  1. its okay I have worked it out, so, I think my form is completed, Do I need to send 3x N1 forms, 3x scale of charges and a chueque for 120.00 to Swindon Magistrates court? Or just 2 copies so that the court has one and halifax has one? After this has been sent, do I just wait? will the court contact me with my next step? Wow the forum is quiet today, no one offering any help at all! My local court is Swindon, or do i need to do it through my local small claims court which is Bristol? Please help!

  5. I know its not mine, but how often in life do you actually get someting like this happen to you? If I can keep it I will, I did my bit, I told my company. So if I take what both of you are saying, I would have to pay it back if they noticed, but I can claim its gone and agree a repayment schedule?
  6. Hi All, My salary is not paid direct by my employer but through a payroll agency. Last week I was short paid but paid twice by my employer, I advised my employer of this and the same day, the duplicate payment was cleared from my account (didnt realise they could do that). My company then organised to pay me my shortfall (230 pounds) on a new transfer but when the money hit my account, the company had paid me my original salary too. (1220 pounds) I advised my employer, who checked their bank account and advised it hadnt come out of their account, so as far as they are concerend they dont care. My question is, can I keep it? how long does it have to stay in my account before they legally cant ask for it back, or is it theirs forever and I cant spend it? My friend said that they can automatically recall it up to 6 days from the transfer date which would be Monday, and that after 14 days they cannot ask for it back... this sounds a little to good to be true! Thanks for your help in advance, as it goes without saying, I would prefer to keep it!!

  8. Excellent, I was advised to fill out the N1 but I might have to do it online, I cannot get to the court at all next week, and I need to do it Monday. At least if I complete it Sunday night it will be issued Monday. I will read up on the MCOL stuff tonight to familiarise myself with it Bullocks! I demanded a response in 7 days of my LBA not 14... I am not doing very well here am I!
  9. Cheers Dude! So I fill it out, and manually take it to Swindon court? On this form I can write that I am claiming interest, even though I did not put that on my LBA? I dont want to cock it up at this stage!
  10. Thanks Martin! The letter I sent Monday was my LBA ( I didnt realise) So I have given them 7 days to respond before I issue Court papers. I didnt include interest though, have I messed up? When I dont hear anything, I write to the court, is this form N1? If so, do I send 1 to court, keep 1 and send 1 to halifax? I live in swindon so would I send it to Swindon crown court? Is it too late to add interest to that form?

  13. Absolutley brilliant!! I need to think about doing my LBA thing soon, as I guess i need to do it one week after I sent them my I will take you to court letter, or do I need to give them longer? I am worried about the law stuff, if he throws some at me I wont know what to say! Can you point me to what you had ready to say to him, I can then print it off and keep it with me incase I need it?

  17. Will do, just read that someone won a claim without even threatening court action... I so hope that happens with me! So should I call them maybe the start of next week and check they have my letter, or just send my next - I am taking you to court letter?

I recieved my "thanks for your letter but the charges are justified letter" They have forwarded it onto Customer Relations (should of just sent it there and not to my branch) (but then again my branch didnt charge me for my statements!) I didnt leave my tel number on the letter, will that hinder my claim, or will they use a number I have left on the account? T-minus 11 days until I threaten them with court action!

  22. Wow, your case really worries me, best of luck to you! My amount outstanding is very similar to yours, and before I started I knew there was a possibility of it going that far, but to see it written out week by week its a little intimidating. Maybe I will just settle.... help??

Hi All, Came across the site and spent most of my day reading through the posts about how people have challenged Halifax and won, I must say I was very apprehensive at first but this site has given me the confidence to push forwards and challenge them! I sent off for my statements on the 3rd Jan, they arrived yesterday and I didnt even get charged for them! I have calculated I have paid £1554.00 in the last 6 years on charges, today I send my first letter requesting my money back! Wish me luck, and thanks to you all for your support, if you hadnt of posted your experiences, I may never have got the bottle to do this! Nailz
