  1. Their failure to redact others personal information although it had been stated that all redactions had been made previous to downloading the SAR data. Now that its been pointed out to the employer they are requesting the data be deleted and have gave a timeframe. Almost like threat.
  2. When a SAR is made to an employer and they send the data electronically, once downloaded by the person that made the SAR does the data then belong to them regardless of whats contained in the files?
  3. Hi, I had a loan with Natwest in 2005 for around 19K, paid it and never thought anymore about it. I was mooching about and saw something on Natwests site about PPI mis-selling and i believed it was mis sold to me. I called the number although i didn't have any loan agreement number and i haven't banked with Natwest for years they took some details. They said it sounded like i had been mis sold PPI and they would investigate and get back to me. A few weeks later i got letter saying they would pay me £1400 (roughly) in full and final settlement of my PPI claim. I signed and sent it back, got the cheque, cashed it, spent it and thought no more about it until today! I've been sorting out the attic today and came across the original loan papers which i thought had been shredded a long time ago. On them it says the PPI payment is nigh on £5.5K and not £1.4K. Surely they would have had records showing my loan and the PPI amount? I feel like I've been stitched up again! Is it worth getting back in touch with them or not worth it because i signed the full and final settlement letter last year? Thanks for reading
  4. Hi all, Were in the market to buy a sofa and are about to take the store up on their 4 years 0% offer. If i paid say £200 on my credit card and then took the rest on 0% finance would i be protected by the credit card company if things went wrong? Thanks
  5. Whenever i go into work i get called names. I have a disability and the names i am called are to do with my disability. The people that do it will deny it and those that are present would not admit to witnessing any name calling. I've had a problem at work for a couple of years now and have recently came back after suffering from work stress and depression. I thought i was moving forward again but this name calling is getting me down. It dosent happen very often through the day usually just first thing. I am currently in the tribunal process (date set) for other bad treatment at work and DDA breaches and by comparison the name calling is nothing but nevertheless it is bothering me to the point where it feels like the icing on the cake and that coupled with everything else makes me feel like walking away. Any advice please?
  6. Hi all, Is there any sort of legislation regarding disabled parking bays in the work place? I'm sure i read somewhere that there should be 1 space per disabled employee and an extra space for visitors etc... Is this true? If not what is? Thankyou
  7. I agree that all union workers are not all the same, it's just people's experiences with the hopeless one's that tend to tar the rest of them with a bad name. Paul, i'll send you a PM m8. Sorry for not replying but my head has been up my backside with all the counselling i've been having and with having to do all the leg work myself to try to do everything correct. It's been and still is a real struggle
  8. Hi guys, Could someone give me advice regarding the tribunal process and if there has been a major cock up, and if so what should i do. My unhelpfull union has decided to speak to a solicitor (nearly 6 months later) and have submitted an ET1 form on my behalf. I had no knowledge of this going to happen as the unions last stance was they would not legally help me. A big problem was i have never met the solicitor, the union guy who spoke with the solicitor doesnt understand the full extent of the problems and the copy of the et1 form i have recieved has loads of mistakes on it. There was an attached statement which has loads missing out and lots of errors with what is there. I am still going through the grievance process and am about to have the final stage meet so that process has not been exhausted yet. Is this a big major cock up? I spoke with the union guy and he that it didn't matter about the mistakes, all that mattered is that the et1 form was in to protect timescales.
  9. I've been told to get some sort of figure in mind for a possible compromise agreement. It's a DDA related case with long term (over 12months) discrimination both direct and indirect, failure to make RA, harassment and a whole lot of grief and upset to go with that. I haven't got a clue where to start. Should i be looking at tribunal awards and go from there? If so where could i look? Any advice please?

