  1. Any help on this would be very much appreciated. I have recently made a claim against a ppi policy for my car after I became ill and havent been able to work for the last few months. I was initially told by Lombard that I was covered but then I was later informed that I wasnt and apologised for the confusion. The reason - I had opted for the Silver cover and my policy would only pay out in this instance if it was Gold cover. Problem is I was never informed by the Garage owner who acted as intermediary for Lombard and sold the policy to me that there were different levels of cover and the form was filled out by him and then signed by me. The garage owner admitted to me verbally that he doesn’t know the various levels of cover and has never been told to explain these to customers however he will not put that in writing and appears to have told Lombard a different story now. Lombard disagree that I have been mis-sold this policy. I have also since found out that the garage owner is not a registered insurance intermediary via the financial regulator, I am waiting on a response with regards the implications of being sold a policy by someone who isn’t registered. Can anyone make suggestions regarding my situation. Does anyone know if insurance can be sold by someone who isn’t registered and an insurance intermediary? Many Thanks Pancho
  2. Thanks for the advice max good luck with your claim. This morning I received a text from someone unknown offering 60% off but doesn't state what this is for? I eventually realized the text no. is very similar to mbna's.
  3. I know this goes against what people say but I phoned mbna and told them I wouldn't be paying. They firstly extended the deadline to today and then explained they would be shut down if they held onto the debt any longer than that. I asked what happens next and it was explained that it would be sold to a DCA ands that I should have contact within a week. I was told I can phone back later on in the week to find out who the DCA is. How do I find out how much it was sold for? Should I cc the newly appointed dca?

  5. Thank you so much for the very quick replies guys. I must admit this shook me today but you have reassured me so much. The debt is approx 13k and was taken out about 5 years ago, I have paid the minimum ever since but haven't been able to for a few months. I asked for my cc after looking at this forum but unfortunately they sent a copy of it to me.
  6. I've had a phone call today from mbna chasing up payments on a credit card debt I am behind on. They are saying that if I don't make a £200 payment tonight they will pass my account onto collections. Sorry to be naive but what are the consequences of this as I will struggle to make so much of a payment?

  11. Would anyone be able to help me, Ive received a copy of my CCA 36 days after my request. Could someone have a look at this and let me know if this is a valid CCA? A second document will be added next. Many thanks.
  12. Ive unwillingly found myself mixed up with ARC now for an old Egg debt too. Capquest were initially employed by Egg to chase the debt but now the baton has been passed to ARC. I CCA'd capquest recently and they sent the CCA after the 12=2 day period but before the 30 day period. Should I CCA ARC now? Any help would be appreciated.
  13. David Ive had the credit card for approx 7 years and have stopped paying towards it recently until they give over a CCA. Sorry to confuse things eastendboy, I was enquiring latterly with regards to my egg/capquest cca request which has got my mind ticking over as to whether or not its enforceable now. It looks right, with my correct signature, the right address for where I was at the time, the amount of credit made available, the interest rate stated as well.

  15. So eastendboy if they dont supply the info within 12+2 days the account is in dispute, but if they then supply it after this time period where do I stand?

  18. Thank you Scarlet for your kind words, MBNA are playing dumb and making out theyve sent it. I should have stopped the conversation on the phone short really and regret providing any info to them at all. Couple of queries though- Was it my responsibility to let them know that they were in breach as 12+2 days had passed, they said I should have informed them but I was waiting for the full time period to elapse. Does anyone know what the next step is if they do find it though, I just want to be ahead of them and expect the worst.
  19. Having not had much luck with Capquest CCa request I have sent a similar request to another debt of mine - MBNA (Virgin Credit Card). The 12+2 days have passed with no reply then a few days later I received a letter containing print outs of transactions carried out regarding charges to my credit card account and nothing more. So as far as I am aware they are in breach of the request, I am now waiting for the 30 day period to elapse of which Im about 8 days in with 22 to go (is the 30 day period working days?) Ive just had a call from MBNA (even though the letter states everything to be in writing from now on) saying that terms and conditions were sent out (they werent) and they have had no reply or payment from myself (which they havent until they supply my CCA). The lady on the phone was abrupt and mentioned that once they do supply the terms and conditions that I have 14 days to pay the balance. Is this the case as I must admit it has me worried?
  20. Unfortunately I received my CCA from Capquest after the 12+2 days but before the 30 extra days and it looks right. My next step is to reclaim the charges which have been applied over the years and look into the PPI both of which account for 50% of the balance. In the meantime I guess I will need to come to an arrangement as to a minimal amount I can afford. Any other suggestions?
  21. Im in a similar scenario with the infamous Capquest. My 12+2 period elapsed two days ago. During that time I did get the letter asking for 28 days to investigate this matter from Capquest and then later on I got a letter from Capquest along with all the statements going back to 2001 from my Egg account but no CCA! I have come across a template letter for 12+2 days elapsing but Ive noticed some people wait for the 12+2+30 days to elapse before sending any letters. What is considered the best course of action? Also Capquest say they are acting on behalf of Egg rather than having bought the debt from Egg does that mean if no CCA can be found then this will get passed back to Egg and they will start chasing me instead? Any help would be greatly appreciated.
  22. I have read on another forum that worse case scenario will be that some other bank buys the debt and has the power to claim the debt back in full with very little notice. Sorry to be pessimistic but Im in the same boat but with twice the loan.
  23. I have heard that it is possible to haggle the amount you owe if you are willing to make a lump sum payment. Does anyone hve any experience of this? I have three credit cards which I would like to clear with a lump sum Im expecting from a remortgage. Unfortunately the amount Im getting from the remortgage is less than expected and I am unable to pay off all three credit cards. I have been told it is possible to have a short settlement agreement which allows you to pay off a fraction of the full amount owed however before I approach the credit card companies, I was wondering if anyone could give some advice on this? What occurs to my credit rating if I take this route? Many thanks in advance.
