  1. Hi, just a quick update on this. Had a reply basically stating their final response of refunding in full to the account the ppi, which is around £804 meaning total left to pay £4500. They want me to sign a disclaimer agreeing this is the end of the complaint!! I have replied simply stating that my original offer is on terms i.e. full removal of adverse information on credit file and they have not mentioned this in their reply. Lets see what they come back with
  2. hi, thanks 4 replying so quickly. it was 36 months of £144. my last payment was around november 07 so about 3-5 months after the loan was taken out. I dont have a copy of my agreement, i havnt and they havnt made any contact whatsoever until 2 weeks ago when i wrote them the letter offering to pay a settlement if they agree to remove default etc thanks
  3. Hi everyone, I have a former loan with Welcome Finance from around 3 years ago, im now looking to negotiate with them to clean up my credit file. Back in August 07 I defaulted on a £2000 Welcome Finance loan, I basically lost my job but Welcome were having none of it. Anyway eventually I moved address and got a new job. I never got back in touch with Welcome, wrong I know but i'm now looking to sort it out. Welcome have now reported the account to my credit file that I owe £10000!!!!!!! I can only imagine its charges as they dont have my new address. Around 2 weeks back I was reading that Welcome are really struggling and looking to reign in any debts no matter what. This in mind I thought I could negotiate a settlement with the clause that they remove all information on my credit file. I sent a letter but havn't had anything back yet. I was wondering if anyone else has had this experience and do you have any advice etc on if this will work? Thanks.

  5. Hello all, I wonder if anyone could help me. I used to have an account with Nationwide. When I had the account for a while I asked them to upgrade my account, they refused and so I took my business elsewhere. The bank then gave me around £250 worth of bounced DD charges and as such my account is now in arrears for £250ish. I know they have placed a default on my credit file and am unhappy with this. Could anyone outline the process for sending a section 10 notice as the "debt" is wholly unfair charges. Thanks in advance all
  6. Ahhhhh, not looking good then. If I fight it would this be the same as setting it aside? would the same timelines apply? Or am I just fighting a losing battle? Thanks for your help
  7. Hi, i'm taking a DCA to court due to not supplying CCA, have given them fair warning. Not sure though do I take them to English or Scottish court? I'm in England, original creditor is in England, DCA is in Scotland and DCA put the default on my file so i've got to take them to court. Thanks for any help, it's appriciated
  8. Hi, basically 2-3 years ago somebody off ebay took me to small claims court for not paying for an item. There are many reasons why I decided to cancel the transaction but the seller wasn't interested, I never turned up in court because of a relationship breakdown etc I had many bigger things going on at the time and it simply slipped from me. The judgement eventually got entered in default against me and it was for the full amount. Now a few years on i'm looking to get it removed, I know I have two choices 1. fight it (though I could do without the hassle) 2. Offer the claimant a sum of money to agree to have the order set aside my mutual agreement. I;m guessing because it was entered in default I will be able to do this? The problem I have at the moment though is that I can't get in touch with the guy who originally claimed, I don't think he lives at the same address. Does anyone have any idea what I could do in his absence? I have to get this removed desperatly just not sure how. Thanks
  9. I agree Scotcall seem like a very buckshee company, have zero regard for the law, hopefully I can set a president and ensure they can't carry on doing this

DCA Scotcall Limited have registered a default on my credit file, I have sent a CCA request to them and they responded by saying "can I confirm that I fundimently state that I don't owe the debt". I don't want to be side tracked and so wrote back stating that they don't seem to have complied with my request. They wrote back simply stating that "we stand by our first response". I have wrote back stating they are now commiting a criminal offence and I shall report them to IFO, Trading Standards and Experian and consider court action. I have now complained to the IFO and Experian though I don't think I will get much joy, court action it seems is neccessary. Do I take them to County Court or as it's a criminal offence do I make a complaint in Magistrates Court? What should my next course of action be? All help will be appreciated, many thanks

  12. Hi, i've been reading the post by championless regarding sending out CCA's, etc. I am really just looking for some advice to my situation I have at the moment with Studio Cards. I CCA'd them and they sent me a blank CCA, I quieried this and there response was that they need to provide me with only a copy and not the exact one I signed. Is this correct?
