it pours. I missed my first 13 week review with the Jobcentre and when I attended today to sign. I was asked to fill in a little statement explaining why I missed my appointment. I filled it honestly as I'd just got the appointment day muddled up with my signing day as they were both on a Friday. The form was faxed off to their decision makers who made the extreme decision to stop my benefit...the ramifications of which are very bad. I've now had to fill out a Rapid Reclaim form which I think is silly. Surely these decisions need to be more fair and considered and not just a punishment? I did actually ring the jobcentre on the morning of my appointment on an unrelated matter (crisis loan) but because I thought my appointment wasn't until the following friday and no one reminded me, my error went unchecked. I'm now about to appeal this decision. Can anyone advise please?
  10. Guys this may sound silly but try as i might, i just can't find the Cca template. Is it just me or can this site be a little puzzling
  11. Thanks folks. If I don't make any response what would happen? I've not responded to anything in 5 years so will they just proceed with the Bankruptcy action? I'm worried if I start sending Cca requests and the like that it might confirm ownership of the debt. I guess what I'm driving at is whether it'd be better just to keep on ignoring Capquest?
  12. Well that doesn't sound too bad either way. The SD doesn't have a response date...even though the accompanying letter states "action by the dates stipulated"...it just says that to comply I must act within 18 days. So shall I just ignore their SD letter? Is that how I let it run it's course? I've also just noticed on the SD itself that the debt in question is just over 5 years old. Thanks ever so much for all this help. I was frantic this morning but now I'm seeing a light at the end of the tunnel.
  13. Hi thanks for replying. I have other debts but I must confess I buried my head in the sand about them when I was working. That is my only debt with Capquest as far as I know. I do have other debts probably around £2.5-3k but to be honest i've ignored them now for years...not big and not clever I know but at the time I was very irresponsible with regards to financial matters. I live in rented accomodation and don't have any other income other than my £62 per week benefit. As to whether Capquest have the correct figure or the right to collect the debt, i'm not sure as I don't know if i've had any other correspondence regarding this debt as I'm ashamed to say up until recently I was too scared to open anything I didn't like the look of. I can afford to pay at around £1 or a similar amount but due to other deductions from my benefit by way of attachment of earnings orders, anything more than a nominal amount would be rather difficult. I was just wondering if Bankruptcy would stop everyone chasing me...
  14. Hi folks...I think i'm up the Swanny with this and I don't know what to do. I received a letter this morning from Capquest in relation to a debt of £2,000. It is for a debt to Intelligent Finance. I'm currently on Benefits after recently losing my job and to be honest Bankruptcy doesn't seem the worst thing in the world as I've got other debts too. What should I do in the first instance. I don't want to be bankrupt if I don't need to be. What I'm wondering is if, in my current financial status, it would be a better decision to consider bankruptcy or should i try and fight this...All advice gratefully received.
  15. Hello again guys. The form 4 complaint is now at the stage of waiting for a response from the Bailiff's. I'm wondering though if it would be of any use to send in any further info to support my complaint. My initial complaint to the court was based on the invalid WP agreement. I then discovered in their response to the SAR they've included in their fees on the day the Bailiff met me in the pub carpark a van fee of £90. But he didn't come in a van. He came in what i presume was his company car. Should i send this info in or start another complaint about it instead? What i don't want to be doing is showing my hand too early unless it's in my best interests to do so. Thanks guys and gals. I feel like i'm finally getting somewhere.
