  1. Lowell Portfolio 1 Ltd Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to. Date of issue 17/6/2014 + 19 days ( 5 day for service + 14 days to acknowledge) = XX + 14 days to submit defence = XX (33 days in total) What is the claim for – the reason they have issued the claim? The Claimants claim for the sum of 8K for monies due under the consumer credit act 1974 between the defendant and LLoyds TSB Plc. The defendant failed to maintain the contractual payment under the terms of the agreement and a default notice has been served and not compiled with. the claim also includes statutory intrest pursuant to section 69 of the county courts act 1984 at a rate of 8.00% per annum (a daily rate of 1.53 from the date of assignment of the agreement to the date of issue () being an amount of £1025.00 What is the value of the claim? £8.500 Has the claimant included section 69 interest (8%)within the total claim or is it shown separate within the Particulars but not added to the debt? YES Is the claim for a current or credit/loan account or mobile phone account? Loan When did you enter into the original agreement before or after 2007? 2003 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Debt purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? Not sure but likley Did you receive a Default Notice from the original creditor? No moved house Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? don't think so Why did you cease payments:- Struggled with payments Was there a dispute with the original creditor that remains unresolved? Yes bank charges on bank account and still to be sorted PPI on Loans Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes with LLoyds but could not carry on with agreed payments
  2. Hi dx100uk This is currently for the loan only, I have not received anything from the courts chasing my OD yet. My OD had a limit of £900 and after my account went into meltdown charges from Lloyds added now stands at £2300. do I paste the answers to the link here?
  3. The £1634.00 PPI Amount was on my Lloyds agreement so I have not calculate any costs on top yet. I could not use the link it said Your user account may not have sufficient privileges to access this page. The loan amount Lowells originally wanted was £6900, now they have put interest on and want £7990.57 also court fees £410 and solicitors fees £100 total is £8500.57 The PPI was on a Lloyds credit card consolidation loan.

  5. Hi, Just received a County court claim form issued by Lowell's wanting 8K over for a defaulted loan 5 years old now. I requested a CCA and Lowells sent back some paperwork which also show some PPI that I had with the loan, I then back in February I sent off a SAR to Lloyds because I had other loans in the past as well and wanted to check them out, LLoyds replied wanting me to go to a branch to show some ID and a Bill to prove who I am due to a house move but that where I fell over a little, I had to wait for my passport to arrive as this was my only I.D. This has now arrived and LLoyds have been issued with my I.D I just have to wait for my SAR to arrive form Lloyds but now Lowells are now breathing down my neck with this County court claim!! Please help!
  6. Thanks for the help ims21, I've just received this paper work today so its quite a lot to take in but looking at the screen captures they have sent me its starting to come back to me. This agreement I now have is for a consolidation load and my credit card was moved over to the loan in 2003. sorry to mess you around. Thinks its best if I send off for a SAR tomorrow I had a credit card before 2003 do you think I could claim back anything that far back? thanks
  7. I have screen captures of statements and these show some figures and abbreviation's by the side and doesn't make much sense. I also have a Lloyds current account with a overdraft and the overdraft limit was £900 now stands at £2300 and lowell are chasing me for that as well. I missed a few DD and the started getting hit by charges and could not recover. Their is loan protection on the card as well. Is it true that if a signed credit card agreement does not have the terms & conditions on the same page its unenforceable?
  8. Hi Ims21, Thanks for the quick response, Lowell have given me 14 days to pay and theirs no chance of that, Would the debt be enforceable in court? Just wanted to know the best route to take with this.
  9. Hi All, I need some help with my Lloyds Credit Card, I took the card out on 31.10.03 and got into trouble with it around 2007 along with my Lloyds bank account. I carried on making small payments until 11.1.2009. This has now been passed on to Lowell who are now chasing me. I have sent them a CCA and now have statements and a signed credit agreement (separate page), terms and conditions and a copy of a loan protection agreement. I was self employed at the time. Would be very grateful for some help. thanks MrPond
