Sending this to CapQuest; Dear Sir/ Madam, I am bemused by your claims of indebtedness as I have no record of a lawfully terminated agreement with said Original Crdeitor but to assist with your investigations I will oblige by corresponding with the alleged Original Creditor in order to effect disclosure of all information by way of Subject Access Request. Thanks to Gezwee. p.s I am not excited by learning that I was missold a PPI as I am not sure the implications of this. However I have created a new thread in the PPI part of the forum and I am awaiting from others to advise. thanks to everyone
  2. Hi, In 2001 I took a loan out from Sainsburys. However after paying the first two installments I couldn't manage to pay the rest and the loan was defered to Blair Oliver Scott. With them I was paying regular amounts until I lost my job and couldnt keep payments this occured in 2003. What I didnt realise was that the original loan I took out had Sainsburys Silvercare Insurance. Now the loan has been bought by CapQuest who are chasing me for the money. Now my question is do I have a case against Sainsburys for misselling me a PPI? And is there anything I could do? thank you.

  4. I have never had notice of assignment from any of the Credit agencies as far as I can see. I usually place all documents inside a folder and no its not in it.
  5. surely if capquest do not hear from me as stated in their letter they would add charges and proceed court?

  10. The agreement does look enforceable, which is unusual for one of that period Did you ever receive a Default notice and Termination notice? sadly no.

  12. Thank you Zimmie for the information. How do I go about writing the F&F letter? Or in fact reply to their letter as described above? I dont want them to pile more charges ontop of the debt.

  16. Hi, I just received this letter this morning; Further to your recent correspondence. A letter telling me ways I could pay and also a photocopy of the original Credit Agreement between me and my Sainsburys bank. The agreement is signed and dated by me on the 5/5/2001 I need to reply within couple of days otherwise they will pass on my account to their collection department. What are my next options? cheers

I sent the CCA request letter and I received this letter from capQuest "Further to recent contact with our office and your request for further information in relation to the above account, we would confirm that your account is now on hold for 28 days whilst we obtain the information required. If you have any proof of payments or correspondence that would assist with your query please forward these documents to our Collections Administartion department." So whats the next step they would do and how should do I react? thanks

Since then I was paying back until I moved recently. I didnt tell them where I moved but I assume my landlord told them I no longer lived there. Now capquest just sent me a letter that I need to pay back £3000 otherwise they start legal action. Now I need to know what my options are. Should I ignore capquest letter? Any help in this matter would be greatly appreciated. thanks

  23. Hi - I have just received a call from Apex chasing me for the money. I told them that my account is in dispute with BOS and therefore not to contact me. I have the feeling that they will still try and call. I am wondering what I should do in this situation. Cheers

However you mention "My last letter from **original creditor/DCA** was DATE and intimated that my complaint would be resolved on **DATE**, " I have NOT received any confirmation from BOS after send a letter requesting CCA. Apart from this clarification. It is an excellent letter. Thanks
