  1. They did the same to me at my elderly Grandmothers. I threatened to report them to the Police under the Protection from Harassment Act 1997 (as I was recieving several phonecalls a week) and the account was immediately handed back to the original debtor. If you can, get your relative to write them a nasty letter.

  3. arrghhh Ive just spend 20 mins writing a post and then when i pressed send my internet connection went!! I HATE TECHNOLOGY!! Anyway, here's the short version... I didnt proceed with the CAA/S.A.R - (Subject Access Request) request but I sent a nasty letter threatening all kinds of civil and criminal legal action if the harrsement didnt stop. Anyway it worked and i didnt here anything until this weekend (2 months later)... A scottish gent called looking for me. Obvious I knew it was AIC because of his accent but i just played dumb and said that i didnt know who he was etc. Anyway ill come to the point because i think my circumstances have changed... I have recently worked out my default charges and it turns out they owe me more than 1400 pounds. If i could contra the debt i would owe them less than 100 pounds. Would any judge issue a judgement whilst the OFT case is still being heard? What is the current legal situation? Many Thanks

Im just about to send this letter off, can you let me know what you think: Re: Harassment by telephone CC: (1) to sender; (2) to senders acquaintance AIC Case No: xxxxxxx Client Reference Number: xxxxxxxx Dear Sirs, I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. You are also continuing to attempt to make contact with myself on an elderly family members telephone landline. This member of my family is registered disabled and very fragile. If you continue to use harassment a formal criminal complaint will be made to the Police. I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Please ensure that you’re future conduct is in accordance with the terms of you’re Consumer Credit License. Be advised that any further telephone calls from your company will be logged and recorded.

Sorry i really have no idea what im doing.   7. Hi Everybody! Sorry for hijacking somebody elses thread but Im not the best with technology and I cant work out how to start a new one!! Its another Allied international one im afraid! Ill give you a bit of background. I owe Lloyds TSB roughly 1,500 sterling. About 4 weeks ago i got a very rude call at the house where i am lodging (owned by an eldery family member). The caller demanded that I confirm the first line of my address and when i repeatedly refused because he wouldnt identify himself he menacingly said 'its in your own best interests'. I put the phone down twice, and both times he immediately called back (harrasment?). I explained that if he did it again I would call the police but he laughed it off. Under extreme pressure as I was taking these calls in front of the elderly relative, i ageed to speak and he said he was looking for a full and final settlement. I explained this was in no way possible and that he would have to call me back (on my mobile) on payday to discuss a payment plan. As expected he called back and took a payment for 40 sterling over the phone. I then offered to pay 80 sterling a fortnight which was the most i could afford to pay and he stated that he would contact LTSB to run it past them. I got a phonecall the following Friday from the same gentleman who stated that my offer was not acceptable to LTSB (i dont think he even bothered to ask them as he initially started the call again looking for a full and final settlement - when i repeated our conversation from the previous week he stuttered and said it wasnt acceptable). I said well thats the offer take it or leave it, and id be happy to repeat the proposal in court if they wanted to go down that route. This seemd to annoy him (probably because I didnt seem concerned by his threats) Anyway the phonecalls havnt stopped. They keep on ringing my elderly relatives landline which is really starting to upset her. Personally I dont own any assets, or have any savings so im not overly concerned with what they can do to me, but the whole situation has really started to grate as i dont want to upset my family. However I have had one phonecall at work, (luckily i work for my family so my long-term reputation or my job arnt in doubt but it is still embaressing). Anyway tonight i got another call, where I stated that I will refuse to deal with them on the phone, he started making casual threats about bailiffs, and I followed that on by telling him to f**k off (wrongly - and he then proceeded to say he was reporting me to the police for abusive behaviour before putting the phone down). Anyway I need some advice with how to deal with these people. Luckily I am a single man in my early twenties with no assets or committments - but i feel for the people with houses, wives/husbands and kids who must be scared sick by these calls. For me they are just a pain and an annoyance, altho one i want to get sorted asap. Firstly, I am not disputing the debt with LTSB. I want to get it paid and set up a payment plan asap. However i dont know what else to do? They wont accept a payment plan and dont seem willing to take me to court? How do you get out of this? Secondly, I want all phonecalls to stop and to correspond by the post. What letter do i use. Thirdly, I will not pay this company without proof of debt (is there no way of forcing LTSB to accept payments directly). Do i need to send a CCA request? Also, if they do not comply with a CCA request, and by reading other posters this is a possibitly, what action can i take. Most people dont seem to follow it up after they dont hear anything else from them. Is it possible for them to be reported to the police and has anyone that you know of done so?? Is it worth name dropping the various financial regulators and acts that they use to regulate? Or will this have no effect? Any advice will be appreciated Many Thanks
