  1. Anyone had experience of PPI in Ireland? I'm helping my dad (who lives in Ireland) with a claim in relation to a more complicated PPI claim with an english firm called St Andrews Group. My dad put a claim in having been unable to work and was paid for the period of 12 months to cover (Halifax credit card monthly payments). Once the 12 months was over they stopped making payments and pointed to terms and conditions saying that they will only pay for a 12 month period and no longer. When the initial cover was taken out the terms and conditions provided to my dad had nothing about this 12 month clause and when brought up with St Andrews Group they apologised that the incorrect policy documents were provided (this is in writing). Furthermore during a previous phone call with a St Andrews Group the representative said they dont have terms and conditions and that my dad would have to approach Halifax for this instead. Now they say they do, when my dad asked for a copy of the telephone recording they told him there was a technical error and no recording could be located. Handy for them. After a few letters sent they apologise that the wrong policy was provided but state that the new terms they provided do have a 12 month clause. Im a bit at a loss as to what to do now? Can anyone suggest how to proceed? Many thanks
  2. The council have confirmed by telephone the amount outstanding for the year is £510 and not £1000

My scanner isnt being nice to me so I thought Id type it instead- " NAME - XXXXX ADDRESS - XXXXXXX DATE OF ISSUE - XXXXX ACCOUNT REFERENCE - XXXX PROPERTY REFERENCE - XXXXX PROPERTY ADDRESS - XXXXX OTHER PERSONS LIABLE DEFAULT NOTICE COUNCIL TAX - PAYMENT ARRANGEMENT WITH REFERENCE TO YOUR PAYMENT ARRANGEMENT AND THE RECENT REMINDER ISSUED TO YOU BECAUSE THE ARRANGEMENTS HAD FALLEN INTO ARREARS. YOUR ARRANGEMENT HAS BEEN CANCELLED. PAYMENTS HAVE FAILED TO BE MADE AS AGREED AND UNLESS THE AMOUNT OF £1000.00 IS PAID IMMEDIATELY, FURTHER ACTION FOR ITS RECOVERY WILL BE INSTIGATED. " For your info, I dont believe the amount owed is any more than £550!
  5. Will do this when I get home Brigadier but it is short and sweet, no allowance for time to remedy default and the amount appears to be a round figure for the hell of it and double what I believe is owed. Strange.
  6. Ive just received a Default Notice for the Council Tax which has none of the pre-requisite terms and has a figure amounting to twice of that which is owed. Do Council Tax default notices have to follow the same rules as other default notices for credit cards for example?
  7. Can anyone advise, the original lending (credit card) and PPI was from Egg but Cabot were assigned (absolute) the account a couple of years ago. Who do I make the approach regarding mis-selling of PPI to, Egg or Cabot? Thanks in advance.

  9. Is a case précis a case summary?
  10. Can someone assist me in what is involved in preparing a case precis? The judge has ordered that the parties confer (I am defending) and file "a case precis and agreed (if possible) Directions for Allocation and Case Management" for a Case management conference taking place. To date the Claimant has made no effort to contact me regarding this.
  11. Can anyone assist me on this point please. In regards to a credit card debt my monthly statements show monthly interest applied at 1.093% yet my APR is supposed to be 12.9%. When I use an online calculator (http://www.stoozing.com/mon2yr.htm) to work out monthly to yearly interest conversion I dont get 12.9% instead I get annual non-compound equivalent at 12.48 and annual compound rate of 13.21. Does this mean my statements do not correctly show the interest rate when compared with the rate stated in terms and conditions or am I missing something here?
  12. It does indeed state that they will seek interest but they have claimed monthly arrears that are during the period between the claim being issued and now, just a month away from trial. Its quite clearly monthly arrears that they are claiming.
  13. Can anyone assist as to whether or not the Claimant can add further credit card arrears to the amount claimed months after the claim has been issued and we await trial? For example, the particulars of claim is for £1000 but the trial is six months further on from the particulars of claim and now the Claimant is claiming £1600 (i.e. £1000 original arrears plus 6x£100 monthly arrears) at trial. Or is the amount at particulars of claim stopped at the original amount?
  14. Sorry Blondie, new bloke and co. for not replying on this til now. Ive had another matter with Egg which was priority. I elected to do nothing to date and today have received a settlement offer from Moorcroft and a settlement offer from SCM. Im confused!
