Does anyboby have a copy or similar that they could email to me please? Many Thanks, Chris.
  4. Hi, I don't suppose you could help me with my court bundle. I have been trying to download Bookworms bundle for assistance, however my rather old (windows '98) pc keeps trying to open it with Windows media player!!! Have tried changing to other applications to no avail. Could anybody please email me this? Thanks, Chris.
  5. Sorry, just one more question...... I have an old Barclaycard statement that reads 'Notification of a change to the Barclaycard tariff of charges. We are allowed to charge for our losses & costs if you break the Barclaycard conditions'. We are making the following Tariff of Charges; change from 08/10/2003. We will charge £20 if your balance is over the credit limit at any time. Would this be enough to show that Barclaycard deem exceeding their credit limit as a breach of contract, with a penalty charge to follow? Thanks again, Chris.
  6. Thanks for info......AQ in the post today!!!!
  7. I think I may have messed up my court claim. I have issued against Barclaycard @ Northampton as opposed to Barclays Bank PLC........I am now at the AQ stage. Part of the defence states 'Barclaycard is a trading division of Barclays Bank PLC and not a legal entity in its own right.' Will this be thrown out or should I carry on regardless?? Thank for your help, Chris.
  8. In relation to the Microfilm issue, Barclaycard have provided me with Statements back to August 2003 (including Microfilm stored info), they have however told me that they don't have any information before this date. Are they not required by Law to keep this??

    Advice please!!!

Hi, I am currently claiming back charges from various credit cards, however I am experiencing difficulties from Barclaycard. I have finally received statements (including those stored on microfilm) back until August 2003. The attached letter stipulates that this is 'all they have'. There were a number of charges applied to my account before this date, so obviously I am keen to get this information. Is it likely that they have disposed of this information or are they just stalling. Are they required to keep this info for a particular length of time, say 6 years?? Help would be appreciated. Many Thanks, Chris.
  10. Thanks for input, seems a little harsh though seeing they had removed the overdue amount from the last 6 months statements, then reapplied it after the CC Claim........but i'm not suprised!!
  11. Over about a six month period, four years ago, I was hit with about £300 of charges for overlimit/late payments. Eventually RBOS agreed that I could pay a lesser monthly fee (£70 as opposed to the min. £90), although this meant that the overdue amount on the account continued to increase due to the above lower payment. Eventually RBOS removed this overdue reminder from my account after 3 years of meeting the above arrangement. I have now issued a county court claim for a return of the original charges. RBOS have responded to this with a demand for the full overdue amount mentioned above (some £400), to be repaid 'NOW'. Fortunately this isn't an issue, I'm just curious as to whether they can actually do this??
