  1. Thanks for that car2403. Can i incorporate the CCA request within the 7 day letter, but change the 7 day to the 12+2? Again, thanks for jumping on board. I have been reading this site for months, but just wanted reassurance before sending the next stage of letters. Silky77
  2. Hi Guys, i've been reading up on SARs and CCAs for some time now and have come to a stage where i'm a little unsure which way to go now. There is a lot of info if you have sent the CCA £1.00 request and which letters to send depending on what you have provided, but i can't seem to find as much if you have sent a SARs request and not had anything back from GE. The scenario is my partner has a GE Credit Card and has been making payments but they have been holding it in a holding account for some reason and she has been getting chasing letters, phone calls galore and defaults threats from them. I sent a strongly worded letter to them to sort this straight away as we have evidence of the payments and that we want any charges that have been applied as a result to be removed. I though whislt sending this letter i might as well incorporate a SARs request within it along with a £10 postal order to see if everything is legit. This was sent recorded delivery 17/09 and we had acknowledgment from them dated 19/09 and within the response letter they refunded the charges and wrote: "With reference to your Data Subject Access Request, I have passed your details to the relevant department who will respond to you seperately." Now the 40 days is well up and we still have not received anything else at all, i was just wondering what i should do next. I have the following breif letter from this site but is this the correct stage to follow, and will it be enough? I fell i should be sending something that should kick them right where it hurts!?! LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam Account: xxxxxxxx You have failed to comply with my Data Protection Act Subject Access Request dated (Insert Date). If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. Yours faithfully I hope someone can point me in the right direction. I have more CC's that i want to look into but i don't want to get confused as to where i am with things.   3. May leave the CC alone then, and just go for GE. I don't mind if they close my account, i just don't want them to demand the Loan i have with them and the CC balance to be repaid - that would be bad for me, have quite a bit on them!
  4. Hi GW, definitely go for it. I got a bit worried at some point in it all, but everyone on this site chips in to reasure and help you out. Can't believe it Lat, the money has already been transfered into my account already. In actual fact it had been credited on the 28th;) , i just never bothered checking my account as thought it would be at least a week. But guess what - Since the 19th June they have again charged me £125 in charges:mad: I can now officially say that i have beat them now:p Now onto the next venture, GE Money! I have a fair few Store cards which have charges on them because HSBC:-x kept recalling the payment. What i want to know is can i claim for the collective charges from all GE store cards or would i need to go through each one seperately and claim them individually. I'm also going for the HSBC credit card now8-) (they shouldn't close my account down should they)?

  6. Nice and sunny here in Notts too, shame sat at work still - never mind, got a beer on the go to help things go down. Do you know how it takes for HSBC to get money into your account once you sign the acceptance?
  7. Your not on your own guys, they did this to me and messed my account up big style. I transferred just enough money into my current account to cover the payment of my loan with them, but the cheeky gits from the credit card side of things took a payment even though i never had a direct debit set up with them. Needless to say this caused no end of problems, and i incurred £75 charges for it. I complained for nearly 4 weeks, to eventually get a refund of this - but the idiots refunded it on my credit card. Again i Complained, because what good is that - it still left my account overdrawn. Eventually they paid me £125 as a good will gesture! Then after finding this site some months after this issue, they had pee'd me of so much i went in for the kill:D

