  1. I left my employment in December last year. Is it too late for me to claim unpaid holiday entitlement. Is there a time limit, if so what is it?
  2. Hi, the saga continues. In conversations with both the MA and the LL my daughter has been told that the LL did not sign and agree to the contract, it was signed by the MA on his behalf but without his permission. They have given her permission to stay until end July and stated that she has no legal right to stay until end August when the contract should have ended. In this case, does she have to stay as long as they say. She has found alternative accommodation for the end of June. She's paid her rent till then. Will they have any right to say she has to stay till end of July and forfeit her deposit, given that they have stated verbally again and again that she has no valid contract? Can they really have it both ways?

  4. Hi Mariner The previous AST was signed in February last year and was for 12 months. The problem my daughter has is that she has spoken to the landlord and he has asked her not to sign the tenancy agreement, the MA is asking her to come in and sign it, bear in mind she should have signed in February. If she doesn't sign surely she'll have no recourse at all if the LL now gives her notice which it sounds as though he wants to do. At least if she signs the six months she'll be Assured until July? Property is in England.
  5. My daughter was offered a six month contract by the managing agent to renew her tenancy in February. In a phone call to the landlord to say she would like 12 months he agreed. However, my daughter forgot to go into the managing agent to ask for a revised contract and never signed the 6 month contract. Now, the managing agent has asked her to come in to sign a 6 month contract. Phoning the landlord again she discovers he has had a row with his boyfriend and wants the flat back ie, wants her out. Should she go in and sign for 6 months as requested by the managing agent. (Does the verbal agreement with the landlord back in February have any weight?
  6. Hi Rob and thanks for your reply, I didn't make myself clear, they are removing the default from my file and I have eight weeks to say I'm still not happy and am going to the FO. I just don't really know what removing the default from my file means - surely the ccj is brought in the first place because of the default - if the default is removed, what is the status of the ccj? or is it irrelevant?
  7. Hi there HFC won a ccj against me. I tried to get it overturned and failed. After nearly two years of to-ing and fro-ing because of a dodgy copy default notice they submitted in court (with blatantly fraudulent date inserted because original default didn't give me the required 14 days) they've offered to remove the default from my file. What does that mean in terms of the ccj against me? Appreciate any input.
  8. Hi, phoned the court today, they told me this is normal and legitimate and to pay the new assignee, especially as Phoenix "are part of HFC". Looks like they own the whole f....ing world. No choice but to pay Phoenix and wait to see what they've got up their sleeve. Polly

  10. Hey everybody I'm staying on this thread because all the relevant stuff is here. Weightmans, after failing to get a charging order for HFC have now written to say the debt is now assigned to Phoenix (see link). Now this is interesting. They have told me to stop paying the Assignee (HFC) but this payment is a Priority payment as it is the subject of a county court judgement, and to start making payments to another account, presumably Phoenix'. What are they up to? Can they go for another charging order in another creditors' name? If so, can I ask for the CCA again and all other relevant documentation which I already have from HFC? Having already chucked out my application to overturn the original judgement, would the court look at my defence if they try to County Court me again? You can see from my previous experience that HFC invented a Default Notice, with different dates from the one they actually sent me as HSBC. I would appreciate any expert opinion.   13. Hi all BOS gone very quiet. As I said they've accepted repayments through Payplan, Payplan advised me no response required to their threatening letter of 7th May. No response to my CCA request which was delivered on 1st May. Am paying regularly monthly payments. Should I just carry on paying and not poke the sleeping tiger? Any advice welcomed. Polly

  16. Hi all Payplan tell me BOS have accepted monthly repayments. However, they have been calling a lot. I sent a CCA request on 30th April, no reply as yet.   17. Hi Manchester What would I have done differently: OK, I would have gone to court and defended the case in the first place, which I hadn't done because of ignorance. Secondly, I might have had a chance if I had asked for the set-aside much sooner, one of the factors against me was the delay; the judgement was in July and I didn't put my application in until the following January, this went against me badly. Thirdly, I have to say, I had very little expert help putting my final case together and certain of my questions which were very pertinent to my case went unanswered on the site. At that point I probably should have sought legal advice (although how I would have paid for it, I don't know). Has your judgement been quite recent? If you have a thread I'd like to have a look at it, can you post a link? Regards Polly

  20. sorry to be like the spectre at the feast, but I think people here should be able to make informed decisions by looking at everyone's entire experiences. Therefore why is there not a thread 'legal losses' as opposed to successes. I certainly would have though twice about taking certain actions if I could have seen other people's experience at court. I notice my 'losing' post has been lost without trace. Not fair, really, for those trying to make considered decisions. Lots of luck, I think this is a great site. regards Polly