  13. Thanks Vonnie I suppose that could be an option but i have no idea how to come to a figure that would be fair to me but at the same time not letting them get off lightly. Where would i start?
  14. Hi guys, I'm currently undergoing grievance procedures and my next step is the final grievance stage. It's a messy case with breaches of DDA over a long time, bullying, discrimination and stress, depression and a breakdown as a result of this ongoing grief. The outcomes of the grievance stages to date are not acceptable. I feel like i cannot work there any more and although i have been off now for 6 months following the breakdown i still feel the same way and feel as stressed as ever with this still going on. I have been told that i have a very strong case for a tribunal but i don't want to go there because of the added stress this will cause although if need be i will as i have nothing to hide and have told the truth throughout. I have had a letter from work asking what resolution i am seeking to obtain so they can progress the grievance to the final stage. What options could i put down? I would find it impossible to go back but after being told in a grievance meeting that i would find it hard to find another employer because of my disability i feel pressured into having to go back to a place that has made me ill and is continuing to do so. I feel kind of trapped. What choices can i put in the letter? Thanks

Another thing to add from my experiences is that you will get legal advice from day 1 if it involves a personal injury claim, why? because unlike employment cases they will be able claim their fees/costs back and probably get a kick back from the solicitors for the business. Try getting an employment solicitor, almost impossible. A lot of these so called special union member offers that come through the door (insurances, discounts etc) are nothing more that an affiliate/commission earner for the unions.
  16. The union that I'm in either reeks of corruption or genuinely haven't got a bloody clue. Advice i have been given has been wrong, denied legal advice from day 1 to date, shop steward frustratingly feels as if his hands are tied and I've always been urged to sort everything out behind closed doors.
  17. I don't really see that there is anything you can do or any wrong doing has been done. The manager wanted to see you and have an unofficial chat about something that had been brought to his/her attention. If it was going to be an official meeting that had end consequences then that's a different story, but clearly it wasn't. If the manager was going to make a boo boo and discipline you somehow at the end of the meeting then that could be a different story but as it never progressed you will never know. I doubt very much that that would have been the case anyway. My opinion is your looking too much into it. Sorry if that's not what you wanted to hear

During a recent grievance meeting my employer said they were aware of my disability around Oct06 (witnessed) which i was surprised at as i was expecting them to say from the date of the occupational health report which was several months later.. Oct 06 is when i was finally diagnosed with my condition. The advice from occupational health was regarding work activities but those activities are also day to day activities. I have copies of these reports. Thanks again for your advice, it's all very appreciated
  19. Is there anywhere that i can find examples of completed ET1 forms or pointers? Can there be a massive difference with the outcome depending on how i fill it in? I just don't want to make a mistake that would be in their favour because of my non existent experience with tribunals. Looks like i'm on my own with this so need to do some speed swatting
  20. They knew of my disability well over a year ago, they also had occupational health reports over a year ago with advice regarding what would cause me problems and what would not. The advice has been ignored numerous times by putting me on jobs that was advised for me not to do even though i always told them time and time again. It kinda chips away at you having to keep saying that you can't do X due to pain and difficulty even though they were fully aware, even more so when they take no notice and put me on the jobs anyway. I never knew about the DDA until recently, this was after a breakdown at work and the doctor had signed me on the sick for work related stress/depression which i am still off for at present. I had to go back to the occupational health and they said that their advice from the original report remains unchanged with regards to work. They also said that i am likely to be covered by the DDA. This is when i looked into the DDA and i couldn't believe my eyes. If they had followed the act i wouldn't be in the position i am in now. That's just part of what's been going on, there's a whole lot more I'm annoyed with myself for allowing this to happen over such a long period of time, kidding myself that everything will be ok one day.

Thanks for the advice guys Looks like im going to have to submit it anyway as im going to resign, i can't see a way forward One of the most frustrating things about my whole ordeal is that i've been trying to get legal advice through my union and four months on i am still being denied it. I guess being harrased, bullied, intimidated and not to mention being denied my rights according to the DDA for well over a year isn't that serious to them. Makes me wonder why i bothered paying my subs when i could have saved them up and maybe i would have been able to afford some legal advice.

Hi, If someone had to attend occupational health regarding health problems and occupational health then send their recommendations (which advised certain tasks not to be done by the employee) back to the persons manager, how long from the manager receiving the recommendations should it take to have a meeting/discussion about it with the employee? What sort of timescale would be considered as extracting the urine? Do they have to follow the advice? What happens if they don't and further down the line the employee becomes ill partly as a result of not following the advice?
