  3. Smashing, that's exactly what I wanted to hear. I'll get on to them sharpish. Sorry for the late reply btw, life has bitten me in the backside. Well, half that and half I simply forgot/didn't have time. Anyway, this is starting to go on about PPI, not retarded companies trying to screw money out of people via dodgy ways - I'll make a new thread in the approriate Forum for my PPI Claim. Cheers!
  4. Hi citizenB, They replied to the letter with some crap about knowing all about the statute barred stuff and bla bla bla, but that they will hand the account back to whoever gave it to them. I'd call that a success, tbh. For now anyway, let's see what whoever gave them it do... If I throw a SAR request to HSBC, will that cause any problems with the Statue Barred thing, or am I still okay to chase them regarding PPI even though it's SB? Cheers.

  6. Yonks ago, I'm 99.99% certain it's over 6 years ago. In fact it's deffo over 6 years, plus wouldn't it show on my Credit Record if I'd paid them within 6 years? I may be wrong on that, please correct me if I am! Bump - What can I send to the Debt Collectors to tell them to get lost? Cheers.
  7. Hi guys, I took out a loan & Credit Card with HSBC years ago. More than 6 years ago, deffo. Now it appears HSBC have joined the two together into a single debt (£2,458.14) and appear to have sold the debt to "Clarity Credit Management", who are now sending me letters demanding I pay up. The funny thing is, the debt doesn't even show on my Credit Report on Experian. How on earth can they chase for a debt that's not even on my record anymore?! Can I fight this, or do I have to pay it? Cheers.

  11. From what I am made aware of via reading on this site, Claim again the same way you did last time. Calculate how much they've taken from Statements, send in the request form, and so on. Good luck for Round 2.

I got the following letter back from Mr. Higley: I'll send him it ticked and signed, but include a little note to say that it's not a 'final' agreement and that, as stated in my previous letter, if the charges continue another claim will be applied for and if they close or limit my Account I will complain to the FSA/OFT. Sound ok to you guys?

By the way it's been typed, I'm not sure if I'll be allowed to 're-slap' them for future Charge, so I have typed (ok I got lazy and OCR Scanned it ) the full letter below: Notes: #1 - They spelt my bloody name wrong, again! #2 - So if I accepted the offer, could I sting them again if they charge me in the future? Also, on the acceptance letter which I'm supposed to sign and return, they put this: Pardon ??
  15. Well well well... Stuart Higley has replied to me, and offered me "£2,192.00 paid directly to your account" which is the amount I put on my first letter to them. (Second amount is when they added a couple more charges on while the dispute was ongoing) I'm not so fond of copying a page and a half of letter onto here, but if you would rather I did, say so and I'll do so. Or be a lazy sod and use OCR. The question is, what do I do?

I'm not so bothered about the Overdraft Interest, so do I leave the following out: 'Overdraft Interest £xxx.xx' and 'Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day [(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day)] OR at such rate and for such periods as the court deems just.'   19. Bit stuck on the N1 Form: Charges £xxx.xx - I put my charges total here, yeah? Overdraft Interest £xxx.xx - The 8% Interest, right? Interest under s.69 County Courts Act 1984 £xxx.xx - What on Earth is this? Court Fee £xx.xx - Rather obvious. TOTAL £ xx.xx - As above. Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day [(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day)] OR at such rate and for such periods as the court deems just. - *confused* ;(

I'm currently filling out the 'Application for a fee exemption or remission (ex160)' Form, and am stuck on the following bit: '1d The title or number of the form that you would like the court to issue Please give details of one form only' I'll assume I keep the following one: '1c The case number or claim number (if you know it)' as I don't know the Case/Claim Number?   22. Hmmmmm, it seems better to use the 'Small Claims Court' one. I'm also wondering if I am exempt from paying the Court Fees as I'm on Housing and Council Benefit - anyone know about this? I guess I fill in the Forms on this page here ?
