I did the same as you regarding the interest and although my charges have been refunded the interest was not (and I am that fella that got refunded after the preliminary letter) I think it is too complicated for me to try and work out what interest charges I can claim for but one school of though is claim for it all and let the bank work out how much is authorised interest charges. Don't know if that would work though.Couple of questions for anyone in the know:
1. In my preliminary letter, I added on all the interest charges from my statements. I now believe this to be incorrect as I have an authorised overdraft. Am I right in thinking it is easier to just leave out reference to interest.
And why oh why are they being so inconistent - didn't one of us get a refund after preliminary letter. It's not fair.
Strange that you wrote to Charles Bacon but you got a response from Customer Services. perhaps he got the sack after my refund:D

Also, I think that we've all had lots of letters by now claiming that the T&C's are legal and the charges are a fair reflection of costs etc...
This, I believe is a deliberate deception, and therefore as you were deceived from knowing the truth about their debt to you, then they have excluded themselves from the statute of limitations.
It's up to you, but if I had 'my time' again, then I would definitly pursue that angle.
Just read this and it could be that NW are paying up without much argument is to keep withion the Statute of Limitations.
It seems strange that just refund the money with no prior or post refund correspondence

When I received my statements I noticed that a lot of them were duplicated but not just the ones that showed charges. I don't think they hav e any intention of going to court so it's my belief that it is an error. After all the banks are good at errors

Thew best place to start in the FAQ's. They are full of all the information and advice that you need before proceeding with your claim. But as Dve says its your timetable and your money

Seems to me the only way to get a result without jumping through hoops is to address all the letters to Charles Bacon. He will soon get fed up and issue insstructions to customer services to pay up without the standard delaying tactics.

If all of the charges have not been refunded then I would still carry on with your timetable as they have not met your terms. Mine is slightly different in that all of the charges were refunded but none of the interest element The charges were all refunded on the same day but in 4 seperate transactions. Some of the interest I claimed however was for an agreed overdraft and as such should not have been part of my claim. I want the bank to make me an offer for the interest part. I also have had no written communication from Nationwide

I have exactly the same problem and when I submitted my claim I included all of the interest payment for the month I attracted charges even though a proportion of it was for a agreed overdraft. My reasoning is that the onus is on the bank to work out what it was entitled to take and what was an unlawful charge (I know they won't admit that) I am going to phone Nationwide and see if they will make an offer regarding the interest element as they refunded the other unlawful charges withinin 1 week after the the first letter was sent. They have still not responded in writing, just credited my account with the full cost of the charges but not the interest.

I'm going to give them a ring tomorrow as I still haven't received any written confirmation about the refund. They still have refunded no interest charges so if they refuse I may well send a LBA and pursue the rebate of interest

Nationwide do not make a charge for a DPA request. This info is from Christopher Swales, Data protection Administrator. Write back to whoever is named on the DPA letter and request your £10 back

Having dealt with the Nationwide for the last 20 years or so I must say that other than the company stealing money from me on a regular basis I have always been treated with respect by all of the staff I have come into contact with. They may not have done what I wished them to do but we always discussed the situation reasonably. I would imagine that to have to listen to irate customers daily must be soul destroying especially when some of them came be rude and obnoxious. Perhaps I have been luckier than some of the other members of the forum but I can only tell it how it is.

I think that we are starting to look for problems where there are none. On my online full statement it says "refund of interest charges". I think it is just a way of repaying without setting any precedents. If the money refunded is equal to the cost of your claim then you have no need to continue. If it's not them I imagine you can continue the claim for the balance.

I received a bank statement today for my Flexaccount but nothing regarding the refund. It appears as though they are trying to refund the money with as little fuss or communication as possible. They have perhaps realised that what they say to an individual is posted here for the benefit of other claiments. Only atheory of course but it seems alittle strange that refunds have been given with no written communications

No letter as yet. I went onto my internet banking site to pay a bill on Saturday and noticed that the available balance on the transfers screen was £1973 more than on the statements screen. I phoned customer services who put me throught to a supervisor who said the repayment would not be available until Tues morning and she did not know what it was for. Checked again today and on the statements screen it said that it was a refund of charges and was available to spend ( I've transferred it out of the account just in case!!)
