  4. Hi, Thanks for replying so quick, the Court is Wellingborough. Will get the SOC updated, and posted out ASAP. Do i need to send a copy to the court, or is it just to Barclays? Thanks
  5. Hi Everyone, It has been a long old process, i am at the point of helping a few friends, we have received a GENERAL FORM OF JUDGEMENT OR ORDER. Stating: Upon reading the documents filed upon it appearing that there are many similar cases proceeding in this court which do not come to trial, it is ordered that: 1. The claim is allocated to the small claims track 2. The claimant shall by 1st August 2007 file and serve on the Defendant a schedule setting out each charge of which the Claimant claims repayment, together with an explanation of the basis on which the claimant claims repayment. 3. if claimant fails to comply with above, case thrown out 4. Case is sta\yed between 1st - 29th August 2007 5. if no settlement is reached by 29th August 2007, the defendant shall by 12 september file and serve a schedule in response to the claimants schedule......etc 6. if defendant fails to comply, case thrown out, judgement served to bank. 7. if defendant complies, matter reffered to district judge. Please could someone help me, as i am unsure what to do now. Thanks Peter
  6. Hi All, HELP !!!! Just checked status of claim online, and Nationwide have entered defence disputing all of my claim, but they have paid out the majority of the claim already, minus about 45 quid. I'm bricking it now!
  7. Hi All, Another update, Sent a letter to nationwide, stating that if they don't pay up the outstanding amount, i will continue with the court claim. Have given them 7 days, which is until about when the case ends. Thanks to everyone that has helped.

  10. Hi, I am in the same boat, not sure about them closing an account. But did you receive the full amount refunded? How long was it after you filed the court claim? Thanks
  11. Why are Halifax Taking so long, they know they are in the wrong. They are taking the biscuit. I'm getting really annoyed now!!! Oh well, i can wait, got all the time in the world. Oh Yeah, Still nothing since they acknowleged.
  12. Hi All, Update, Have received another amount deposited in my account last week, for £613.10p. so total received back so far is £775.19, so i'm short by about 46 quid. Also this morning received the letter from Nationwide saying they are giving me 30 days, to repay any overdraft on the account, before they close the account. Bar Steward's I knew it would happen, good job i've moved to another bank!!!

  14. Hi All, Just quick note, to say that my nationwide claim has been acknowleged. and a mysterious cash credit has appeared in my account (£162.12) if it is right, it is about 20% of my claim! I want the other 80% back!!!!!!! Consumer Action World Cup Me 1 Banks 0

  18. Hi All, Now that halifax have basically admitted by paying the full amount, what do i do now, do i have to notify the court about the payment, or do i wait for halifax to do this, as they have said they have done so. Thanks
  19. Thanks for that Don, Have submittted quote this weekend, so not long till my credit card balance is paid off!! I think the best thing is, is that i used my halifax card to pay to file my claim!!!! Can't Wait.

Howdy all, Received acknowledgement this morning, stating they intend to defend the full amount, checked bank account this afternoon, two cash deposits that suspiciously add up to the amount i have claimed for. Will wait for automated letter from halifax saying it will cost them too much to take it to court, and they have paid in full, but will move money to another account first.   24. Just An Update Checked MCOL this lunchtime, and Halifax have Acknowledged my claim 26/05/2006, just waiting to see what reply i get from that. Managed to beat the postman, this lunchtime replying to halifax last letter. Should push things along nicely. Thanks
  25. Morning everyone, Have just received letter from halifax this morning saying they whave increased my offer to £946, but it's too late, it has already been submitted to court. Also on the letter it says " Thank you for your letter dated 29th May" and " in an attempt to reach an amicable solution to your complaint" I don't think £946 out of £2925 is a very amicable solution, do you! So i have responded this morning saying "unfortuntely it has now been issued to court proceedings, i will be claiming the full amount of £2925.44, which includes the 8% interest and my £120 court costs. if they wish me to drop the court case against them, i require them to pay the full amount plus costs to the approriate bank account." Thats also after i had given halifax an extra 2 weeks to reply, so original date for court proceedings would have been the 6th May.
