  1. I will do Enron, I am going to take it into the court tomorow. I will be on holiday for the next 10 days after that...
  2. ok I have ammended that.... Thanks again Enron,
  3. Thanks enron, I have another question regarding interest, I have only used the simple spreadhseet to calculate the 8%, is that the interest i should be claiming for in 6 a, or is it the interest in 6 c?
  4. I am off on holiday friday, so would like to complete the N1 before then. Is this suitable to send off? Regards Dave
  5. I got this from another thread and tried to updated it and remove any parts not relevant to my case. Does this look ok for a POC?
  6. Should i serve an s.10 for the default? Or just go staright to court? I am on holiday for 10 days from friday so would like to get the ball rolling. the has an s.10 worked for many on here?
  7. Hello, Natwest have offerd to refund me for more than my defualt, but still refuse to remove the default. Does anyone have a link to a guide to filing with moneyclaim and removing a default? All the other guides seem to miss the default part out.... Regards D
  8. no i didn't need to file it, there 14 days LBA would have been up on friday. I will send them another LBA i think. I have held onto the first offer cheque for about a month so can hang on again for a little bit longer. It's just daft as the default was the original complaint, not the charges lol
  9. I just got a letter with full settlement including 8% interest taking this well over the initial default amount. I have used the template latters demanding the default be removed, but this letter does not mention the default at all, but says it full and final settlement. Has anyone been here before?
  10. it's getting close to the deadline of my LBA..... Well it's up on friday so they got 3 days to go. I see most of the threads here are about bank charges rather than credit cards... Is there anyone with a good thread on credit cards and default removals? And preparing to make a court claim?
  11. Ok Natwest phoned me of friday offering interest on the differrence between the charghes and the current fee's. it came to about £15 lol I told the guy on the phone that I would not be accepting this offer and to send me the papers I needed to take them to court... Watch this space...
  12. Ok, I have written the letter, it 's a combination of Request for repayment of charges, and a Rejection of settlement. It has a breakdown of charges and interest added to them all. Will be posting today.
  13. is there any tool for calculating interest for reclaiming credit card charges? i.e the 15.9% or what ever it is they have been charing me for the last 6 years?
  14. oh yes and the total amount of charges is over the amount the card defaulted for Regards D
  15. I got responce to my letter today giving me the total charges i have recieved. They reponded to offering me the difference between my charges and the current charge of £12, and enclosed a cheque for the said ammount. There was no mention of the default on my account though. The ammount charged is over double the difference so am I entitled to claim all of these back?
  16. well it should have been marked as settled May 2007. So in my eyes its inaccurate. And since the account was closed then I don't see why it should still show as open and them continue to update my credit file. If the account was marked as settled that they had not continued to update my credit file then that would be correct. As it stands it showing as open and there for will remain on my credit file for longer. So I was going to send them a letter along these lines : I know it may seem trivial, but with todays credit situation I would like to get my file as clean as possible and remove any information I can that would lower my score
  17. Since my account has been closed since may 2007 is it not against the Data Protection Act 1998 to update my file? Can I send a data subject notice as the account has been closed for nearly a year but they are still showing it as £0 balanace and open? As toucan are showing the account as open and updating my credit file then is this data inacurate?
  18. My card was terminated with the 160,000 others earlier this year. I did not default on my card and never missed a payment. I had the odd charge for going over my credit limit though. I am a bit new to all this but I am trying to investigate if them terminating my credit card also nulls me from the original agreement. There for at least letting me get out of paying interest. I would also like to know if now they have terminated my credit card I can stop them updating my credit file - then ultimatley coming to a settlement figure without showing as a default on my credit file. Kind Regards D
  19. I also have an egg credit card which they terminated in january. So would you think there is at least a chance of stopping interest going onto the account as they have terminated the original CCA?
  20. This is not a default just a payment history registered on my account. I was not aware that broadband accounts would show up on my credit file? I don't recall signing a credit agreement
  21. Well, I thought thats how the letter I wrote would read. If they don't remove the default I will claim back the charges prove that the debt was partialy made up of them, clearing the default in the end anyway. I have asked them to remove it or provide me with the information I would need(i.e list of charges) to get them to remove it. If they send me the list of charges then it's time to threaten them with court. I get a little worried about everyone using the same template, as they just have a standard reply for each template I have seen. I don't think they will take any time to look into a case if the letter is one they get every day.
  22. Hello, I had Toucan broadband. I missed the odd payment with them but stopped using them over a year ago. I settled all debts etc. Toucan still seems to be reporting to experian and looks like i still have an account with them. Its showing the missed payments too. Is there anyway I can get toucan to remove their entry from my credit file? And any other settled accounts that show late payments that have been closed for a couple of years? Kind Regards D
  23. I reclaimed all my bank charges last year with natwest. was nearly £800. I have written a letter without a template this time. Do you think this sounds ok? I just want to get this default off as quick as possible, not bothered about the charges as they wont be too many on there.
  24. Hello, I have a defualt with a natwest credit card that was settled last year. I sent the first letter asking And got back the letter stating that as it's repaid there is no obligations to do so and that there is no legal requiremnts to provide me with a true signed and certified copy of the original defualt notice. I have read loads of threads on this now and just wondered how people have succesfuly got the defualts removed. Did these work? a) Try and reclaim some bank charges, and get the default moved at the same time. b) Try to stop them publishing my data with the credit agencies Any links you know of would be much apreciated. And which route is recomended to be followed first? Kind Regards D
