Just to keep you up to date, just had a phone call from Nationwide (my main) bank, telling me Natwest have been in touch with regards to a payment i made through my Nationwide acocunt to an individual for an item i purchased off an auction site. Wanted to questions if i had recieved the item. What the hell is going on, can Natwest access my Nationwide account details or something, they are seriously up to something. Does anyone know if they can do this kind of stuff

  4. Ive only just rec mine today and i sent it rec del 6 March so they are really cutting it fine. Suggest to use the CONTACT US emial address as they usually reply quite quickly and you have somthing on paper then
  5. Came accross an interesting point in my car insurance with Endsleigh last year. I was paying by Direct Debit at the time cos my premium was that high. It was only that i was looking through my old policy that i noticed they had charged me Payment Protection Insurance and i hadnt even requested it £35. I rang them up and gave them down the banks and they agreed to refund it even though my policy had expired. Just a note to anyone who pays vai this method to watch out for seems they just add it on even without you requesting it.
  6. HI Sent of my DPA request to the address at the top of the page on the 3/3/06. Been in contact with TSB customer services serveral time they ackowledge they have received it and is being dealt with. What do i do next ?
  7. Bankfodder, i think they do record the amount - well i know they do. I am not entirley sure but if the amount is incorrect then surley the entry has to be removed as it is defamtory. I think, you could argue the fact that if the unlawful charges had not been imposed then the person may have been able to clear hi/her debts and the default may have never been a factor
  8. Yeah think it s time the gloves came off. Can i claim compensation for breach of contract, as they have clearly failed to act in my best interests, with regards to acting on the fraud information. I also have the letter from Graham Welsh to say they accept that they have failed to act on the information i gave them, and they are willing to refund the charges and set up the new account number, but that he could not do the latter personally and just to go into my local branch and they will be happy to do so. No mention of all this hasstle i am now having. I think i will keep the DPA thing seperate for now, ill just try and get a final response from them with regards to my account (or lack there off) and then once the DPA info arrives ill hit em for everything in one go. Threaten court action, as i said just wondered if i could claim compensation for all the stress and hastle ive been through not to mention breach of contract (and the banking code aswell) Ill compose a letter and post it on here so you can have a butchers before i post, see if there s anything i missed or can be phrased better Thanks Barry

OK just to keep you all up to date, been told now that (after they closed my STEP) account that they cannot open me a new one as these accounts are designed for people who do not have a bank account. Since I do, rather i said i had to open an account with a different bank becuase of all the trouble ive had. Basically get lost we dont want your business. Funilly enough my first reverve account is still open and they have just ordered me a new card start I can start using it again. Still not received the DPA request from them which was sent 29/3/06. They have refunded me alot of charges £500, and my account is back in the black, but i know i havent got them all back. Can anyone advise on the next step i am right royally pi**ed off about the fact they are just trying to get rid of me.
  10. Upon getting a copy of my credit ref I have noticed TSb have registered a defualt and a CCJ or the same debt can they do this?
  11. Cool 28 days and counting then, but im goin after TSB fro putting it on there in the first place as the majority of it are charges
  12. Just been in touch with equifax, they have confirmed it should be removed when 6 years has elapsed. How can it affect your credit once removed
  13. Can you tell me what the CRA is, also can anyone confirm for definate that the DEFAULT is or can be removed after 6 years regardless of weather its settled or not
  14. I think in the first instance i will tot up the charges and send them the initial letter. I wont make an issue of the 6 year limit until they do, could also make the point that they have contacted and updated my credit record since Arpil 2000 so could that be consrude as kinda re started the 6 year limit if they asked for payment after the default date
  15. bear in mind i was really only a student whne this happened, i was only earning around 120 per month and they upgraded my account to "select" with a VISA debit, thats cos around 3-5 per month thats when the charges stated coming and it snowballed from there
  16. I need the DPA, but i the default was for £4,700 - give or take 3k are charges & and intrest. Could this be dealt with in the small claims court or becuase its a default would need to go somewhere else
  17. Im up for it believe me, I have all the time in the world and have a few hundred quid to spare to go to court. I have already sent the DPA and sent TSB an email yesterday to ask where they are up to, i got a reply almost instantly to say my statements are being prepared and are on there way soon. Would you know if the Default can be removed after the 6 year period even if the account is not settled.
  18. Bugger!!! what happens if obviously then the defualt was made up of illegal charges, can i request a copy of the pre default notice that was supposed to be sent to me before t was registered, i was working away at the time. If they cannot produce it would i have a case for it to be removed
  19. Defaulted 19/04/2000 £ 4,541 Can any one help with this, around £2800 of the above default are charges. As the default is coming up to the 6 years can i still claim the charges back. Also one the 19/4/06 passes will this default be removed from my credit record regardless of weather its settled or not. What can i do if i disagree with the defualt
  20. Yeah ive asked for all transaction and charges for whole duration of my acocunt and enclosed 10 quid cheque. Thought id start that part of it whilst i wait for a reply from the Fraud dept to get back in touch,
  21. No but maybe thats how there gonna try and shut people up. Thing is it will just make people push on either further and go to court.
  22. Just sent the DPA off, just wondering what there gonna try next. They were deffinetely trying to discourage me from using the account. Dont really see what the fraud dept can do, they ve done nothing for 12 months, just think its an excuss to get me to give up and get lost
  23. Right, just as ive posted the last repy i gets a phone call from the lady i spoke to at Natwest lunchtime. She told me she has just tried to open my account and there is a block on it from Fraud Dept, they have informed her that they will not authorise my new account to be open until they are satisfied there is no further fraud on my accunt (just in the nick of time 12 months late). She said she will get a reply in 7-10 days and let me know. She also inquired as to who i was banking with at the moment and advised me that i was just better off sataying with that bank. I said no thanks i want my account back, she conluded by saying that the STEP account i opened was only a basic account, so i said the one i have with Nationwide is too and would like to start putting my salary back in with them as soon as possible. She was basically trying to tell me to Pi** off. What can i do if they wont let me have another account, this is not justa straight forward claiming my charges back so we ll close your account type situation. Where do i stand with regards to my rights

Right went in lunch time, they still said it was being dealt with so decided to ask to speak to the manager who duley came out and as soon as i started shouting about fraud and them taking no action (bear in mind its lunchtime and packed) he quickley agreed to get it set up today. so we ll see what happens next
