  2. Hi can anyone give me a little advice as (apart from evanregan) I don't seem to have had any response, thanks in advance. Please can you advise me what to do next. I have today recieved a court letter saying a defence has been filed and the case transferred to my local court. A copy of the defence is attached. It also says that an allocation questionnaire has been dispensed with. It doesn't tell me what i need to do next though. I am also angry at what the defence says: 'claimant regularly advised of the amounts to be debited in respect of unauthorised overdrafts, card misuse.' (never had an overdraft or a card other than a cash card with no guarantee facility-all the charges relate to them charging over the top fees for bounced ddm's). They have just used a 'blanket' type response rather than personalise it to me and I would love to explain that to a judge. Anyway-rant over, can you help me by telling me what happens next.   4. Went to press the button today but the status has changed to 'defence' and now it says i am no longer able to take any further action online and it will be transferred to a court. Has this happened to any of you?
  5. Cheers Rob, I think i will wait a couple of days and then 'do it' on wed/thursday. I suppose now that we've paid our court fee we may as well go all the way and perhaps it will mean we will be first in the queue after oft.
  6. Hi all, a bit of advice please: Nationwide have until today to submit defence, in light of oft case should I still apply for judgment (mcol) in light of the letter i have had saying they will apply for a 'stay' or should I do nothing until the oft case is sorted. Thanks people.

  8. Hi Copeswell, good to hear your news, enjoy YOUR money. did you use mcol. my 28 days will be up on 3rd August just wondered if anything changed on there at any point before you got paid. Cheers Pete
  9. Copeswell, I couldn't agree more with what you say. Although I am fortunate to be a little better off these days, when they were taking my four grand off me we were struggling with two young children. If they do turn up in court I will tell them in front of the judge just how immoral their charges have been and the effect it has had on me at times (£100 in a single day on occasions) quite apart form the legal perspective, the moral one is pretty compelling!

  14. Hi I think i'm in this boat too (unsure as i'm new to this) I issued a claim that was acknowledged on 6th July, and had a copy of it saying that they intend to defend the claim in full. Did this happen to you and have you had to prepare a court bundle or are they usually paying up before the 28 days. (sorry for the questions-just trying to get it straight in my head. Thank you. Pete

Hi, had a letter from the court today to say that an acknowledgment of service of claim filed (6th July) a copy was attached and the box 'I intend to defend all of this claim' has been checked. does anyone know if this means I should start to prepare a court bundle. I guess at this point it starts to become a little scary. Thanks Pete

  18. Hi everyone, I filed my claim with moneyclaim for over £4,000 last week and i logged in today and it says 'acknowledged' 6th July 2007. Does this mean that Nationwide have acknowledged it and the 28 days are now ticking or does it merely mean that the court has acknowledged it. Sorry but its the first time i've used this system. Also my account is in joint names and I couldnt see how to file the claim in joint names so I did it in my name only. (My wife has signed all the letters sent to them asking for the charges returned). Will this be a problem? Thanks people will keep you all updated with developments.   19. I'm new here. Hope this is in the right thread, apologies if not. Having had no sensible response from Nationwide I have taken filed a claim on Moneyclaim for over£4,000. Just logged in and it says acknowledged 6th July, can someone tell me if the 28 days they have starts from there. Thanks everyone Pete