  16. Excellent Update Folks.....:) Phoned Council straight away this morning and told spoke to the Senior Revenues Manager. He told me that the Walking Possession Agreement was valid still as it related to a car on the highway...here's the kicker...I don't own a car and don't even drive:):). I told the Council man that surely the Bailiff couldn't seize cars willy nilly just because they are parked outside my house...I live in a terrace on a road so cars outside could belong to any of the residents down my road as people park where they can get a space. He then said that he's put the account on hold with the Bailiffs in order that he can validate my benefit status etc. So I then sent a letter to the Rundle's informing them of my new vulnerable status (Jobseekers Allowance) and asking that they transfer this back to the council in order that relevant forms can be filled out etc. Here's what could possibly be the best bit...when I sent the S.A.R - (Subject Access Request) asking what fees I'd been charged and what type of van they had hired and how much etc. They replied with a breakdown of charges including a charge for a Van at £90+vat. The arrogant Bailiff turned up to meet me on his own in his flashy Audi Estate (minus a van, don't where he was hiding it but it wasn't in the back of the Audi anyway:):)) I think I've got em now. Didn't come to my house and there was no Van and in any case he would've needed a recovery truck to move a car and they are £120+vat. So hopefully when the Form 4 I posted on 30th April is processed. I should have the b******s right where I want them.
  17. Hi Guys. I don't know what items they have listed as I do not have and wasn't given a copy of this agreement. Another Update: Received this morning from Rundle's a reply to my subject access request. It is a fabricated piece of garbage. On the day (15th March) that I signed the agreement (in a pub car park) the bailiff had turned up in an Audi estate not the van that it says on the letter from Rundle's. There is also no mention of the nullification of the WP order that the young lady at their office said she was actioning immediately. This was before I'd had the benefit of the great advice from all you guys and was silly and inexperienced enough to speak to people on the phone. Rundle's have also not acknowledged the other letter I sent with the S.A.R. which was a request for a refund of an Invalid Walking Possession Order fee. I sent my Form 4 complaint of to the Court on Thursday though so hopefully we can start making some headway.
  18. Sent by recorded delivery on the 21st April a Subject Access Request, £10 cheque and a Request for Refund of Walking Possession Order. Got another letter this morning from Rundle's this morning saying they are coming on or before the 7th May to remove goods. Letter goes as follows; "The above debt remains outstanding despite previous applications for payment. I have arranged to call at your premises accompanied by a Certificated Bailiff on or before Wednesday 7th May to remove your goods for sale at public auction in order to discharge your debt. Whilst we are entitled to remove your goods in your absence, I would prefer that you were present so that we can personally agree the inventory of chattels seized and provide you with full details of the time, date and location of the auction of your property." And another new update is that I've been laid off from work now too which I feel is a result of my performance not being up to scratch as a result of all this Please help me :(
  19. Thanks ever so much folks. I'm feeling that I'm really getting somewhere. Yes my employer deducted my tax and National Insurance. What is the first move I should make? Should I write to employer asking for his reason for dismissal? And is there a standard letter template available for this purpose? I can't thank you enough people as I'd be lost without this info and assistance
  20. No...I have had nothing in writing from him explaining this unexpected turn of events. All I've received is a P45 and a P60.
  21. No. I am not self employed. However my boss never provided me with a a Contract of Employment or even the very basic Statement of Employment. My employer just does things his way regardless of law or protocol. But I was a PAYE employee if that makes any difference. Thanks folks for any assistance you can be regarding this matter:(
  22. Hello. I work for a Sub-Contractor in the Groundworking trade. I recently was asked by my boss's brother and our Site Agent to load some material into a dumper truck for disposal. It then later turned out the following day that the material shouldn't have been disposed of and the main contractor was up in arms. I wasn't in that particular day and surprise, surprise, my two superiors dropped me in it and I was made to be the scapegoat. When brought in to the Office to be asked my version of events, I somewhat foolishly decided to be honourable and not drag my colleague's name's into this. The main contractor asked me to leave site. This was not a problem, I thought, as my boss knowing the truth about the events would not leave me in the lurch and would place me elsewhere on another site. He strung me out for a fortnight before telling me on Sunday that he has no work for me. I've worked for him for 3 years. Surely he can't just drop me like this???
  23. Is there anything I can do. I didn't realise til I got back and seen my statement. Are these charges fair and can they be refunded. Many thanx
  24. Hello again. I'm wanting to pursue a complaint against a Bailiff who has made me sign a walking possession order illegally (ie. In a pub carpark and not after gaining peaceful entry to my house). I also wish to see a statement of the charges he has put on for his "visits" (only got one letter and that came with the Postman). Are there any standard letter templates in order to make this task easier. Thanks