  10. Thanks guys, i sent the acceptance yesterday but just crossed out the bit about keeping my claim confidential and sent a this as a covering letter. Dear Sirs, Please find attached the signed proposal of the refund of bank charges, however I have deleted the confidentiality section as I do not agree to this. May I thank you for your prompt response, and look forward to a speedy return of the funds Yours faithfully, (EDITED) Hope this will be ok. WIll let you know when it sows in my account.   11. Hey guy's, just been to pick up my post. Had a letter from DG sols. Nothing to worry about, it was just the OFFER IN FULL When i send the acceptance letter do i just re write thiers but state that "however i do not agree to keep the fact of my claim and ***** ex gratia payment strictly confidential." A quick response would be great so i can get the letter in the post tonight to avoid the strike - or should i send it back special delivery Thanks Guys
  12. Thanks guys n gals, i thought that was the case! Will phone MCOL today to find out why they have not provided details. but will also send of schedule to DG (yet again:rolleyes:) - is kate Eaves one of the DG lot? Hope so as it is her and the other 3 email adds that i sent my schedule last time to. They did state when i got my 80% offer that i was claiming for a charge that was over 6 years old, but this wasn't over 6 years when i sent my very 1st letter off. I'm assuming i'm still ok with this!
  13. Low and behold, the Notice of Acknowledgement is on my door step. "An Acknowledgement of Service of your claim has been filed today, a copy of which is attached. The defendant now has 28 days from the date of the service of the claim form to file a defence." However they have crossed out "a copy of which is attached" Don't you think thats a bit crap! how the hell do they expect me to know who i'm dealing with!?! Shouldn't i at this point have got a 2nd page with the sols details?
  14. Cool, so i can keep stacking up the pennies on the ratbags. I still have to wait for the acknowledgement to come through with the sols details yet though! I'm assuming this will come through any day now. How long is it now that you had aknowledgement, and have you had to fill in the AQ?
  15. Well what do you know, got a letter from the court accepting HSBC's aknowledgement and my judgement has een cancelled. I'm asuming i will get a letter with DG's details to send a scehdule of charges (although i have already sent this when i entered into the judment) Will make sure i send another copy anyway special delivery and email. Do you know if i should recalculate the interest as of the date i send the details to DG or use the one i sent to the court for back up? At least i'm at a familiar stage now, guess i'm in for another few months waiting! Starting to wish i had gone for the 85% offer, Oh well:rolleyes:
  16. Thanks for that, if they request a stay am I in for a long wait then? I'll get right onto today then, no time like the present. When executing the warrant it gives you a box to wirte additional info, do you think i should put in the number of times i have written to them to let them know what my position is and that they have only ever responded once throughout the whole procees? Thanks for jumping on board, with you on my thread i feel like i have back up! was feeling a bit in limbo:confused:
  17. Just never had no replies as to where this will take me, hopefully laughing all the way to the bank. I would hope this means i will get the full amount i have fought for, it just confused me as every one else's threads i have read have followed the same path of HSBC filing defense at last minute. Hey catlover, i'm frustratingly past your stage - HSBC never even acknowledged my MCOL claim (issued 14th May)and have not filed a defence, so i issued notice of default and sent them and DG (even though i've never heard fom them) letting them know my situation and that if they do not reply in 7 days i will execute the warrant for judgement! I am now at that stage today, very apprehensive to do it at this as no one has been able to offer any advice for someone in this situation! I think i have no other option but to go ahead and issue the warrant!! I just hope i'm dong the right thing now
  19. hi guys, i have my own thread set up but not getting no replies of help. I was in the same boat as you all at one point, had notice of issue from MCOL 14th May, defendant had till 2nd June. I had no defence set against it, and didn't know where to go after this, so issued the notice of judgement. Hoping at this stage i would get a positive response from HSBC, i sent a nice enough letter stating that if i had heard nothing in 7 days i would have no option but to issue the warrent. I have been waiting to see if any one else had been in this position for guidence, but i have trouble finding anything that has gone to this stage. Sorry to butt in, but just after some friendly advice before i shoot myself in the foot!
  20. Is there anyone out there that can offer any advice please. I seem to be struggling to get a response. The situation now is that i entered a notice of judgement 5th June, i also written a letter to HSBC office and DG sols to state the situation and that i intend to persue if i have no positive response from them within 7 days. In addition i also sent an email of the letter and schedulke of charges to the 4 addresses on this site to the guys at HSBC (rachel tomilnson, debbie daubney, kate eaves and alan burden) as i have never had an acknowledgement since i issued the online claim! I am really annoyed now as i have gone through claiming money for my girlfriend and have had a settlement today from barclays, and that is only after 3 weeks. I want to issue the warrent now, purely out of anger:mad: , but do not want to burn any bridges. I feel i have given them ample enough time now. I really could do with some sound advice asap before i execute the warrent. Has anyone else had to go this far. Please, Please Fix it for me Jim to get my money back!

  23. Just not sure how to go about getting my money out of them? Do they have to pay up the full amount now? If so, how long should it take now?
  24. Was wondering what to do now? HSBC has not acknowledged my claim, and today was the last day for this. Just spoke to MCOL and they said i can enter a judgement tomorrow. Does anyone know what exactly happens when i enter this judgement. what does this entitle the bank to do and where do i stand with getting my money out of them!
