  2. Hi hellhasnofury, No, I haven't contacted them about anything! I only found out recently from all the media coverage that I had been conned. Also received a call from a company called conkers who told me I was entitled to this. Regardless of how long I let it run for I should be entitled to get my money back for something I was mis-sold shouldn't I? I never claimed on it because I didn't actually know what I was paying for. As a student I wasn't very money savvy so I guess I just let it slide and cancelled it because it was costing me too much on top of the credit card repayments which I could barely afford anyway. I don't rememeber actually signing anything though. I was sold it over the phone when I called to make a payment once.
  3. Thanks all, the information you have provided is definately going to be of good use when i re-start this claim. Hoping to get this done asap, just need to work out all the extra money they now owe me! Plus the PPI charges. Seems very unfair that a judge would combine the two claims since they fall under different categories. Its almost as though they are taking the bank's side!!
  4. Hi there, I have just recently been made aware of the mis-selling on PPI's and think I might be one of the many that I have been cheated on - once again! I was sold the PPI over the phone as a student to compliment my credit card. At the time I don't recall signing any paperwork but being advised that this insurance was very helpful if I could not meet my repayments on my credit card. As I was a student at the time I was only working part time - approx 12-16 hours a week. However, when I did not have enough funds available to make payments I was not advised of any other possible solutions and consequently was charged numerous late charges and eventually had my account closed. I am still paying this off 4 yrs on. On numerous occasions I called Lloyds to cancel this over the phone and was told I would have to write a letter, which (sad as it sounds) I just didn't have the time to do in between lectures and assigments. Finally about 2 years later I managed to cancel this over the phone. I am also in the process of claiming for late charges etc. But am unsure if I also qualilfy for this PPI. So where do I stand? Was I mis-sold this policy and can I claim for this now? Thanks ButWhy

  6. Hi Blossomandebony, Thanks for that! Sounds a bit daunting that I am gonna have to go through the court process! Was hoping to settle out of court. Just my luck that the bulk of my owed money is held with Lloyds! But I'm still a bit confused, shall I just proceed with the court claim, where i left off from before or do i need to start the claim all over again? I ask this because I will now be claiming for my PPI on my Lloyds credit card which I wasn't aware I was entitled to before. Luckily though, there have been no more charges because I am being extra careful with my finances. I will not give them another opportunity to make a fool of me! Thanks
  7. Hi All, I have a small problem. I began the whole claims process and sent a LBA. got up to the stage where I was supposed to file a court claim but had a few health problems so was not able to follow through on this stage I am now ready to pick this claim up again but don't know where I stand with the process? Where do i pick up from? Do i have to start the whole claims process all over again or just resume from where i left off? Also it was recently brought to my attention that I was paying PPI for my credit card whilst I was a student, which was mis-sold to me! So on top of the £392 (minus interest) that they owe to me I am also now due back the PPI aswell I am feeling a bit overwhelmed with all of this, so any suggestions about where to start?!
  8. After weeks of claim processes I have received an offer from them. They have agreed to pay out - even though it IS only £30. Is there a special letter template or process I need to follow or can I just complete the form they have sent me and be done with it?
  9. Ok, thats great, thanks! Another qq though, do i HAVE to claim for the Overdraft Interest and Interest under s.69 County Courts Act 1984? I'm not too fussed about this amount and would be more than happy to just receive the initial amount back. But in order to have a strong claim do I need to claim for this aswell?
  10. Ok, so i sent my LBA to Barclaycard, after they had refunded me £91 out of a total of £247 which is owed to me and they have basically said they refuse to refund any more. The response letter seems fairly generic and doesn't say much else other than the fact that I agreed to the terms and conditions and that the fees were charged to cover their costs. SO... my next step is to file a claim. I have read on some of the sticky's that it isn't advised to complete this form online and instead to fill out a paper form and post this. Can someone please advise me where to start with this, obtain the form etc. I'm a bit nervous about this part of the process as I didn't think it would really get to this point but still feel in principle that I should follow through. Would really appreciate any pointers??
  11. Hi All, I have sent my prelim letter, received a partial settlement of £91, where my claim is for £247. I then sent a rejection of settlement offer letter dated June 15th. Have just opened my statement yesterday (28/08/07) and it appears they have already credited the £91. It is now 13 calendar days since I sent this rejection letter so what do i do now? send an LBA or go straight to filing a court claim?
  12. ok so I sent my prelim letter to Lloyds for my credit card account on 2nd June and then followed up with an LBA on 20th June. However, I have received a letter in the meantime dated 19th June with some blurb about the OFT's recommendations (including this): So, where do I stand? What do I do now? As the most recent letter from them is dated a day before I sent my LBA, so there appears to be a crossover. Do I take this as the response to the LBA or wait until the 14 days are up to start court proceedings?
  13. I am about to send of my LBA to Abbey for a grand total of £52, made up of returned DD charges! (yay!) Quick question though, the LBA template mentions the interest that is also owed. To be quite honest, I am not really too bothered about this and will be more than happy to just receive my £52 back. If i leave this out, will the bank take me for a bit of a soft touch and assume I don't know what I am doing?

Hi all, So i have compiled my two claims, one for my gold visa credit card account which is now closed, but i'm still clearing the debt (uni mess up) and the 2nd claim for my current account, mostly made up of unpaid DD charges and overdraft excess fees. I have sent my preliminary letter for both of these and received ONE response letter which amongst other things says the following: That's gone and confused me! Do I still have a valid claim and therefore, can I still follow through with my LBA? Also, both my schedules do not include the interest charges, but in each case, what type of interest can I actually claim, if any? Any help would be much appreciated as I am still unsure about the whole process. Thanks in advance!!
  15. Hi, I am about to send my LBA as stage 2 of 2 of my claims, but i noticed the paragraph in red about default notices. I know i received numerous defaults on my credit record over the last 6 years since most of the charges I am claiming back are late charges. But how do i check the exact number of defaults I have on my record and will these affect me in the future in anyway?

I sent my prelim letters on 06/06 and then went away on holiday for a week. in this time i received some responses and have not yet managed to reply to these, meaning that I am outside of the 14 day timeframe I gave the bank in my intial letter. Does this lose mean my claim will lose credibility?

  19. Ok, sorry to be a pain but i have a slight problem (I think) My 1st letter was dated 31/05/07, but I sent it by recorded delivery on 02/06/07. I then received a response dated 06/06/07 but this would have taken a couple of days in the post (and I was away on holiday from 07/06 - 12/06. Today is 15/06/07, so in technicalities, where does the 14 day period end?! And do I give them 14 days from the day I date my letter or from the date it was posted?

This is what they said: Blah blah... it goes on. Does this mean that I now need to send Rejection of settlement offer letter (letter 1)
  22. Hi All, I'm new here!! I have already sent my preliminary letter following the examples I found on the BBC's website and now am starting to receive responses from the banks. However, I am a little confused as to how I should be responding and if there is a standardised template letter that I can use to follow the next step of the process. To summarise, I have received one part offer from Barclaycard of £91 (£156 less than the owed amount) and a total rejection from Lloyds TSB (charges totalling £1,346) My preliminary letter did not include interest charges as I wasn't aware that I could claim for these, so where do I now stand? Is there any template letters I can use to send my responses and what are the next steps I should be taking? I would appreciate any help as this is all quite overwhelming and the legal terminology and "threats" from the banks are fairly intimidating Thanks in advance
