  1. Hi Everyone I am at a bit of a loss on how to proceed with MBNA. It is my hubby's account and we waited (patiently!) for all the statement to come back (two days before deadline). We sent of the prelim letter, only to be told to push off. We then sent off the LBA which we had a response to two days over the deadline. We have been offered £890.00 as a goodwill gesture and as full and final settlement. We had claimed for £2082.00. I have printed the letter off the bank templates regarding rejecting offers but my hubby is reluctant to send it off and accept the £890.00 in case we lose the chance again to get this money. Has anyone had this sort of thing happen and how best do i proceed. Hubby thinks that the letter to reject the offer is to vague, and it doesn't mention that we will accept what has been credited back to the credit card as a part payment. Do i just hit them with a county court claim for the whole amount or the amount minus what they have credited? HELP!!!!!
  2. Thanks Karnevil, sorry i didn't respond sooner, hubby has been very sick recently. Anyway, do i counterclaim on the same form that i am defending? and then do i counterclaim the full amount or do i take off the amount that i owe them? The counterclaim fee is £80.00, but on the counterclaim bit there doesn't seem to be anywhere where i can put the particulars of claim. I have sent a lba and schedule to abbey and heatons, i wondering if i should just send a copy to equidebt as they were originally working on abbeys behalf? I have received a lovely letter from Abbey saying how sorry they are to hear that i am unhappy, and if i give them 4 weeks they will sort out my probls, by which time the 28 days (obviously) has run out.
  3. I have sent both Abbey and heatons a schedule and lba. I thought i would give them a chance to respond before i counterclaim against the judgement they want to impose on me. I have sent my acknowledgment of service to the court and now have until 5th March. Apparently i have to submit a defence if i want to counterclaim, any ideas would be good on how to word this. I have been paying back a 2000 overdraft which abbey suddenly took off me and only have 450 outstanding, my bank charges however amount to 890.00. Can anyone help with the wording?

  5. I have recently asked Lloyds for £862.00 back, the first letter was, an 'I am so sorry to hear you are unhappy letter'. I wasn't happy so then hit them with the LBA to which i got a 'Really sorry we cannot refund your charges as we think they are fair' letter. Do i know just take them to court or send another letter to them. The customer telephone number on the letter is constantly engaged so i can't get through to anyone.
  6. Thanks Zooman, My total for bank charges is £890.00 is it ok for me to go in for this amount or should i just break even with Abbey?
  7. Particulars of claim: 1. The claimant claims the sum of £472.59 being the balance due at this date (although not since i made a payment of 20.55) in respect of monies due under an agreement in writing and made between the Claimant and Defendant. 2. The Claimant also claims interest at the rate of 8% per annum purusant to section 69 of the Count Court Act 1984 amounting to per day 3. Costs. This is all it says. Please can some one help with the best way to counterclaim or defend. Thanks.
  8. Have decided to defend the claim, I have sent off the acknowledgement of service and need to know if i have to send Abbey a schedule and LBA as a matter of course.
  9. Claim forms arrived this morning, as well as 6 years of statements from Abbey!!!! If i decide to counter claim do i go straight to the court bit or do i need to tell Abbey how much i want to claim for and issue a prelim letter? The total cost they are claiming for is £542.04.

  12. Thanks for replying, I didn't think anyone was responding which is why i added another thread with a different title. Sorry. I have just called Heatons asking them to clarify a couple of points for my information. Abbey still own the debt, the claim was filed today 31st Jan. £90 has been added to the overall debt of £472.00. I pay Heatons direct with my debit card. I am expecting the claim forms tomorrow or Friday. I also called Abbey complaints dept to find out where my statements are and a request was put in to Bradford on the 18th so i was told i should expect them in the next few days. If the debt is in dispute (as i am sure the charges far out weight what i owe to Abbey) can i still get a ccj?
  13. Help!!!!! My account with Abbey has been with Heatons for a few months, I am paying off a £2k overdraft and there is £400 or so left to pay. I called them this morning to pay my usual payment and as it was 2 days late (NatWest debit card was lost and i have only just received a replacement), i was told that county court claim forms have been issued. I am now unsure as to what to do as i am still waiting for the snail like Abbey to produce my 6 years statements and i am really aware now that court costs etc will be added to my debt. What action do i now need to take???? HELP!!!

  16. I wrote to Abbey on the 29th December asking for 6 years worth of statements. I started receiving statement last Friday 1 per envlope going back to April 06, is this normal? At this rate it is going to take 6 years to get all my statements and cost Abbey a fortune in envlopes and postage....
  17. Sent my prelim letter to Lloyds saying i would very much like my £860 back please!! The day the 14 days were up, i got a lovely letter back from them saying how sorry they are to hear that i am unhappy with their service and they will be investigating my complaints within two weeks. They also added a nice little pamphlet on 'voicing my concerns'!! Anyway i sent them the LBA letter and am now waiting for their response, although i'm not expecting one!!!
  18. Hi everyone I am just about to send off my prelim letter to Lloyds TSB (very excited!). Hopefully if all goes well then i can start getting this and other accounts back to normal. Isn't it amazing that when you start totting up how much they owe you, you can actually start to see figures that will get you out of debt!!! I'll let you know how it goes. Good luck everyone!!!!!!
  19. No, we went through GE Money but were told that First National are same company but not!!???? We are now solely with GE, do you think it is worth contacting them, i don't want to rock the boat if it will affect our current mortgage.
  20. Hi everyone, am just starting on the long road to (hopefully) getting some money back!!! Have just sent Abbey a SAR, and am just about to send Halifax bank a request for refund. I am also going to go after MBNA, GE Capital, Halifax Credit Card, Barclaycard and Co-op!!!! Can't wait, will keep you posted.
  21. Well done on your ERC payback. We have just remortgaged from First National to GE Money and had to pay £7000 in ERC (it was after 6 months), but it would have been £9000 if we had been remortgaging to another company. Is it reasonable for me to ask First National for all/some of this back?
  22. Hi, I have only just joined the forum and am currently claiming against Abbey, but want to claim against Halifax. The one thing I can't find is a data protection address for Halifax bank accounts. Also, is it possible to claim back charges from companies if the account has gone to debt collection?
