She has just rang me with the wording from the most recent letter for the unsecured to see if you can offer advice on a response to them. It has not yet been passed on to a DCA. Can you take a look and maybe advise on her options, Thanks Unsecured balance - £27,558 Further to our default notice of 3rd Oct and your failure to pay outstanding arrears of £498 we are now terminating your loan agreement. We therefore demand you pay the sum of £27,558 plus interest from the date of this notice until full payment has been recieved at a rate of £5.74 per day. Failure to pay within the next 14 days may result in instructing our solicitors to recover the amount through the county court.

I didnt get ppi on my agreement only shortfall insurance and admin fee. Are trading standards helping you or have you got a solicitor?

Yes, I checked my copy of 1st letter sent this morning and it was pretty much a cca request but without stat fee and mentioning consumer act. I did send an official one last week but was wondering why they had not even acknowledged my 1st letter....it has been signed for, I checked on the royal mail site.

I have sent an official cca request since, should I just forget about the first letter and go from the date of the 2nd one that contained the statutory fee? Also would be grateful for some advice if they did not comply with my request please.

If I requested a copy of my credit agreement, but didnt quote consumer credit act etc in the letter does the 12, 30 day rule still apply? Before I found this forum I sent a letter (recorded delivery) asking for my agreement and have not recieved any reply yet even though letter was signed for by company 27 days ago. I did ask for a copy to be sent over the phone 3 times and they did say it had been sent twice but "must have got lost in the post" until the 3rd time they told me to put it in writing.

Spoke to previous owners of car (leasing company) and they have emailed me the cars history and guess what....car had more mileage 5 months before I bought it! Not sure what this means in terms of getting out of this hp agreement but I have rang trading standards today and they think I may have a good case under the sale of goods act.

Not sure about the CCJ, I`ll ask her tomorrow. She did say there was a charge or something on the house over the debt so if they sell the house they have to pay the debt back, but link said they will try to force sale. What should she do next?
