  1. Hi All Firstly thank you for giving me the advice over this thread. Secondly I have received this letter from CrapQuest. As you will now be aware your account is being processed for legal action. I am corresponding with you as teh Managing Director of the CapQuest Group. Your account has been preselected for a one time solution to settle your account. This is not a gimmick and nothing sinister, just a project that I am personally promoting to encourage you to clear this debt and save a considerable amount of money doing so. My plan is simple 1. You agree to pay an amount of your choosing by Direct Debit 2. For each payment you will make in line with arrangements made then we will credit you with an equal amount of 30% of your payment. That is to say you pay £50 and we will credit your account with another £15. If you comply you will save x amount. Now my question is this if I wish to pay these monkeys back what should I do given that I want to give them as little as possible so that they are off my back. thanks

I trust that you will take this opportunity to contact us and save yourself the possible expense of litigation and the problems that any litigation in which we are successful would possibly cause your credit file. I have restarted my PPI claim against Sainsburys and they have phoned me back to confirm. Now the problem I have is CrapQuest sending me letters when they know that I am still in the process of reclaiming PPI. What can I do???? cheers
  4. Received letter from CrapQuest with the following; I write in response of your recent correspondence dated 5th march 2011 of which your comments have been duly noted. Thank you for advising me of your complaint with Sainsburys Bank plc and that you may be escalating this matter with the Financial Ombudsman Service if you do not receive a response. In order to assit you whilst Sainsburys Bank or the Financial Ombudsman Sevice may investigate your complaint I have placed your account on hold for an initial period of one month. If you require any further assistance with reference to your account please do not hesitate to contact me further. Now Sainsburys have yet to contact me regarding the letter I sent for the PPI. What course of action do I have? Secondly how should word my letter so that CrapQuest would stop bothering me? Thanks for all who have responded so far.
  5. Cheers citizenB I have sent Sainsburys a letter complaining about the misselling of the PPI. I did not send them the spreadsheet as I had already sent them the letter before you gave me the link. I will wait to hear from them in due course.

  7. Hi CitizenB "I would just rewrite your original complaint to Sainsbury.. ie the reason you were mis sold PPI. They have 8 weeks to resolve the complaint. Did you prepare a spreadsheet with all the charges on ? If not, then I suggest you get one of those sorted out. There is a spreadsheet in the library that you can use. It automatically calculates the amount of interest on a daily basis." I have looked in the Library but cannot find the spreadsheet. Please could you provide a link. Thanks
  8. How exactly should I restart my claim with Sainsbury's? My initial claim was for a Subject Access Request which was not the actual claim I was claiming for. My claim is for the mis selling of the PPI..
  9. Thanks citizenB but what response should I give to CrapQuest? I just checked on Post Office Track N Trace and even though the letter was sent last year it still says 'Information on your item is not yet available online'!! Looks like I would have to restart my complaint.In this sense what whould you advise me to write to for CapQuest and Sainsburys.

  11. Just to summaries; Letter 1; CrapQuest purchased the above referenced account on 01 dec 2009 from Sainsburys Bank with an outstanding balance of £3,269.00. CrapQuest were not made aware of any disputes or issues. crapQuest aknowledge your dispute regarding PPI and I can confirm that your queries were forwarded to Sainsburys Bank plc for their reponse. I can further confirm that CapQuest have received a reply from Sainsburys to advise that they are not aware of any dispute details. However they have informed CrapQuest to advise you to write to their customer relations department and they will be happy to assist. Letter 2. I wrote to you on 22nd March 2010 and received no reply. You had stated in previous correspondence that you had raised a dispute with Sainsburys Bank with regards to PPI, however you are now stating that you have a CCA request with them directly. I would therefore request that you clarify what your dispute relates to and forward to me any relevant correspondence between yourself and sainsburys Bank and I will be happy to investiogate further this matter on your behalf. In the interim period please find enclosed a signed copy of your agreement and statements of your account for your review. If a response is not forthcoming within the next 14 days your account will be returned to our collections department in order to resume contact with you. If anyone has any ideas what my course fo action should be please let me know.
  12. Hi Firstly I would like to thank everyone for the reponse and advice. I received the following letters from crapQuest. Please could someone advice me on what the reply should say.   13. Received letter thanking me for my correspondence which has been passed onto their Compliance department. Confirms that my account will be on hold whilst its being investigated. What would be the next step in this process?
  14. Jimbo and CitizenB Thank you to you both for answering my query. I have sent a letter to crapQuest solictor outlining that they should not be threathing me as I still have a dispute with original creditor and I have passed this to the FSA and Financial Ombudsman. I hope this is enough to deter them but I doubt this. Anyway one final question. Whilst replying to crapquest and other creditors is there a way I could learn what the legal procedure should be and what my rights are? Basically I want to give back to this forum advise to other members but not having sufficient experience or knowledge I could be wrong and dont want to give anyone any bad advise. Cheers

  17. Hi All, Thank you for all of the advice. I had thought that this was over but after a year now I get this letter from CrapQuests solicitors. Take notice that unless this account is paid in full or a satisfactory proposal for settlement is received by 24th jan court proceedings may be issued against you without further notice. Information obtained to date suggests that if judgement is entered against you the current enforcement action we would be instructed to take is a WARRANT OF EXECUTION. After this they have added more costs to the balance. Could someone please advise me what would be the best course of action. thanks.
  18. I got this weird letter from CapQuest this morning. I write in response to your recent correspondence... CapQuest purchased the above referenced account from sainsburys bank with an outstanding amount of £3,000. CapQuest were not made aware of any disputes or issues with your account and were acting in good faith based on the information from Sainsburys Bank plc. CapQuest acknowledge your dispute regarding this payment and confirm that your queries were forwarded to Sainsburys Bank. I can further confirm that CapQuest have received a reply from Sainsburys Bank plc that they are not in receipt of any dispute details. Please could you contact Sainsburys Bank to provide them with further details. This account is on hold whilst we await your reponse. Not sure what to do now.

  21. Is there are template to complain to Trading Standards and the OFT that CQ are chasing me a disputed debt? Also I have sent Sainsbury's a Subject Access Request on the 24th of January 2010. As yet I have not heard from them whether they have received the letter which was sent recorded. How do I acknowledge from them that they have received my letter? When should they get back to me?

  23. Just received this today. LETTER BEFORE ACTION It is our intention to progress your account to our pre-litigation system...the litigation process will seek an Order of the Court, directing you to pay monies outstanding. In the event that we do obtain a Warrant of Execution, a Court Enforcement Officer(Bailiff) will be assigned to attend to your address and carry out the Warrant. A Walking Possession Agreement means that the goods that have been seized now legally belong to the Bailiff...etc All this action is avoiadable if you contact this office immediately... Now I need to know what I should do. cheers

Received from CrapQuest this morning; Please be advised that as you require a Subject Access Information the following are requested; - A cheque for £10.00 for administrative purposes - proof of Identity. If we have not heard from 6th Feb then your account will be passed to our Collection department for further action. I have requested SUbject Access Information from Sainsburys bank so not sure why they think I asked them. I sent this to CrapQuest "I am bemused by your claims of indebtedness as I have no record of a lawfully terminated agreement with said Original Crdeitor but to assist with your investigations I will oblige by corresponding with the alleged Original Creditor in order to effect disclosure of all information by way of Subject Access Request." And also they have increased my debt by £40 pounds?! Not sure why. cheers

Was this a front loaded sum + interest that was added to the beginning of the loan ?" Not asked for PPI was added to the loan.
