hi the same thing has happen to me the bank has offered me the charges minus interest and i am due in court. i tthink as i may take it as i feel that it guareeted.

What do you think of this response Thank you for your letter dated 19 March 2007. I respectfully decline your offer of £2,592.00 in Full and Final settlement. You may not have been aware that I commenced legal action against you for the full amount plus interest and costs on 22 March 2007 as I have not had any response from my previous correspondence. I wish to stress that I will accept this offer only as part settlement and do not accept your offer as Full and Final settlement, I would ask you to reconsider your offer. Alternatively, should you wish to settle my claim in full, then please forward the balance of the claim £3,892 plus £120 court costs without further conditions and I will inform the court that the claim is settled. If you fail to respond within 7 days of the date of this letter I will no alternative but to continue to pursue my claim through the country court whereby I shall seek the full amount and interest plus court costs totally £4,993.19.

hi the offer was for £2,592. i orginally claimed 3,992 in charges. which make 1300 pounds different. i stated court proceedings yesturday on line. i am now unsure about which rejection letter to send back as they are 2 different types. 1 before court action and 1 after. i am aware at this stage bank will not be aware of court action and i would rather they would make me another offer. hope this is clearer. babyk

hi everyone i filled in mcol yesturday and submitted it to court, then today i recieved offer 2,592 from rbs claim for 3,992.what my next step will it complicate matters as i have commenced court proceedings.

hi everyone it is now 14 days since 2 nd letter stating i would give them 14 days to comply.is the next step small claims or should i send them further letters. they have just completly ignored me, not even acknowledge they have recieved thr letter. babyk

hi its babyk does any one think that the banks are stalling ,as they are waiting for the the ruling on bank charges due the i end of march or april , which means there unlickley to response to anyone pror to this date. does any one know how long the court process takes. thanks

the interest is the 8% interest calucalated on the spread sheet by martin babyk

hi i am claiming 3,822 charges from the bank, with intrest this amouts to 4,999 if i was to go to court . i sent letter on 16 february which informed them that they had 14 days to reply to my request for charges . they did not reply ,i telephoned them and they said they were not looking at any claims for 5-6 weeks, due to volume of work ,these charges had created. i then sent them 2nd down loaded letter from martins money tips . which gives them 14 days to reply before sarting court proceedings i changed this timescale to 7 days as they had ignored all previous letters. i am unsure what do to do next. should i wait the 5-6 weeks or commence court proceedings within the 7 days. babyk

hi did not make my information clear i am requesting 3,882 charges without intest and 4,999 with intrest at 8% if i was to go to court. my letter, which i downloaded from martins moneytips,gave them 14 days to reply and i stated in my eairler post when i telephoned them they said they would not look at any claims for 5-6 weeks, due to the large volume of complaints. thanks baby k

hi everyone i have just started my claim against RBS. total 3,---- with interest 4,---- i sent my letter of requesting payment on the 16 february 2007 and to date had no reply. i telephoned them today and they informed me that due to the large volume of complaints that it would take 5-6 to look at my claim and anybodys. i sent them a second letter stating that at they have ignored the previous letter, i would commence court proceedings in 7 days. IT is clear that they are not going to reply what shall i do. help please ,baby k.
