sorry I have only just seen this, I used to live in hull but I moved back out in a village near market weighton (lived there 18 years) so luckily (I hope) my post code now falls for Scarborough. I have been watching the Hull cases with bated breath, but they seem to be a good success in our favour though Lizz x
  3. Hello i had problems too i first wrote to them 17th March, they didn't reply so i reported them to the Information Commissioners Office who upheld on the 12th June and Last Thursday i got them all! just sent off my letter to claim £1958 so have faith and patience they do like to darg these things out Lizz x
  4. there was quite a difference to the interest as the 2 charges from the past were more then then newer ones i took off if that made sence will it still be ok and if i send a nudge with the summary again what set should i use? thank you Lizz
  5. Hi All, I think I have made a grave mistake, I took all my statements originally into work and did the calc from MSE site and went through court on MCOL at work. it has been transferred to Scarborough county court and has been with the judge since the 16th of may! and when D&G wrote to me asking for a summary of charges as I had only figures of my original claim at work I redid it on here from the templates and put what it was from all my statements. stupidly because I had checked and my work mate checked I just thought the figures would be right but i have just checked and from my original summary sheet i have 2 charges missing and 2 which shouldn't be on so my MCOL claim is £3121 and the figures I have sent to the judge and D&G is £3147.50 (without interest) i know i am an idiot for not checking, but help! what should I do to fix this I could kick myself for not double checking. Hi lateralus, thank you for your contribution to this group, i love your posts i have read the one you have liked above several times and i have used the prompt letter but i really wasn't sure what the draft order is it just confuses me am i right in thinking that it is an order to speed up the process and give the judge the details he would ask if he set a date? you wouldn't think i did AS Law or covered it in a business management HNC i just can't get my head round it! do you think i am too late sending it? are there any risks? what would you do if you were me wait or do the draft order? thanks again Lizz x P.S i work in Hull and am helping alot of people at work, your posts have been invauable thank you from me and them

  8. Hi all this website is fantastic and I have read and read and read but I go from link to link to link and yet I am still unsure what to do, i am working really long hours at the moment and finding it hard to digest after spending all day on a pc, I know it is designed to be self help so I will say what I think I should be doing and hope the people that know will advise me nay or yay! I am taking HSBC to court over £3642, I filed on MCOL and have been referred without allocation questionnaire to Scarborough county court, that was on the 11th of May and I have heard nothing until Friday when D&G HSBC's solicitor sent me a letter stating so i have printed off my charges and will send these off but should i be doing anything else do i wait until the courts call to send the bundle? and should i send a Draft Direction to the court or am i too late? sods law i have just sent D&G a prompting letter already including the charges again. Hope you can help? Thanks Lizz

    HSBC AQ Fee?

No I called them twice that lady isn't terribly helpful I assume she is sick of the same questions!!! She said the judge sent it back on the 16th may and it is in the pile and will be dealt with when they get to it, I said could you give me a time scale and she said within a month? I am claiming more then £1500 though and it does say there may be a fee payable. I have been reading on some other threads and wonder if I should have been sending nudge letters to HSBC Solicitor every 10 days? Thanks again Lizz

Hello all and eeks! i have just read this post http://www.consumeractiongroup.co.uk/forum/general/80091-your-court-dispensing-allocation.html i recieved my letter back from the courts on 11th May stating no need for the filling in of an allocation questionnaire and i haven't paid a fee should i have by now and is it too late to send in? i'm really cross if i do beacuse i have rang the court twice and asked if i need to do anything and they have said no each time:mad: Thanks Lizz
  12. Hello everyone, my name is Lizz; I’m from the North and have joined this site from linking from Martin's moneysaving expert site which has been a godsend to me for the last few months. I am taking HSBC to court over £3587.41 which they have taken from me in "penalty charges" in the last 6 years. I am getting very nervous as they have put in a defence on the 8th May - the judge, according to my local court has referred it back for processing on the 16th May and the lady at the courts says it will be done when it is reached in the pile they have a back log of 3-4 weeks.:-| So I have joined really for and to give advice/support and also if I do have to go all the way to court I know I will have to do very good preparation to fight my corner so I would hope those who have gone through it can help me. Look forward to reading & joining in with the group:D Lizz J
