  1. I waited the 40 days for my list of charges from Cahoot, rang them today to see where they were and was told the address we have has been updated, the new address to send things recorded delivery is: Cahoot Friars House Manor House Drive Covenrty CV1 2TE I'll now try again!!!
  2. I have just received the funds from Lloyds! Thank you soooooooo much. I am now starting claims against Lloys Business, A&L, Cahoot and a 2nd Claim for this account, since this claim!!! I am so chuffed, thanks again!! :D
  3. Many Thanks! I have sent an email today! Let's see, if they don't pay by end of day Monday should I instruct Bailiffs?
  4. I wrote to them last week, but the 14 days the judge set is up on Monday - should I insruct Bailiffs Monday? Is there a number I should call to chase or just instruct Bailiffs without any further calls or letters? What is the procedure with instructing Bailiffs? What forms do I need to complete etc? Has anyone else had to instruct Bailiffs? A frustrated Sophia!
  5. Have you been paid yet? see my new thread - I have received a letter threatening court for my O/D, but this will be cleared if Lloyds pay me!!
  6. I received my General Form of Judgement in my favour dated 3rd July. But haven't received a penny as yet. I have a £2000 overdraft but my charges have gone up and up as I've stopped using the account. The balance sits at £2213.62 o/d But I won the judgement and am waiting for £2407.21 from Lloyds, obviously this will clear the entire Overdraft. Today I received a letter demanding the £213.62 by 11th August otherwise daily interest will incur!! How can I get Lloyds to payup by 11th August??? This is so stressful, I thought once I'd won the case it was over! Thanks Sophia:eek:

  8. I have just called the court for an update.... The Judge has given his descision in my favour - Yeeeehaaaa!! I know everyone on here says it's just a matter of time and I haven't got the money yet, but the stress is over!! I am now downloading leaflet EX321 which tells me how to get the money from Lloyds.......... But any advise wouls be gratefully received. I've not heard a button from LLoyds or their Solicitors so can anyone tell me how long I should leave it before my next step and in fct what that step is?? Thanks Sophia
  9. I've just tried to contact Cahoot about getting copy bank statements. They have told me there is a £5 charge per month, but I have been banking with them since 27th August 2002! Do I send the data protection letter and if so what address do I send to? Thanks Sophia
  10. Hi, Does anyone know the address to send the Preliminary letter to Lloyds Business Banking? Is there anything different that happens with reclaiming charges from business accounts? Thanks Sophia
  11. Well the judge still needs to issue the order in our favour, I can't get excited until that happens as Lloyds have been so crap to me that I can't quite believe it will go my way until it does! Fingers crossed though. Sophia.

I called the court and they confirmed thay have received nothing and told me to complete the Issue of notice requesting an order to pay immediately. Please let me know if you hear anything and I'll do the same. Thanks again!
  13. Heard nothing as yet?? I'll call the court again. But I don't understand what happens now as the deadline the court gave was yesterday so should I put my bundle together?

Hi I received a General Form of Judgement or Order from the court today, it says that the defendanet has until 4pm on 16th July to serve a document answering the questions: Is the case intended to be contested to and at trial? Does the Defendant intend to apply to adduce expert evidence? Is this a court date?? Should I begin to put my "bundle" together as it mentions no more than 7 or less than 3 working days I should file my Bundle?? Should I expect to hear from Lloyds at this point? Thanks Sophia

