  1. Thanks buzby, Is there anything H&S related with the water? After all we bathe and clean our teeth in it. What are "bursts"?
  2. While I'm here, once they do agree to collect. Is it ok for me to request the delivery guys sign something to the effect everything was in good order before it left my property? I don't really trust the company anymore and the last thing I need is for the delivery men to drop the oven taking it back and not owning up.
  3. That's brilliant, I hope this is true because otherwise I have the feeling this "unprofessional" company won't be very quick in returning the deposit.
  4. So does this mean we have to give the goods back and then wait for the deposit?
  5. Actually, does anyone know where we stand on this? I don't want to give the goods back until my deposit has been returned but can I do that? They wouldn't have given me the goods until I paid the deposit so it seems only fair it should work the other way round.

  7. thanks bookworm, I sent a letter yesterday providing them with a date to collect their goods and commented this gave them enough time to ensure my deposit was returned beforehand. I also gave them a figure for consequential damages, not compensation and advised that this would go to county court if not provided.
  8. I'm just racking up the threads lately aren't I? Should have my own forum! OK, I'm not sure this is exactly the place but the answers for previous posts have been helpful so far. Had British Gas out yesterday to look at a boiler/radiator issue. Had there 200 cover which is supposed to cover radiators if they go wrong but apparently it only covers BG coming out and "turning them off" not replacing, which I can easily do myself and to be honest would do in an emergency anyway!!! So we cancelled the extra "radiator" cover as it doesn't actually do anything. But, the BG went into the loft space above us, (3rd floor flat, 2 flats below us) and he found a huge hole that was allowing pigeons in. On top of that, all the tanks had no covers on them so effectively the water in our bathrooms could be full of dead pigeons, dirt, feather, faeces etc. The loft insulation was also in "tatters" which explains why it's never warm in our flat. There's nothing in our lease that says we're responsible for that space, and based on the fact there are 2 other tanks and storage heaters up there, should the freeholder be responsible for not only pest control but also covering the tanks and insulation? I don't expect any legal advice but someone might've found themselves in the same position.
  9. When I asked for my details to be removed I was told that no credit card account details were retained by lastminute. Weirdly this morning I've just received an offer from lastminute as I'm "a valued customer" and a "Mastercard holder"....interesting, how would their system know I had a Mastercard if details were not retained!!!
  10. I think it's pretty clear we do not want this company carrying out any work on our property. There is clearly no incentive for them to do a decent job now anyway. I'd be concerned corners would be cut to compensate for the loss of money to this point.
  11. I asked how they would fix the oven next to a fridge and was told they use an L shaped bracket within the oven housing.
  12. Hi 1stlifeline, they've said the fridge can sit next to the oven providing there are end panels in between the two units.
  13. From originally saying we wont get our deposit back to them now making this the most viable option makes me think they're deliberatly trying to give the impression they're "doing us a favour"
  14. It's also worth noting that when the technical surveyor came out on the day the problem was found his response was "how did they miss that?"
  15. Options 2 and 3 are not suitable...would you let these people back to your property to carry out work? Option 1 is what we request a month ago now but was told plainly "That's not something we will do" hence we are where we are today. As for compensation, we're not after that, we are after consequential damages which is different.

Ok, time for an update, had a phone call from the representative of the kitchen company just before 7pm last night (Tuesday) stating that he was still coming to see us 6:30pm on Wednesday and that he had a response to our letter and he would arrange for it to be emailed first thing so that we could read and take it in before he arrived. I waited all day today and there was no email sent!!! I was home from 5:30 onwards and when 6:30pm came around, he didn't show...no phone call..no appearance...nothing. So at just after 9pm tonight I checked my email and I've received an email from him at 18:29...no text, instructions or apologies just a word document attachment with the following text "Dear Mr xxxx Further to our telephone conversation of Tuesday 25th March 2008, I can confirm that I have been able to review your file and can confirm that I am in a position to offer the following remedies in an effort to overcome the problematic Gas supply pipe situated on the proposed oven and hob run detailed on your kitchen plan. Option1 Arrange full collection of the Kitchen supplied by Refund Kitchen Deposit in full. Cancel credit agreement between and . There would be no offer of compensation based on the fact that the gas valve is part of the main service structure into your property. Option 2 Re-Design entire layout offering drawer line as an option where Possible, collect unwanted items and deliver replacement parts. Option 3 Install kitchen as detailed on original survey plan, with the Customer arranging relocation of Gas shut off valve through Transco." That's it...nothing else...no idea why he didn't turn up. Any thoughts?

  19. Do you have to pay by DD? If you can pay online/over the phone/Cheque then I don't see why you can't cancel the DD and set up a standing order. So long as the payment is cleared by the time stated on your statement they shouldn't worry about it.
  20. If that's in the contract before you signed and that's what you've agreed to I can see why they'd be pushing for it. If it's not stipulated and they've "plucked the figure from the air" then you'll be ok. I doubt it's the latter.
  21. Makes perfect sense, I have no problem mentioning them once this has all been sorted. If only so that others can avoid the hassle.
  22. In the contract, is there a certain amount that has to be repaid before the car can be given back?
  23. Is this the same as HP? In other words you pay a certain amount each month over a period of time and at the end the car is yours? I'm pretty sure that you cannot simply "hand the car over" and walk away from it. More than likely you can settle the balance and sell the car privately.
  24. That's good news Twist, at least they realise it's their mistake.
  25. By the sound of it yes, although I have to say it is going to be your word against the salesman. Don't be surprised if doesn't admit the error. He may not get paid depending on if they work on commission. Not your problem though, stuck by your guns. Not sure what the stipulation is with "cooling off" periods on this kind of thing.
