  1. Finally!!! Over a year later and I have had all my credit card charges refunded! PLUS the interest. I decided to go with the FOS and let them deal with all the hassle! So in total i had approx £306 refunded back which is a result! Thanks to all who helped! (YAY!)
  2. thanks bathgatebuyer, it's so reassuring to know i haven't hit a dead end and there's still hope! So since I have already lodged a complaint with the FOS I can't lodge a claim with the court or reply to Lloyds, but in the meantime should I forward this letter to the FOS and insist that I am upholding my complaint? Just like you, I can ensure 100% that i didn't complete the form. It's just not my handwriting!! But what annoys me the most is that they keep insisting about the benefits of the policy etc but thats no use to me now!! If they'd let me know at the time it was sold to me then I woulda known what I was buying and could have definitely made use of it! It just all seems so ludicrous!
  3. Ok so i submited a claim to the FOS, for my PPI claim and in the meantime also received this from the bank: So what do i do now? Does this mean that I have no claim?? i still refuse to accept the response though. Because I was clearly mis-sold a policy as I didn't even KNOW that I could claim if I was off work due to sickness, which I WAS. It seems they might have the last laugh though because as indicated, i DID sign the form. So basically I agreed to it didnt I? Could someone provide any suggestions on how to approach this now?
  4. Hi Scott, Thanks for your info. I have 2 credit card claims and 2 Current account claims to pursue so will definately read up on the FOS route and your threads to get some more info! When you say HBOS failed to acknowledge your claims, did you claim AFTER you had already complained to the FOS? I only ask because I did not see much more info about this in your threads (unless i read them too quick!)
  5. Ok so the time has come for me to file a claim but after reading through as much info about both routes I still can't decide!! The FOS is free but will take much longer and does not require lots of documentation or the risk of having to face a judge The Court route will cost to make a claim (although this is refunded if successful) But this will require writing POC's and maybe facing a judge etc. So my question is - has anyone tried both methods and can offer a comparison? Most cases on here appear to opt for the court route so I want to know why people have chosen this method and if it was a successful option?
  6. Hi nicsussex, When you say "Get your claim in" do you mean file a claim with the court or a complaint with the Financial Ombudsman? Should I also be contacting the bank again to let them know I am taking action or just go ahead with it? Would it be possible for me to achieve a full refund via the Ombudsman too, or should I only really consider the court route? I only ask this because I have just filed a PPI complaint with the FOS and it seems like an easy enough process so can this also work for the credit card and bank charges claims?
  7. Hi All, I have recently sent a complaint to the FOS about a mis-sold PPI and since I have had no response from Lloyds regarding my claim for bank charges and also credit card charges. I want to pick up with the claim roughly where I left off but was not too sure about whether I can still do this? Is there still a "stay" on any bank charge claims? Can i claim for the outstanding credit card charges? My spreadsheets indicate that i am owed £488.87 for credit card charges and £1194,69 in bank charges including the 8% interest rate. The 1st bank charge occurred in May 2002 so I am still JUST within the 6 year period and therefore really want to get this sorted before I lose out! My last correspondence was an LBA in mid June 2007. I received a response basically telling my that they were rejecting my claim and should I wish to contact the FOS i could do so. At the time I had alot of other committments and so failed to follow through with the application to court or FOS. So what are my options now? Do i need to warn them AGAIN and then wait 14days before filing a complaint with the FOS or court. CAN I claim for bank charges or is this still on hold? I truly believe the bank was not helpful at all when I incurred these charges and had they not penalised me in this way I would not be in debt now. So I am adamant to follow through! £488.47

  9. Hi patrickq1, Yes i DID sign my CCA request, was i incorrect to do this? I have sent a S.A.R and now collated all the charges in a spreadsheet so I know how much they owe me but they refused to refund this and provided that form. I have another question, my form is dated 2001 - I was only 17 at this time so definately could not have applied for a credit card or the PPI at this age. BUT the form is stamped 2002 - I assume that this means the person who filled out the form put the wrong date. Does that mean the agreement is void?
  10. Thanks for your quick response patrickq1. I have almost all copies of pay slips dating back to this period of time so what is the best way to approach this? Should I write a letter directly to Lloyds stating that I have all proof and also providing copies of these OR go straight to the court route and file a claim?

