  1. Well Welcome seem almost the sadest company I have met so far, praying on people in financial difficulty. Forcing them to take PPI..charging over 89% interest on the whole lot. charges are incredible. SAR off to them today, will send CCA next week. Op's

Today a letter will go out to let them know they didn't comply fully with the SAR as no mention was made about manual intervention and as this is now with a DCA I am assuming there must of been something written. CCA reminder expires on 3rd November. So hopefully will start seeing some decent correspondence from these people soon. I feel court coming on soon for these folks! Op's
  3. Well today, I got another leter from Vanquis. Giving me a refund for the charges. Also attached was a list of charges And then mention in the same letter saying about the original credit card agreement being looked into. Seperate letter was a statement, with a reduced credit limit! Op's

  5. Ok Thanks again, I devised a very simple letter, which I should get back signed by my sister the end of the week hopefully. I put a timeline of 12 days for them, I think this is pretty fair to be honest. So hopefully in 3 weeks time, they would of responded. If anyone has a template letter that I can prepare ready for my sister to sign for non enforcement, I would appreciate it, as I do have a bit of a process to go through everytime I send a letter and it delays things by over a week normally.   6. Date on T & C is 1st October 2002, so looks original. Going to stick on one thread now, so I don't confuse anyone or MYSELF:-D Thanks for all the advise though, think I will wait for confirmation that what we have they think is the agreement, before I stop paying. OP's
  7. thanks Shane for responding to both my posts This is my sisters card to be honest, but she doesn't remember signing anything else. And, even if she did, they should of responded with a copy of this I think? I am not sure about the T & C's after all how many people even look at them, the documents we got looked oldish, so I am guessing they were either on the back of the application form or seperate. I am not certain if thier current T & C's look different. This credit card is way out of control upto £10k and most of that she has been on DLA, and only met minimum payments, yet the limit rose. She is very nervous that baliffs will start knocking on her door, and harrasing her, so i am trying to lead her through this. I pay her credit card for her, was paying £400 per month, but just reduced this to £60 per week. We are going to go into Lloyds and have me added as a contact, so they cant harass her. What do you suggest we do next? ta OP's

  10. I apologize if this has been seen before, but can someone let me know if the agreements, mentioned here are enforceable, I have a feeling they are but just to be sure. Thought this might be the best place to link them.   12. Well not sure where we stand with this. Received CCA response, no letter just the signed form, looks like an application form to me, with just her signature and date on it, and signed under the credit agreement 1974 bit. She took her card out in 2003. I will try and scan in and post for your perusal. I am concerned that as she has only really made just above the minimum payments how they could keep offering credit (started at 2.5k). She did pay it off once with a lump sum about 2 years ago when her divorce came through and the card stood at 5k, but since then the limit has risen to 7.5 and then 10k, while she is on benefits. 1. I asume it is enforceable, but please clarify once I link. 2. Is there any ground for persuing irresponsibly increasing the limit when she was only making just above minimum payments? 3. The charges she has gained over the last few months are very small, so i don't really feel that way is a good way forward to help her. OP's
  13. Ummm maybe I will I have a feeling from what I have read in posts, that Barclays are not the easiest company to go up against. Although their 3 a day phone calls to my mobile might be interesting with a response of repeated requests for statements. Will be interesting for sure. If i dont hear from them pretty quick, I will go the official route. Op's
  14. It's interesting to be honest. I requested, however, they gave me a copy of the request and THEY said they had 40 days, and it should be before that, but he stressed they ALLOW 40 days because lately they have had a lot of requests :grin:. But it shouldn't be longer than that...we will see!!! Just looking at the form, the reason given for non-charging the £5, was because of 'bank error' and he also put it as first class and not 2nd as is normal. If we don't get the statements, I will go the official route. OP's
  15. Got to love this one. My husband had a solo account, and Natwest said he could upgrade to a 'normal debit card account' (cant remember name). Anyway, instead of upgrading they opened a new account with an overdraft of £100. Instead of them just upgrading the exisiting one! But they didn't transfer the income or anything else either. My husband set up a direct debit to go out, with the intention of paying money in there...but forgot. SO the £100 overdraft now sits at £450..all CHARGES. Spoke to DCA, got copies of statements, got a phone call from Nat west offering £75.00 refund...time to start the process. Sent a Prelim off, which is up on the 16th Oct. LBA prepared. Debt collection agency has gone very quiet. Op's
  16. My poor son got himself into a right muddle. Anyway, went into the branch today, requested all statements. They said that they needed £5, but couldn't take cash, but only from a Barclays account. So smiling away, I said 'well I really don't think you would want to take it on my son's account'. They waived the fee. On 40 day timer now Op's
  17. Well sent off a CCA, haven't heard anything. Reminder being sent next week to them. It's for about £45 , so not a huge amount. Op's

  20. Hiyas folks Okies.....well LBA prepared, should post on Friday Anyway, I was looking at some other posts, and wonder if I made an error? I Have put in my schedule: Charges And compound interest at 35.6% (based on current charges devided by 2) But I notice on some claims people are charging interest on the charges as well as the CCI...how do I get this figure?   21. HIyas Still no news from Vanquis....Like I am surprised. My CCA is up on Friday, going to send them a reminder Monday, but I need to prepare it now, as I have to email it to get it printed. Can someone please confirm, the 30 days start when the 14 days are up please? or from when I first sent the CCA? Also working or actual days please. Ta OP's

  23. Good Morning everyone My online account shows they have made a partial payment, I am guessing the usual difference between £20 and £12. Still my card is paid off and in credit. Do I accept partial refund and send LBA letter in the next day or so, or do I have to wait until my Prelim was due to expire? Ta Op's