I just checked my schedule of charges it's your spreadsheet I used and only have listed O/draft excess fee, Unpaid D/D, Unpaid S/O in the left column and I just complete the Interest on interest column on the right - it is the one with the blue and yellow columns - is this not right?? I remember asking you guys about this when I did it and was sure I'd done it correctly?? Can I email it to you to confirm?
  17. Their defence reads: 1. the Defendant Lloyds ....... It is admitted that the Claimant has been a customer of the bank at all material times. 2. By opening an account with the bank, the costomer enters into a commercial arrangement with the bank for the provosion of banking services.................. 3. By maintaining the account in credit, or within any limit agreed the customer may avoid most if not all charges. If the costomer fails to ensure that there are insufficient.......... 4. There is no breach of contract; the charge cannot therefore be a penalty, consequently there is no requirement that the charge be a pre-estimate of the Bank's loss. 5. The customer is given advanced warning of charges being imposed; .... 6. The charges are fair and reasonable, and it is denied that they are unlawful. 7. The customer is notified of the charges in plain intelligible languageat the conclusion of the contract, and on each monthly statement. 8. Furthermore the Claiman's claim appears to be misconceived in that the Claimant is seeking a refund of overdraft interest. There is no claim for refund of the authorised rate interest as it is contractually due and is a core term...... 9. In the premises: 9.1 the charges are for banking services, and are not damages nor a penalty; 9.2 the Bank is entitled by contract to impose the charges, which are fair and reasonable; 9.3 it is denied that the charges are unlawful or contravene any statute or regulation. 10. The Claimant's claim is denied in it's entirety. It is further denied that the Claimant is entitled to the sum claimed or to any sum from the Bank.
  18. Hi, I just got their defence through the post but no questionaire so I'm not sure whats going on?? The defence has 10 points, point 9 consitist of 3 parts, is this normal?? Sophia
  19. Hi, I received my notice of issue. My claim was issued on 8th May it was served on 16th May, Lloyds acknowledged and so I worked out they had until 23rd (Monday) I've not heard anything - but just called the court, who hadn't sent me their defence and the questionaire. I'm going to collect all this today - so now I need to print all the info etc. Could someone send me the thread listing everthing I need to supply? I'm really stressed out now!! Thanks S.

Lloyds have filed their defence so I am awaiting that from the court But I've received a letter from Ben Jenner of Customer Service Recovery Centre in Andover, this was sent the day after they should have responded to my court claim... Dear Miss Mason, Thank you for your letter dated 16th April 2007. I am sorry that you've not been happy with our response so far. I am unable to add to our letter dated 11th April 2007. This is because we have already outlined our position on the points you have raised. We see from our records that you have already issued a court claim for repayment of these fees and that our solicitors are dealing with this. Apart from explaining our position, there's nothing more I can do at this stage. Thank you once again for taking the time to raise your concerns with us. Yours sincerely...... Is this a normal response? What should I expect next?? Sophia :confused:
  21. Hi, I received the notice of Acknowledgement today, so they have 28 days to file their defence. What should I expect once this happens? I've not heard anything from Lloyds since their response to my first letter - is this normal, or do they usually try to contact to discuss?? Should I expect anything from them or just wait for the 28 days and a court date?? An anxious Sophia. :-|
  22. I have still not received anything from Lloyds since my notice of Issue was sent. It tells me on there that they have until 30th May to reply. What do I do tomorrow if they don't reply? Is this normal??

I received my Notice of Issue from the court dated 8th May it was deemed served on 16th May, I've not heard anything from LLoyds except that they have now cancelled my Overdraft fascility and require the full £2000 returned immediately and until it is they are charging me 2.20% per month. If they refund my charges I would receive £2372.71 so obviously this would sort the overdraft. What should I excpect? Does it usually take Lloyds this long to reply to the Notice of Issue and what do they usually reply? I am getting really stressed with this now.

Hi, I have sent my Prelim letter and received the standard LLoyds response, so then sent my Letter before action which I've had no response as yet, D-Day to start action is tomorrow so I'm just reading my small claims self help pack and will complete my N1 to send tomorrow. It says in the pack that I should telephone adversary, I'm not keen on doing this as I get flustered on telephone calls and I'm nervous, is it something I should do or shall I just send the paperwork? I'm nervous about completing the forms as I scared I'll get them wrong, does anyone have any advice??? A Nervous Sophia!!
  25. Cool, all sent recorded - think I'll start filling in the court forms now, as after reading a lot of the others claiming against Lloyds it sounds like they don't actg until then anyway!!