  12. Hi All, i was redirected here from the PPI forum as I'm having a little trouble with my claim against Lloyds for a mis-sold Credit card PPI. Basically, I was sold a PPI over the phone by an advisor while i was a student at uni working only 13 hours a week. I don't recall signing any documentation for it as I rarely went INTO a branch at all. But after sending them an S.A.R. they have sent me a copy of a credit agreement which I apparently signed in 2001. It's stamped 2002 though. I don't understand why this would be. Also, the form has not been completed in my handwriting but it IS my signature and some of the details are incorrect. For example, the salary info is above what I was earning at the time. Now the thing is, I need to contest the fact that I wasn't sold the policy properly because it only came to my attention that this wasn't valid due to all the recent publicity surrounding mis-selling. Otherwise I would never have known that I was not working the minimum required hours to be able to make a valid claim for this. I turned 18 in May of 2001, so how could I have been allowed to apply for a credit card at that age? The only thing I remember applying for before I turned 18 was a visa debit card as I only had a cashpoint card at the time. So is it possible that they have confused the 2 agreements? I would really appreciate some advice on this and how to approach the bank as they've managed to rip me off for approx £800 and i want it back!!
  13. I know, you're right. I'm just being a bit wimpy. They're very good at making you feel like you have no chance! I haven't posted the form on any other threads. But I do still have record of the original terms and conditions which state that I was required to work a minimum of 16 hours. I was only working 13 and have most old payslips to prove this so I guess that's my main point of dispute. Although the other elements of the case still anger me when I think of how easily they fobbed me off
  14. Yup thats exactly it HHNF!! So I have until early march to respond to their letter otherwise they will close my file - OR I can go straight through to the courts route. I'm a bit scared to send them a letter again because I know they will do everything they can to prove me wrong, especially now that they have managed to find a signed agreement.
  15. Ok, I had a thread here which has been moved to the student forum but since I can't get any response from the mod i thought i'd better re-post my problem as i need some help asap! The basics are - I was mis-sold a PPI over the phone by Lloyds credit card team when I was at uni and only working 13hrs a week. According to terms and conditions that means my policy was void. So basically I was conned into buying a policy which had no use for me! I sent a letter to Lloyds and they said they had no copy of my agreement but later they magically found a signed copy of my agreement dated Jan 2001 but stamped 2002. I didn't turn 18 until May 2001 so I don't know how I could have signed for a PPI at that age. Also - i'm not sure why its stamped a year later. Although, I do think that this form was just an application for a debit card as i was only in possession of a normal cashpoint card and wanted to get a normal visa debit as soon as I could! Could someone please advise me what to do and what I should write in my reponse to Lloyds or whether i should just go straight to the courts. My only concern is that if I contest it directly with them they will say "you signed on the dotted line, so your fault, we won't pay out" Someone please help!?
  16. Hi HHNF, I have just posted the main form itself, but they have also attached a 2nd sheet of paper with basic terms and conditions. I already had an existing account with them at the time of this application but was just applying for a debit card rather than just a cashpoint card. IF the date on the form is real, then this was signed 4 months before I turned 18. Would I have been eligible to apply for a credit card before i turned 18?! And if you noticed.... the date of the signature at the bottom is jan 2001 but the form is stamped jan 2002 ?? How can that be?:?

Ok, extremely delayed reaction but I finally managed to get a copy of the form scanned: I have read through the letter I received again and am now feel as though they have backed me into a corner. I have signed for it - thats what the form shows. So is there really anything left that I can contest?? I KNOW for a fact that I wasn't working the minimum hours and was really not aware of what I was buying at that time otherwise I obviously would not have signed for it knowing that the policy would have been void. I don't know what to do
  18. Well, having a look at the form it just looks like an application for the credit card. Which i was eligible to apply for once i turned 18. Ok, rookie question - how do I add the attachment? I can't see any options at all that allow me to add one
  19. Hi HHNF, it looks more like an application form for the account as the only indication of agreeing to the payment protection is a little tickbox in the bottom left corner of the form. I've had the account from a young age but when I turned 18 I applied for my visa debit card as before that I had only been given an electron. That's the only reason I can think of for signing a form. I also applied for my credit card at this point but only started using it in June 2002 (roughly 18 months later) Also, now that I think about it, my signature might have even been different at that age :? But I can definately say that the handwriting on the form isn't mine and there's no way I was earning the kind of income that has been noted on the form. I was only working 13 hours a week! I'm starting to think they're trying to make a bigger fool out of me now. Because when I sent them a letter asking for a copy of my credit agreement they didn't provide one, probably because I don't ever remember signing one! So i wouldn't be surprised if this photocopied form has been tampered with....
  20. I received a letter from Lloyds TSB today which basically contests my previous letters sent to them. The basic contents of the letter state that I was sent a policy document, monthly statements and I was well within my rights to cancel the policy within the grace period. Therefore they are NOT going to refund my payments. They have also magically produced a signed agreement form dated 24th Jan 2001, but stamped 30th Jan 2002?? Furthermore, the form has quite clearly not been completed by me (the handwriting is totally different) although my signature DOES appear at the bottom. The income information is totally wrong (way ABOVE my actual income at that time). I'm really suspicious of when this agreement was signed as I don't remember signing anything for the payment protection, but I DO remember being sold it over the phone. I have most of my old payslips which cover this period time whilst I was paying for the protection cover and I wasn't working the minimum required 16hrs so thats gotta help right? So what do i do, should I reply to this letter or just file a claim with the courts now?
