Yes my card is the same - I have a thread going on this where I got good advice on common law - I have quoted that and rewritten giving 7 days notice before going to small claims, as you say mine can be used for either but the charges are purely for late payment charges so how the card was used should not be brought up - I have told my company that I am doing it and they are fine about it.

Thanks for the reply - I went about Amex in the same way as Barclays and First Direct (Both Paid out) Amex sent the statements quickly, ignored my first letter and have just replied to my 14 days letter. It is in this letter they claim that the regulations do not apply as this is a business card and not a personal card. They gave me a link to www.oft.gov.uk/Legal/UTCC to explain the legislation but this link does not get recognised when I try it. I am tempted to file the claim in the small claims court to see the reaction
  3. I have just heard that Amex are not going to refund costs on my corporate card - now closed. They are claiming that this is exempt from the regulations and is a business contract, howver this is not a charge card, I am fully responsible for the payments, my credit history is affected and it can be used for private or business use. I am happy to take them on but would like a bit of advice if anyone else has been down this route. Tx

I have just posted a similar thread, they are quoting the same - however in the small print at the botton of the letter it recommends going to FOS if you are a personal cutomer or your company does not turn over £1million so maybe this is a way to get at them. I will happily go further but would like to understand my position fully first.
  5. I am a new user on the site, I have claimed back over £1200 from first Direct and Barclays with very little trouble. I then took on Amex with whom I had a corporate card for 6 Years - they ignored my first letter and replied a day before the deadline to my second letter - they are refusing to pay quoting that the regulations on unfair terms in consumer contracts do not apply to corporate accounts - can anyone help me or offer advice? I am happy to take this to court but would like to be sure of my position. Thanks in advance:confused:
