  1. Hi guys, I went through the process of reclaiming my bank charges back in 2007, and oike many others, my claim got put on STAY while the test case ran. It's currently been on stay for 2 years. Does anyone know a time frame to when or if I may get my money back? Is there anything I can do to get the claim reopened and looked at? I'm not exactly in 'hardship' yet, but the money would come in really helpful in paying off debts (credit crunch isn't good at moment ) When my claim originally got put on STAY I had (I think) 21 days to object, but I missed out on it as I was working away and didn't get the post until it was too late, and now I've just waited patiently for 2 years for it to make some progress. I'm sure there are probably other threads similar to this, but I've tried my best to read through some threads to find the answers, but none really match my circumstances. Any advise is greatly appreciated. My claim is for approx £1000, so it's not a massive claim, but it would help pay off a credit card, and stop me getting hundreds of pounds interest charged each year...

  3. I'm currently sueing Barclays for bank charges etc, but I've had my case put on automatic stay. I received the letter a few days ago, and only just had chance to get together a reply. Only problem is, the court letter 'stay' day says 17th August, but I only received the letter a couple of days ago. They say I have 7 days from that date to appeal the stay. How is that possible when it's about 3 weeks ago?? What can I do? Appeal anyway and see what they do, or backdate my documents, and blame it on the post system which is what seems to have happened in this case. Don't know what to do. 7 days doesn't seem long enough, to say the test case will go on for years yet! And it was all done automatically without my concent. Please Help. Dan
  4. Right, what I've done so far is: Sent a letter to bank asking for charges back, with statement proving charges. Got letter back saying not, but will 'offer' half as a good will gesture. Refused 'goodwill' and told then was taking it further. Applied to court through online application (didn't know about the written application to court until after I applied). Got defence letter saying they said charges were legal, and need more proof of charges etc. Got court date, but no allocation questionaire or bundle request. Just a 10minute hearing notification letter. Sent bank & court a detailed list of claim including statements highlighted etc. Receieved letter today from bank saying court hearing is being put on hold until TEST CASE is complete. THIS IS WHERE I AM TODAY. I haven't contacted the litigation team, because I don't know who to ring and what to say. I've read the post #24 on that help page, but still alittle unsure. What phone numbers, and who to talk to etc. Will they just say no to negotiations until the test case is complete now? Has anyone actually gone to court and not phoned the litigation team and still won and got their money? I've heard of people going to court, winning, then the bank appealing and stalling the process.   5. Hi guys, Been looking at the forum for a few months but never actually posted anything. I'm currently claiming my charges back just like everyone else on here. I've actually got a court date, and it's the 21st August 2007. I'm claiming back about £800 from Barclays. I received a ltter this morning from Barclays (first letter since I got a court date a couple of months ago) saying that they have applied for my case along with all others to be put on hold pending the result of the TEST CASE. Seen that I haven't heard directly from the court, I'm still prepared to turn up on the day. Does anyone have any advice about what I should do? I've read about people contacting the litigation team at Barclays and getting a full refund without going to court. Is it too late for me to do that now as it's 2 weeks to my court date? Has anyone else received any similar letters from their banks about the test case?? Thanks Danny
