  1. this just goes on and on.... just after xmas I phone as I am still getting letters, as the bill had now gone up to £293.. I did owe them £63 for call charges - fair enough I pay them and they apologise for the error... another letter appears, phone told to ignore it... then another letter, this time asking for £113...ignore it and then a letter from DCA, chasing me for £113 that I dont owe...?? DCA is now leaving voice mail and threatening home visits lol... phone Pipex and they cant see the charge in the system, they will call me back...never happened...I phone again today...cant see it in the system, but they are upgrading, can u phone back?? really sick to the back teeth of the runaround from this mob and the stroppy cow from the DCA, wasnt too happy when I fought fire with fire and she put the phone down on me... anyway, I think its time for a letter to the CEO or similar..anyone agree?? kenny
  2. I did speak to the National Debtline and the halifax about the offsetting and the debtline concurred that it is legal. I am in the process of changing all DD's across to my missus's account n the meantime, nothing new on the Halifax front.... They have still not responded to my "viewing of my agreement request" of 18th November. However they did respond to my SAR request with simply a pile of statements..I will be asking for my full SAR again grrr....they took the £10 PO onwards and upwards kenny
  3. ok, quick update on my sitiation.... offered 20% F&F on 25th November - no response got my SAR in - well statements only and £10 PO returned - looking for a killer SAR letter as obviously my request was ignored also got a letter (shown below) from RMA - unsure whether DCA but looks like they have upped the ante what is my next move???? - thanks kenny

  6. okay ... halifax are now emptying my current account and a savings account to the tune of £500 in the last day... 4 seperate transactions... 99% of it is childrens tax credit... surely they cant repeatedly rape my account every time something goes in??? phoning CAB in the morning.....but need to get all DD e.t.c. away from halifax...asap... need advice fast... thanks kenny

  8. well I got a reply from the halifax today... not regarding "a viewing" of my agreement, but to inform me that since I had not made any arrangements to pay my direct debit, they have taken everything out of one of my halifax accounts and left 1p.... can they do this - surely not... what is worse is that is all childrens tax credit money in that account... even when I did pay the dd - it wasnt from that account here is the letter Image of HAL081208 - Photobucket - Video and Image Hosting thanks kenny what is worse is that I have money in another halifax account, about £500 or so....

  10. hmmm... ok got a default notice in from EGG... 28th Dec.. Their agreement appears to be rock solid....I wrote to them asking for a interest freeze, got a reply today... please phone us... I phoned egg and they basically said that I could not negotiate an interest freeze until I went into default??? I would be required to produce a income/expend sheet - this will be a nightmare as a I gamble for a living... now I can afford the payment a month, but I was hoping to get some sort of joy with the interest freeze/reduction without going into default.. any ideas on how to get some sort of joy with Egg before I go into default... kenny

  12. Hi Mate, yeh definitely smell a rat here... I wrote to mint on the 18th of November and I still a/w a response. I have also requested a SAR on my account buy as of yet - nothing..... I may challenge mint to a viewing of my agreement at my local RBS branch (I done this with HALIFAX - but all is quiet on the western front with them)...   13. firing this off to them today... bearing in mind that they have said they will accept 80% F&F...I also requested again my SAR I do not acknowledge any debt to M&S Money – Account in Dispute Firstly I would like to thank you for your correspondence of 1st December in which you refused my 20% Full and Final settlement. In response to this it is my view that the documentation supplied on two separate occasions by M&S Money is improperly executed. It is also my view that the debt will be un-enforceable in a court of Law and therefore I acknowledge no debt to M&S Money. I offer this 20% F&F settlement to M&S for a final time, as I need to approach other creditors ASAP. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released for any liability. I also request that, if accepted, you will make an entry on a credit reference agency file relating to the above account as "satisfied" in full. Payment can be made within 2 weeks of receiving your written agreement of this offer and method of payment. If this payment is not accepted, I will be unable to make any payment other than a token payment of £1 per month. I also note that whilst this account is in dispute you should not be adding interest or charges, requesting payments or harassing me with numerous calls. I am sorry to say that M&S is guilty of all above and I will be reporting M&S to the appropriate agency. Furthermore you cannot pass this debt to a DCA as no agreement exists. As I have already stated this is MY FINAL OFFER to M&S… I look forward to your response. Yours faithfully,
  14. ok the ball is still my court with this one.... they rejected my 25% offer and would accept 80% - which I am not prepared to accept... like above my absolute max is 33% - but unsure whether to stick to 25%... any advice please... is their 80% offer an admission of no enforceable agreement??? in the meantime my SAR arrrived, with my £10 PO returned?? they sent me over 110 pages of A4 sheets...   18. hehe, I get a bill in from pipex for £263.44 which is exactly double the so called cancellation charge.... really unbelievable these people, I aint wasting the time with a call will write a letter and offer to pay my broadband up until 03/12/08 as I just changed to BT today... kenny
  19. ok guys Subject Access Request'd them about a week ago... here is there response to my 25% F&F Image of M&S80% - Photobucket - Video and Image Hosting now obviously they can GTF with there 80%, but is this an admission that they know they cannot enforce this debt??? any advice on my response.... my absolute ceiling is 33% for a quick closure, or do I simply reply and say..my final offer is 25% kenny ps my other thought, is to write to them forget the DCA, lets go to court:)

  23. ok BRW done a quick check paid £720 a year for approx 3 years (minimium amount each month), and then £1800 in the last year (balance transfer) so in effect by my reckoning paid bout £4k to M&S on a £7k debt kenny

Het BRW, some fantastic points there mate, I would need to SAR them,to get that kind of info, I only keep maybe the last 2 or so statements However I do have online banking, so I wonder how far I could go back with that and check my statements the £1750 represents about 25% of the total debt. TBH if they wrote back and said yeh they would accept F&F I would bite their hand off... although I do see your point and agree with it... will check my statements in the morning and see what it amounts to thanks kenny
