  2. I've looked at the letters. If was to do a CCA request who do you think I should address it to? Santander own the loan but Equidebt are the ones talking to me about it. It's a bit unclear as to whom I should be talking to. Will Equidebt just pass on the correspondence like a middleman or answer all that on their behalf?

Ok, if I were to accept their offer of £6800 as a partial settlement, do you have a link that would guide me through the procedure of agreeing to this whilst protecting me from any future attempts to get more money from me either by them or other companies/agents they may employ?
  4. Hi, Thanks for answering. They have not applied charges to the account. Though at the present rate it's going to take years and years to pay off, I'd rather pay them a lump sump of the amount I outlined above. What are the possible consequences of stopping paying?
  5. Hi, I defaulted on a Cahoot loan in October 2006. I still owe £9000 on it and it now belongs to Santander. Equidebt appears to administrate it and they are the ones who deal with me and who I pay £30 a month to. I have tried speaking to them on the phone to settle the debt with an offer of £1800 which would be lent to me by my family. They will not accept it and countered with £6800 demand to clear it. Santander will not negotiate at all saying Equidebt handles it all. What should I do? It's going to be removed from my credit record anyway in 18 months, so I do still to pay anything at all? Can they apply another default after it comes off my credit record, if I don't pay? Should I stop paying the monthly amount? I just want to get rid of it and don't mind spending the £2k to do it. I want to buy a house at some point and this is the last debt to be sorted. Any advice gratefully received. Regards, Kevin
  6. Well. I got a response back from barclaycard. They said that my account was closed in Dec 2003, which sounds about right. They said my account records are held on microfiche along with other customers data and as such are not "readily accessible" in the meaning of the subject access request under the data protection act. If I do want statements they will cost £3 per statement. If I have any problems then I can make a complaint with the OFT (or whoever deals with this (I'm paraphrasing from memory here)). Any ideas people? Should I pursue this or let it go?

  10. Called them. They asked me to confirm it in writing which I've done. So now I'm finished with it. Thank you for all your help. Except I want to do the same to two old credit cards, which I no longer have any details for except the names: Barclaycard and Lloyds. What are my chances of getting statements out of them 3 years after I closed the accounts with no account numbers to give them?

  12. Yeehaw! Halifax Credit card services finally admitted defeat and offered me everything I demanded through MCOL. £580 charges, £90-odd in interest and £80 court fees. They credited my credit card with the full amount. Apparently according to a letter from their solictor, they were fully prepared to defend the case, but due to it probably being assigned to county court they would not be able to claim costs and therefore even if they won, would not be worth the legal fees. One question, they asked me to write to the court saying that this has been settled. Should I do this online? Or just write to the court? They haven't actually admitted anything, they just want to settle.

  17. Thankyou. I have taken A LOT of time to read the issues and haven't found a satisfactory answer. I think I more understand how to put in the interest and have used the spreadsheet to calculate it. However, the online form for MoneyClaim Particulars of claim just doesn't have enough room to put in an argument as well as put in all the details of each penalty charge I have suffered. The Particulars of Claim in the library was of little use as it amounts to about 2000 characters which is double what is allowed. I can't seem to find a smaller template. How much detail of the charges do I need to put???
  18. I've been trying to do a MoneyClaim online and I am a bit fuzzy on the Particulars of Claim section. You have limited space to make your case and it asks in a box if you want to reserve your right to interest. The problem is that it works out interest in its own way using 8% from the time that money was charged. The problem is that I am claiming for lots of little bits of money each charged at different dates and therefore having different amounts of interest. What should I put? Has anyone used this MC online and what did they do? The interest spreadsheet in the library here looks a bit useless in the face of this.
  19. Problem: I'm filling out my moneyclaim online and it says it requires an English or Welsh defendants address. Halifax Credit Card happens to be in Fife - Scotland, can I get away with using their general Halifax bank address in Leeds?
  20. Yeeee - freakin' - ha! I got home today to find a full and final settlement offer on the doormat for the £207 from Halifax Bank. I guess my rejection did the trick! Now to issue a claim against Halifax Credit Card! Don't have much money this month so this will help a lot!

  23. Well, I've sent a prelim for my two halifax accounts and had an offer to settle for about half what I am claiming for. I sent an LBA in response rejecting that offer and requesting the full sum. Haven't heard back. I've sent an LBA for charges from Halifax Credit Card and received a reply saying that I will not get a refund as I agreed to the terms and conditions regarding late payment charges when I got the credit card. Does that still mean I can claim? It is a credit card after all. Looks like I'm going to have go through small claims for both of these. I've followed the FAQ to the letter and included schedules of charges and sent everything recorded delivery. What do you reckon? Move forward and start claiming. Was hoping they'd just cough up.

I phoned Lloyds for details about my credit card with them and was told that they didn't have any records with my name and any of the previous addresses that would be have been registered with it. Barclaycard wouldn't even let me get through the automated annoyance they call a telephone service without a credit card number.
